RE: UPDATE ON COVID-19 Ms. Meador said there are 86,994 COVID cases in' Virginia with 2,095 deaths, The Thomas Jefferson Health District reports 1,633 cases and 30 deaths. Greene County has 134 cases and 2 COVID related fatalities. The Thomas Jefferson Planning District Commission and the Central Virginia Regional Housing Partnership began accepting applications for the Emergency Mortgage and Rental Assistance Program on July 15. There are several small business grants available including the Rebuild Virginia Grant Fund and the County program being administered by the CIC for businesses impacted by COVID. Albemarle County and the City ofCharlottesville have made modifications to Phase 3 effective August 1 to go back to 50% capacity on indoor dining, face cover mandate for all public places, and a ban on gatherings ofmore than 50 people. Ms. Meador said she will be working with the Health Department in coming weeks to review data and will make recommendations to Mr. Taylor and the Board of Supervisors ifmodifications are indicated for Greene. Everyone needs to wear a mask, maintain social distancing, wash their hands, stay home if possible, and avoid crowds. These things are easy to do and can make a difference in slowing this virus down. Board of Supervisors July 28, 2020 Sheet 5 RE: GREENE COUNTY WATER SUPPLY PROJECTUPDATE AND RESPONSETO RAPIDAN SERVICE, AUTHORITY ACTION OF JULY16.2020 this exclusively and it was also discussed in closed meeting this evening. unaware oft the motion and voted against it. The motion included: toF RSA prior to the initiation of any new water service. Mr. Martin said the Board held a special emergency meeting on. July 21, 2020 to discuss Mr. Taylor said the RSA Board took action on a motion that was hidden from the public and Greene County. The two Greene County representatives, Mr. Martin and Mr. Williams, were Effective July 17, 2020, all water availability fees in Greene County will be paid directly Effective July 17, 2020, water facility fees will no longer bel billed or collected by RSA. Effective July 17,2020, sewer facility fees will no longer be billed or collected by RSA. Each oft these actions is contrary to agreements signed by RSA and Greene County and one party alone cannot change a signed contract. This action by the RSA Board demands a response from Greene County. Our water supply project must proceed to provide service to existing and future customers. The RSA Board did not apply their usual rule of deference to Greene County and thinks everyone who pays real estate tax should pay a bigger share oft the costs of our water project. The Board of Supervisors sets the Greene County tax rates. Building the water system RSA was created as an authority on. June 2, 1969 by Orange, Madison and Greene counties. An authority is similar to aj partnership where members join together to achieve shared goals or to advance a common mission. RSA does not work like a partnership and is really more of a confederation oft the three counties. Separate books are kept for each County it serves and for each RSA was created to do two main things or "purposes". Purpose A was the acquisition, construction, operation and maintenance ofa a water transmission, storage, and distribution system in Orange County. This purpose was achieved. Purpose B was the acquisition, construction, operation and maintenance of water supply and treatment facilities plus a water transmission storage and distribution system in Greene County that will supply, treat and transmit water from a water impoundment site near Stanardsville to the Town of Stanardsville and to the Ruckersville community and the area along Route US 33 between Stanardsville and Ruckersville. Greene County is still waiting for RSA to fulfill its purpose of providing a decent water system for Stanardsville. More than 35 years after RSA was created, Greene County still does not have an impoundment. In 2005, Greene County agreed to take on our own water supply project and Greene County's Water Supply Project is on track and looking forward tol breaking ground next year. The site has been selected and property purchased. Engineering and design of our system improvements is complete. Following multiple presentations about the progress of our Water Supply Project, the RSA Board of Members was asked to act on a slate of gradual water facility fee increases consistent with the Stantec Plan of Finance that RSA has known about since 2017. Greene County asked the RSA Board to follow our lead on a matter of great importance that would affect only Greene County per their rule of deference. Thei majority oft the RSA Board, representatives from Orange and Madison, put Greene County's preferences aside and put our water supply plan aside. They refused to act on the facility fee increases and instead took three unilateral actions on July 16th, all of them in violation of existing agreements. Their actions are was supposed to be RSA's job but they did not do it. system it operates within those counties. assumed millions of dollars ofRSA debt. sabotaging Greene County's future. Board of Supervisors July 28, 2020 Sheet 6 Mr. Taylor noted complaints about the water supply, or lack thereof, in Stanardsville. During a fire department training, the water supply tot the Stanardsvillea area was severelyimpacted. Mr. Taylor said the amount of water used during that training exercise would be equal to what RSA's lack of transparency and unwillingness to engage with the Greene County community about our needs, our priorities, and our programs with their system is a big problem. Itisr reasonable to expect RSA to bej proactive and helpful when service is interrupted. Customers want to know what is going on and what to expect. Getting information about a service outage RSA has a total of ten projects in Orange County and three each in Madison and Greene. Significantly more has been done toi improve systems in Orange than Madison or Greene. RSAis A safe and reliable water supply is al high priority and is critical to Greene County's future. Greene County has been frustrated by RSA's lack of attention and failure to fulfill its mission to our community for many years. It was RSA'sinattention to Ruckersville needs that drove Greene County to agree to build our own Water Supply Project. RSA has not fulfilled its purpose in Mr. Taylor said, at the direction of the Board of Supervisors, a resolution was drawn up whereby Greene County is requesting an amicable withdrawal from the Rapidan Service would be used to fight a house fire. four days after the fact is not good. clearly pushing for Orange County's future. Greene County in 50 years. Authority. Mr. Bowman read the proposed resolution. Mr. Herring said it was well known that RSA was aware of our project. There appears to be no plan to present to Greene County which takes away input from citizens, the Planning Commission, and thel Board of Supervisors as tol how we as a county will grow. They have stopped our growth and arel hindering our future. RSA had discussed taking on the funding fort this project and later said they could fund halft the project ifGreene turned over all financial resources we had and increased taxes toj pay for the other $30 million. No recreational activities would be available to citizens ifRSA builds. The Planning Commission asked a representative ofRSA to attend their meeting but no one showed up. Mr. Herring said he was very surprised by actions of the RSA Mr. Lamb referred to the water system service agreement section 4a.2 which states RSA shall collect the aforesaid water system facility fee on aj periodic basis in accordance with policy and procedures. RSA will disburse the County the amount of fees collected less the 10% administrative charge. They would have to get permission from Virginia Resource Authority to Mrs. Durrer said it is clear to her that RSA does not want Greene County. They want us Mr. Martin said hei is very sorry tos see what was tol have been aj partnership with our service authority turn into an adversarial relationship. The RSAI Board of Members voted to terminate the facility fee, ignoring the wishes and actions that the Greene County Board of Supervisors took on July 14. This much needed water project must be paid for somehow. If facility fees disappear, the only way to pay for the project would be significantly higher water usage rates. The second option would be to significantly raise real estate property taxes which he is dead set against. Greene County residents contribute 7.5 cents to water infrastructure now regardless of where they live. Board at their. July 161 meeting. stop collecting fees. out. She supported the resolution. RE: BOARD LIAISON REPORTS Mr. Bowman said he attended the Planning Commission meeting on July 15 where applications pertaining to the moving ofar mobile home park were considered. These applications Mr. Herring said there was a Mayors and Chairs meeting this past Friday. The Regional Housing Plan was discussed as was CARES. Act funding and how localities plan to use those funds. should be coming to the Board of Supervisors shortly. RE: COUNTY ADMINISTRATOR UPDATE Mr. Taylor shared aj picture of ongoing improvements to the exterior of the Visitor Center. He thanked the Board for their action on the Feeding Greene lease/purchase which will help address pandemic related spacei issues at the. Juvenile. Domestic and General District Courts where very cramped facilities makes social distancing impossible. Funds will be used toj provide satellite waiting areas for the courts and consultation space for attorney/clients. Additional space will be also bej provided for thel Registrar's Office to facilitate early voting. Parks and Recreation will have space at the Community Park to provide for safer operation for staff. These projects will make good use of available CARES Act funds. RE: MONTHLY REPORTS Mr. Martin said he was pleasantly surprised by information in the monthly report for Economic Development and Tourism that indicated a decrease of only 15% in TOT funds. Mr. Bowman asked for an update from Solid Waste regarding the disposal of plastic and glass. RE: OTHER ITEMS FROM7 THE BOARD Mr. Bowman said the vent on the front ofthe County. Administration Building needs repair. He requested an update on the status of the fire study and on the communication system design. Mr. Bowman also said he would like to talk about capital improvement projects and departments being able to usel left- over end ofy year funds for projects. He suggested department heads identify major capital improvement projects they are looking for sO the review process can begin. Board of Supervisors July 28, 2020 Attachment "E" RESOLUTION CALLING FOR THE UNANIMOUS CONSENT OF ORANGE AND MADISON COUNTIES TO THE WITHDRAWAL OF GREENE COUNTY FROM THE RAPIDAN SERVICE AUTHORITY (RSA) PURSUANT TO VA. CODE $15.2-5112 WHEREAS, on June 17, 1969 the counties of Greene, Orange and Madison formed the Rapidan Service Authority ("RSA")in compliance with the Virginia Water and Waste Authorities Act and WHEREAS, the original purpose in forming RSA was for the acquisition, construction, operation and maintenance ofwatertransmissiont forcertain parts ofC Orange County, Greene County and Madison County; and WHEREAS, RSA was also specifically formed in part for the express purposes of "the acquisition, construction, operation and maintenance of water supply and treatment facilities plus a wateri transmission, storage and distribution system in Greene County that will supply, treat and transmit water from a water impoundment site near Stanardsville.."; and WHEREAS, RSA is governed by a Board of Members consisting of six (6) total members, two (2) of which are appointed by the Board of Supervisors of each of the member Counties; and WHEREAS, historically RSAI has kept the operations, revenues and debts of RSA WHEREAS, historically the Board of Members of RSA has voted in support of various projects within each of the three (3) Counties as each member County's appointed Members have requested or recommended, and the Board Members have ina a segregated manner with respect to each member County; and deferred to the determination of each County as to its needs; and WHEREAS, historically RSA Board of Members have not sought to impose their will or determine the needs, fees, expenses, infrastructure or development actions or priorities in the other member Counties; and WHEREAS, historically, each member County's elected Board of Supervisors has been able to trust that their appointed Members to the RSA Board would be respected and deferred to, in order that the plans, priorities, decisions, and directives of each member County Board of Supervisors would be dutifully advanced by RSA for the benefit of their respective County; and WHEREAS, Greene County has experienced a large growth in its population and has increasing needs for water that RSA is unwilling or incapable of providing; and WHEREAS, in 2005 RSA and Greene County entered into a "Water System WHEREAS, Greene County assumed a portion of RSA's debt as part of the WHEREAS, pursuant to the 2005 Agreement, Greene County would collect water availability fees for the Ruckersville Water System, which money would be used to help Ownership and Management Agreement" ("2005 Agreement"); and consideration on the 2005 Agreement; and pay debt service, and for new infrastructure; and WHEREAS, on September 9, 2014, the 2005 Agreement was amended whereby RSA agreed to charge a "water system facility fee" and pay said fee to Greene County to be used for (1)debt service for debt incurred by the County, (2) debt service on the RSA debt Greene County assumed and (3) new watert facilities "as determined byt the County."; and WHEREAS, pursuant to the 2014 amendment RSA began collecting a facility fee WHEREAS, the Greene County Board of Supervisors asked RSA to raise the facility fee in 2020 pursuant to- Greene County's financing plan for managing the County's existing and anticipated debt service and infrastructure improvements costs, and to ensure payment of debt assumed from RSA by Greene County, and including funding a water impoundment for which Greene County has already spent $11 million; and on behalf of the County as required by the 2014. Amendment; and WHEREAS, on July 16, 2020 the RSA Board, led by the Members of Orange and Madison Counties broke from the historical practices of the RSA Board of Members, disregarded the arguments and wishes of the Greene County Members on the Board, and took the unprecedented step of determining for Greene County what was best fori its citizens; and WHEREAS, on July 16, 2020 the appointed RSA Board Members from Orange County and Madison County failed to even meaningfully consult with the Greene County Members before making significant decisions affecting only Greene County, nor did the Orange and Madison Board Members properly inform their Greene County counterparts of the actions they planned to take; and WHEREAS, on July 16, 2020 by a vote made by the Orange and Madison County Members, without any consideration to the desires of Greene County or the stated concerns of Greene County's Members on the RSA Board, did vote to unilaterally breach the 2005 Agreement by ordering that all water availability fees would be paid directly to RSA; and WHEREAS, on July 16, 2020 by a vote made by the Orange and Madison County Members, without any consideration to the desires of Greene County or the stated concerns of Greene County's Members on the RSA Board, voted to unilaterally breach the 2014 Amendment stating that it would no longer collect facility fees as mandated by the 2014Amendment; and WHEREAS, on July 16, 2020 RSA did issue a press release, without any consultation or authorization from the Greene County Members, and did falsely state that the 2005 Agreement required Greene County to "build White Run Reservoir Project, water treatment facility, and other improvements" by 2008. This is a false statement verifiable as such by reading the 2005 Agreement; and respect to the citizens of Greene County; and WHEREAS, it has become clear that RSA no longer wishes to fulfil its mission with WHEREAS, it has become clear that the RSA Members from Orange County and Madison County intend to make all determinations as to what they believe is best for the citizens and taxpayers of Greene County in place of the Greene County Board of Supervisors; and WHEREAS, the Board of Supervisors of Greene County does not believe it is in the best interests of the citizens of Greene County, to have Orange County and Madison County RSA Board Members ignore our adopted plans and priorities, disregard our vision for and investments in our community, and make decisions in our place to control our water infrastructure and supplies, especially since those Members have zero accountability to the citizens of Greene County; and WHEREAS, the Board of Supervisors of Greene County has lost confidence in RSA's ability to properly, equitably, and fairly, address or provide for the future water needs of Greene County; and WHEREAS, the Board of Supervisors of Greene County has lost all confidence that RSA can be trusted to provide any loyalty or faithfulness to Greene County; NOW THEREFORE BE IT RESOLVED that pursuant to Virginia Code $15.2- 5112(B), the Board of Supervisors of Greene County does hereby signify its desire to withdraw from RSA. ITIS FURTHER RESOLVED that pursuant to Virginia Code $15.2-5112(A), the Board of Supervisors of Greene County does hereby call upon the Board of Supervisors of Orange County and the Board of Supervisors of Madison County to consent to the withdrawal from RSA. ITIS FURTHER RESOLVED thati if an amicable and agreed-upon withdrawal from RSA is denied by Orange County and Madison County, the County Attorney for Greene County shall file all necessary legal proceedings to enforce the breaches of contract referenced above, and shalt take such additional legal action as necessary to force RSA to comply with its contractual and legal obligations to the Greene County Board of Supervisors and to the citizens of Greene County.
