RE: UPDATE ONCOVID-19 Ms. Meador said there are 25,800 confirmed COVID cases with 891 total deaths in Virginia. The Thomas Jefferson Health Department reports 354 cases and 13 deaths. Greene County has 16 confirmed cases with 1 death. Thel Health Department has held several free testing clinics over the past few weeks and a clinic is planned in Greene County on Friday, May 22. The EOC remains at enhanced monitoring level. A N95 fit testing was held on May 4 at the nursing home, the memory care facility, and the assisted living facility with a total of 97 employee participants. Ms. Meador said she is trying to arrange a second round of fit testing for nursing home employees. A large shipment of face shields was received from VDEM and there are four outstanding requests for PPE and general supplies. Just under $20,000 was received from the Governor Northam plans to enter Phase 1, which will last at least two weeks, of the reopening process on Friday, May 15 unless there is a change in the trend of data. Phase 2 would begin on May 29. Phase 1 will lift the stay-at-home order but Governor Northam is still advising iti is safer to stay at home. Phase 1 will not look much different for Greene County other than the Ms. Meador urged everyone to seek medical attention if experiencing a medical emergency. Hurricane season begins June 1 and runs through November 30 and information is available on the Emergency Services Facebook page and National Hurricane and FEMA websites. Mr. Herring asked when the Shenandoah National Park will reopen. BUDGET RE: PUBLIC HEARING - SECONDARY SIX YEAR PLAN AND CONSTRUCTION Mr. Frydl reviewed the proposed Secondary Six Year Plan for fiscal years 2020/21 through Unpaved road funds must be used toj pave gravel roads. TeleFee funds can be used toj pave 2025/26 and the Secondary System Construction Budget for fiscal year 2020/21. gravel roads or can be allocated to other priorities as the Board of Supervisors sees fit. Priority projects include: Bull Yearling Road - from Route 33 to junction with Route 639 Turkey Ridge Road -1 from South River to junction with Bull Yearling Beazley Road - end of pavement to Route 623 Swift Run Road Bingham Mountain Road -1 from Amicus to Route 612 Simmons Gap - Shady Grove to Mission Home Road Ice House Road - entire gravel road South River Road - end of pavement to end ofs state maintenance Mr. Frydl said the Board can add ai road to the Plan but funding is not available for another project at this time. RE: PUBLIC HEARING - REQUEST FROM CHESTER HULL FOR A SPECIAL USE Mr. Frydl reviewed the request from Chester Hull for a Special Use Permit for tourist lodging as listed in Article 5-1-2.4 ofthe Greene County Zoning Ordnance on approximately 0.88 PERMIT FORTOURISTI LODGING Board of Supervisors May 12, 2020 Sheet 5 acre, zoned R-1, Residential, located in Deer Lake Estates Subdivision at 119 Rudolph, Ruckersville, and identified on County Tax Maps as 60E-(1)-103. Rudolph Drive is a public road and VDOT did not have concerns regarding the use. Off-street parking is available in the driveway. Public water is provided by RSA and the site has a VDH approved septic for three Aletter was received from Leonard and Betty Corner, neighbors, stating their concern that any type oft business use in the neighborhood would potentially increase traffic and impact safety The Planning Commission recommended approval with the following condition: The Special Use Permit for tourist lodging is only applicable to the primary dwelling Mr. Frydl said camping in the recreational vehicle (RV) would not be allowed as tourist lodging. Ms. Kemp questioned if the homeowners would be allowed to stay in the RV while renting thel house as tourist lodging. Mr. Frydl said this would not prevent the owners from staying in thel RVifthey wanted to. The Zoning Ordinance does not allow camping for more than 30 days during the course ofa year. The Board of Supervisors can place a condition on the permit ift that Mr. Hull said they see this is an opportunity tol bring more tourist business to the area and Mr. Lamb asked ift the number ofl bedrooms will be expanded to which Mr. Hull answered no. Mr. Frydl said this use is only allowed in the R-1 zone by Special Use Permit and conditions may be placed on the permit. Mr. Lamb said there are 15 children who live on that street and he Mr. Herring commented on the owners residing in the RV, noting it would be difficult if not impossible to enforce. Mr. Frydl agreed and said there is plenty of parking in the driveway but on-street parking is not prohibited. Most people choose to park in their driveway. The public hearing was opened for comments and closed with no comments. Mr. Martin asked Mr. Hull ifl he intended to stay in the RV and rent out the house. Board of Supervisors May 12, 2020 Sheet 6 RE: PUBLIC HEARING - AMEND BUDGET TO ADJUST AGGREGATE AMOUNT TO Mrs. Morris said Virginia Code requires that the governing body advertise and hold a public hearing to amend the budget to include any supplemental appropriation which exceeds 1% oft the adopted budget. One percent of the adopted budget for FY 19-20 is $756,665.78. The Board needs to: make a supplemental appropriation in the amount of$11,555,000. Virginia Code requires a public hearing be held for re-adoption. Ms. Kemp said there was a question from counsel for al board that Greene County sends a representative to about the breadth GOVERNMEND). APPROVED ON IMARCH24.2020 ofthe ordinance. RE: PUBLICSAFETY RADIO SYSTEM UPGRADE Ms. Meador said the request is for authorization to proceed with a contract with Mission Critical Partners (MCP) for the third phase oft the radio project. Funding is allocated in the current budget and additional funds are requested in FY 2021. RE: UPDATE ON PLANNING FOR FUTURE EMERGENCY MEDICAL SERVICES Ms. Meador said UVA has terminated their contract with the County effective October 14, 2020. Wel have 180 days to determine aj path forward. Currently, wel have two units from 6 am to 61 pm and two units from 6 pm to 6 am. Funds in the amount of$1,104,000 are requested for this The first option is to do nothing which is not truly an option. EMS is not mandated in the The second option is another contractual service. AI request for proposals was released in February, 2020 and no responses were received. Another request for proposals is an option but The third option was a regional approach with Madison County. The Madison County The fourth option is the establishment ofa Greene County EMS Department. This option contract in the FY 2020/2021 budget. The County already has an EMS license. The County has a current agreement with the Rescue Squad for use of their apparatus, Other benefits would include increased coordination and communication, a county-wide training program, and control and accountability regarding treatment protocolsguidelines. The Operational Medical Director (OMD) could provide guidance, input and instruction without any difficulties. The OMD must be a licensed physician and the agency operates under their medical license. The goal is to have the best possible EMS system and the dependability and reliability of the overall service could bei monitored as well as consistency and professionalism. Ms. Meador said figures mentioned at the April 28 meeting have been revised. The Department would require a total of 15 full-time employees (7 EMTs, 7 Medics, and 1 EMS Supervisor). This will be an extremely tight budget but there would be just under $21,000 for remaining non-personnel costs. Part-time hours for EMT and Medics are included. Ms. Meador said all her certifications are still valid and she could staff an ambulance if needed. There is a potential grant from the State Office of EMS. That, combined with the existing Emergency Services budget, should cover costs without additional funding from the County. Board of Supervisors May 12, 2020 Sheet 8 The recommendation from Mr. Taylor, Dr. Perina (current OMD) and Ms. Meador is to establish a Greene County EMS Department. A phased approach must begin immediately. Ms. Meador reviewed steps in Phase 1, Phase 2, and Phase 3. Dr. Perina has agreed to serve as Operational Medical Director for this Department. Hiring of the EMS Supervisor position is a priority. Phase 1 should be accomplished in 65 days. Ms. Meador estimated Phase 2 will take 90 days and will include interview and hire for all positions, development ofa schedule, and on the job training. Phase 3 will be when the agency is fully implemented and begins emergency Mr. Herring asked ifthere would be sufficient funds for an "overlap" period with the UVA contract. Ms. Meador said she believes it will work. Mr. Lamb asked about revenue recovery. Ms. Meador said the rate is running at 60% now which is around $350,000 per year. Ini response to a question by Mr. Martin, Ms. Meador said shei is confident that efficient and effective members Ms. Meador said the County has a great relationship with the volunteer Rescue Squad and their Board of Directors and is open to any help that the volunteers can give right now. The volunteers are looking at how they can help the County. Mr. Taylor said the volunteer squad has an integral role to play with the County going forward. The County depends upon agreements with the volunteers for access to and use of equipment and station house to be able to provide Mr. Taylor said a public hearing is not required to establish an EMS department. Mr. Bowman thought the establishment of the EMS Department is really the only option we have to go forward. RE: RESOLUTIONT OF INTENTTO AMEND ZONING ORDINANCE update areas to come into compliance with state and federal regulations. The resolution ofintent to amend the Zoning Ordinance pertains to Article 21, Standards for Telecommunication Antennas and Towers. Ms. Kemp has worked diligently to identify and Mr. Frydl said this is presented as an item for first review and will be on the agenda for the next meeting for action by the Board. RE: GREENE COUNTY PPEA GUIDELINES Mr. Taylor said the General Assembly adopted a set of guidelines for the implementation of the Public-Private Education Facilities and Infrastructure Act (PPEA) in 2002. Such partnerships provide an alternative approach to procurement for public facilities and services. A locality may offer a basis for partnership such as land for construction of a facility and find a Board of Supervisors May 12, 2020 Sheet 9 partner who is willing to build a facility on county property. They may also operate and maintain the public facility in exchange for fees and other payments from the locality. Adoption of the guidelines is the first step required in order for public-private partnerships to be considered by a locality. A PPEA could be used to build and operate a public recreation facility such as a swimming pool; provide al landfill facility; build, operate and maintain a drinking water production and distribution system or a sewage treatment plant; or build and operate ai rescue squad facility. The guidelines position a locality to consider the use oft this alternative procurement vehicle. No PPEA can be considered or solicited for unless or until the locality has implemented or adopted a The County Attorney has developed a set of guidelines for Greene County that fully comply with the requirements ofthe State. RE: LIAISON REPORTS Mr. Herring said the Thomas Jefferson Planning District Commission had their first virtual meeting last week which went very well. Discussion centered on impacts ofCOVID-19. Mrs. Durrer said there is Jail Board meeting scheduled for Thursday. There are no cases Mr. Lamb said the Social Services Department has twice the number of applications. The Mr. Martin said the Economic Development Authority has had a couple ofmeetings and is considering a loan program that goes beyond their usual small business revolving loan fund. The EDA is really not set up to administer al large loan program and will bel looking for at third party to help administer a program. The Stanardsville Independence Day Committee has made the ofCOVID-19 at thej jail. Ruckersville Advisory Committee will meet this Thursday. decision to cancel the 4th ofJuly program this year. RE: COUNTY ADMINISTRATOR UPDATE Mr. Taylor shared data that reflected the continued, diligent service of county employees amid COVID-19. The presentation included data comparing last year to this year for the Building Department, the Economicl Development and' Tourism Department, Erosion and Sediment Control, Parks and Recreation, Planning and Zoning, the Solid Waste Facility, and Transit. Information forl Emergency Services focused on current activities for the department which are centered around The Community Park will be reopening under the Governor's Phase 1 limited guidelines. COVID-19. The Solid Waste Facility encourages customers to come on weekdays. RE: OTHER MATTERS FROM THE BOARD to discuss the transition ofoperations in July. Mr. Martin said Greene County Transit has announced a meeting with JAUNT on June 2 Board of Supervisors May 12, 2020 Sheet 10 Mr. Bowman felt the County needs an Emergency Operations Center for the Emergency Coordinator and Emergency Manager to operate out of. The Board should address this issue at Mr. Martin said COVID testing will take place in Greene County on May 22. Mr. Martin also said nationwide 54.6% ofresidents have self-responded to the Census. In Virginia, the number was 61.5% and 61.7%i in Greene County. The Census will start reaching out some point. to those who did not self-responded. RE: ADJOURN Board meeting was adjourned. WHEREAS onl March 12, 2020, Governor Ralph S. Northam issued Executive Order Fifty- One declaring a state of emergency for the Commonwealth of Virginia rising from the novel coronavirus (COVID-19) pandemic; and WHEREAS Executive Order Fifty-One ordered implementation oft the Commonwealth of Virginia Emergency Operations Plan, activation oft the Virginia Emergency Operations Center to provide assistance tol local governments, and authorization for executive branch agencies to waive "any state requirement or regulation" as appropriate; and WHEREAS Virginia Code $ 2.2-3708.2(A)03) allows, under certain procedural requirements including public notice and access, that members of the Board of Supervisors ofa county may convene solely by electronic means "without a quorum oft the public body physically assembled at one location when the Governor has declared a state of emergency," but only if"the purpose oft the meeting is to address the emergency"; WHEREAS the catastrophic nature oft the declared emergency makes iti impracticable and unsafe for certain public bodies ofthe County to assemble a quorum in a single location; WHEREAS the open public meeting requirements ofthe Virginia Freedom ofInformation Act are limited only by a properly claimed exemption provided under that Act of "any other statute"; WHEREAS federal and state guidance from the President of the United States and the Governor of Virginia have recommended suspension of public gatherings of more than ten persons; WHEREAS it is imperative that the Board of Supervisors and other public bodies of this county would be capable of continuing to assemble, both to address the emergency and to carry on the ordinary functions ofg government; WHEREAS Virginia Code $ 15.2-1413 provides as follows: Notwithstanding any contrary provision oflaw, general or special, any locality may, by ordinance, provide a method to assure continuity in its government, in the event of an enemy attack or other disaster. Such ordinance shall be limited in its effect to a period not exceeding six months after any such attack or disaster and shall provide for a method for the resumption of normal governmental authority by the end of the six-month period"; and WHEREAS the Code of Virginia clearly contemplates that a "disaster" includes an "epidemic,' " as seen in Va. Code $ 15.2-1724; and the courts of Virginia have held that [w]hen attempting to define terms in one part oft the Code," the words should be read with"a view toward harmonizing it with other statutes,"because "the Code of Virginia is one body oflaw. . Marsh V. Commonwealth, 32 Va. App. 669,677, 530 S.E.2d 425,430 (2000) (quoting Branch V. Commonwealth, 14 Va. App. 836,8 839,419S.E.2d4 422,425( (1992)); and WHEREAS, on March 13,2020, the County's Director of] Emergency Management issued aDeclaration of Emergency, applicable throughout the entire County ofGreene, Virginia pursuant to Virginia Code SS 44-146.21 and 15.2-1413; WHEREAS Virginia Code S $ 44-146.21(C) provides that a local director of emergency management may upon the declaration of a local emergency "proceed without regard to time- consuming procedures and formalities prescribed by law (except mandatory constitutional requirements) pertaining to performance of public work; NOW, THEREFORE, BE: IT ORDAINED by the Board of Supervisors of the County of 1. The Board of Supervisors, School Board, the Planning Commission, and any other County board, commission, or public body may, at their election, conduct any meetings and act upon agenda items before them for the duration oft the emergency declaration thereafter, whether under normal procedures or by solely electronic means, whether to address the present state of emergency (Va. Code S 2.2-3708.2(A)03), or to address any other matter (pursuant to this ordinance adopted in conformance with Va. Code $81 15.2-1413). When conducting ai meeting by solely electronic means, the Board of Supervisors, School Board, the Planning Commission, and Greene, that: any other County board, commission, or other public body shall nonetheless: a. Give public notice using the best available method given the nature of the emergency, which notice shall be given contemporaneously with the notice provided to members ofthe public body conducting the meeting; b. Make arrangements for public access to such meeting, whether physically or C. State in the minutes the nature of the emergency, the fact that the meeting was. held by electronic communication means, and the type of electronic communication means by which the electronically; meeting was held; and d. Otherwise comply with the provisions of Virginia Code $ 2.2-3708.2 (except for any requirement that would otherwise require a quorum ofthep public body to be plysicalyassembled). 2. Agenda items scheduled or proposed to be considered for the duration of the local emergency declaration not to exceed six (6) months by the Board of Supervisors, School Board, Planning Commission, or any other County board, commission, or public body shall be deemed continued for the duration the local emergency declaration not to exceed six (6) months, if the Board of Supervisors, School Board, Planning Commission, or other County board, commission, or public body does not take action on the agenda item during the referenced timeframe, including those agenda items for which state orl local law requires an affirmative action to bet taken within a statutorly-mandated timeframe and the failure to act can be deemed an approval; and 3. In the event that a public hearing matter is deemed by the applicable public body to present a critical goverment: function essential to continuity of govemment for the duration ofthe emergency declaration, thej public hearing may be conducted by an open public comment period called for during an electronic meeting, in which case, action by the goveming body shall be continued to a subsequent meeting pending receipt ofs such comments. Public comments shail be reçeived by written submittal (including but not limited to email) delivered to the clerk of the Board or designee during the period stated in the call forj public comments which comment period shall be a minimum ofsix calendar days. 4. The Director of Emergency Management's Declaration of Emergency is hereby 5. An emergency is deemed to exist, and this entire ordinance shall be effective upon its adoption. The Board of Supervisors reserves the right by subsequently enacted ordinance to ratified, pursuant to subsection. A ofVa. Code $44-146.21. rescind or amend this ordinance. 6. The provisions of this ordinance shall cease in their operation six months after the adoption ofthis ordinance; but all ordinances, resolutions, agreements, or other decisions ofpublic bodies made by public bodies oft this County at meetings held in accordance with the provisions ofthis ordinance shall continue in their effect.
