RE: MATTERS FROM THE PUBLIC Ms. Connie Perrin spoke in opposition to the purchase of property at 9715 Seminole Trail foru use as an enterprise center. The community has needs that must be met before spendingi money on wants that was discussed without the knowledge or input of taxpayers. She felt the reservoir project should be put on hold and re-evaluated to determine actual need. She also noted the shortfall in thel budget and the needs by the Sheriff's Department. Wec can'tafford to pay $800,000 for a property with a dilapidated structure that will likely require more than $100,000 in Mr. Keith Bourne asked the Board of Supervisors to intervene and delay the purchase of property for the enterprise center until details of the project are made public and reviewed. At a minimum, the public should be able to review a cost benefit analysis and operating budget. Itis understood that the debt for this project would be paid by revenue generated by the transient occupancytax. Iti is reckless and irresponsible to allow additional spendingofTOT: revenue at this Mr. Steve Kruskamp also spoke in opposition oft the proposed enterprise center. Whilet the Economic Development Authority has the power toj purchase land, he feels this is just a way to get new county offices for the Economic Development and Tourism group. He strongly suggested this project be put on hold to allow for additional research. A business could locate there and generate tremendous revenue for the County. This is not an appropriate use oft that land as it could Mr. James Murphy said the current EDA office building stands sufficient in its own right for the purposes of economic development and tourism and we do not need another $1 million building to welcome new businesses and tourists. Let's have the EDA continue to maintain a positive relationship with the Chamber and not strain finances to support an unnecessary office building in need of renovation. Subletting rooms to new businesses is ridiculous as they would renovations. This is an ill-conceived idea that won'tpay fori itself. time. be used for better purposes to benefit the county. LLC/VALENTE - REZONE Mr. Jim Frydl, Director of Planning and Zoning, said the request from Benchmark Homebuilders, LLC/Valente is to rezone a 3.26-acre parcel located adjacent to Water's Edge Subdivision on Flintstone Drive from R-1 (Residential) to R-2 (Residential). The existing R-2 zone allows single-family detached houses by right with townhouses allowed by special use Thej property is currently vacant and could be subdivided into 13 lots with 13 single family detached houses by right. Thel R-2 rezone would allow for 19 single family attached homes on the parcel. The projected number ofs school children is 7.2 for 13 detached single-family units and 5.7 for 19 attached single-family units. Townhomes have a lower percentage of children per household as compared to single family homes, according toinformation from the Weldon Cooper Mr. Frydl reviewed the proffer law effective July 1, 2016, which states proffers must address an impact that is specifically attributable to that property. In response to a question by Ms. Flynn, Mr. Frydl said the upgrades are needed regardless oft this development. He said estimated connection fees for this project are $380,000 and a portion oft that money could be used to make the upgrades Mr. Frydl reviewed VDOT comments on traffic impacts, which were that the development should not generate enough traffic to warrant a traffic study and will not significantly change the existing traffic patterns for the area nor overtax the capacity oft the existing roads. Mr. Frydl said the roads are public and problems with parking is an enforcement issue. Mr. Tony Bonanno, resident of Water's Edge, said there has been an increase in traffic over the last five years and the road is very congested asi is. He found it hard to believe that VDOT does not see any problems with the road. Construction of townhouses will affect traffic and the Ms. Tammy Springer, resident on Flintstone Drive, said there are speeding issues on this very curvy, hilly road and there are problems with cars parked in the road. She understands the need for affordablel housing but the character oft the neighborhood is single family homes. She did not agree that townhouses would have fewer children and noted the new auto place going in at the Mr. Riaan Anthony, resident on Flintstone Drive, recommended this request be denied. He referred to the Comprehensive Plan, which is updated every five years, and the current R-1 zoning in the area. Mrs. Flynn clarified the developer could level thej property tol build 131 homes with: nol buffer and individual driveways under the current zoning. VDOT standards for a neighborhood street allow driveways that are practical and the entrance to the townhomes will be a private road. Mr. Frydl said information regarding the number ofs school children per unit was obtained for this region from the Weldon Cooper Center. Mr. Martin also clarified that the Board of Supervisors will consider any rezone request made by private property owners and does not wait until for an update to the Comprehensive Plan. Mr. Frydl said zoning is not part of the Comprehensive Plan but land use types are. Mr. Martin also said there is R-2 zoned property in Mrs. Durrer said shel has concerns about the character oft thei neighborhood, single detached homes, ift the rezone from R-1 to R-2 is approved. The roads are quite narrow in the subdivision Mrs. Flynn said she did not disagree with that concern but iti is important to remember that even by right, development will add traffic, entrances, etc. There is going to be more traffic whether the rezone: is approved or not. Mrs. Flynn said shel has lived in a variety ofhousing types and felt a mix of housing types, even in a single neighborhood, can be a nice thing and add character. She felt the concept plan with the buffer makes it almost seem like a different Mr. Herring said individual residences would have more impact such as driveways on the main road. This proposal has one single entrance. He agreed the Route 29 intersection is bad at that location. He felt the buffering around the property is important and said this proposal does fit Mr. Martin said he visited the area recently and did not feel there would need to be a lot of planting to increase the buffer because of thel hardwood trees on the site. He also felt complaints about soil erosion into Lake Saponi are absolutely legitimate and a buffer zone should make ita a lot easier to control erosion during the construction process. The concept offee simple ownership is critical as it is proven that homeownership leads to pride in the home that is not there in rental properties. The Comprehensive Plan supports more affordable and diverse housing options. The roads are narrow but they are to VDOT standards. Mr. Martin said he did witness cars being parked ini the roadway outside ofc driveways and suggested that problem could be handled through peer pressure and law enforcement. Growth has to be managed and we're trying to do that by making smart decisions in following the Comprehensive Plan. He said he sees a willingness by the applicant to work with the community. The proposed use fits with future land use and the Comprehensive Plan. He did not agree with the vote the Planning Commission made, but they Mrs. Flynn said wei think about teachers, law enforcement and youngp professionals starting out who want to own a home and say we want them to do it in our community, but are sometimes resistant to changes that can make that happen. Herei is an opportunity to provide some of what we have said isi important to us toj provide. A lot of comments made are extremely legitimate concerns that existi right now such as traffic, silti ini thel lake, etc. and shel hopes those things will be addressed. Mr. Herring questioned the proffers and what will happen ift the project does not happen. the neighborhood and Terrace Greene is also zoned R-2. and traffic will only increase. She said she was not in favor of the rezone. neighborhood. with the Comprehensive Plan. were looking at a different concept plan. Board of Supervisors March 26, 2019 Sheet 7 Mr. Frydl said thei request is to rezone the property tol R-2 with proffers and the proffers would run Mr. Cox said his biggest concern is Flintstone Drive and he feels the road, constructed years ago, is not adequate tol handle the trafficifall property were tol be developed. He questioned the width of the right-of-way on that road saying there is definitely not enough room to park on the road which he observed and is a safety concern. There are quite a few parcels zoned R-2 that are undeveloped and he asked why those parcels have not been developed if this type housing is in such great demand. Mr. Frydl said there are four undeveloped R-2 zoned properties in the county. One parcel off New Life Drive does not have access to public sewer. The property on Stoneridge does not have water or sewer and the cost has been deemed prohibitive. Mr. Martin asked how many parking places there are in the proposed development. Mr. Watkins said he thought there are two parking spots per unit with five or six visitor spots. Mr. Frydl noted the application would have to meet the site plan requirements. LLC/VALENTE - SPECIAL Mr. Frydl said the Board just approved the rezone of the property tol R-2 (Residential) and a Special Use Permit is required to build townhomes at a density of 6 dwelling units per acre. Special Use Permits are legislative acts for uses that have greater impact than the by-right use and need to be evaluated under reasonable standards based on zoning principles. Impacts can be addressed through conditions and have to be created by the use. Consideration is to be given to the abatement of noise, smoke, dust and other elements that affect surrounding properties; building setbacks; provision for off-street parking, ingress and egress; provision for protection ofa adjoining property owners with buffer and/or screening; and a time limit may be established. Al lot ofthese were addressed Information for this request ist the same as for the approved rezone. The applicant has said he wants to be in the range ofa price point of $200,000 depending on market demand SO the per square foot cost may actually bel higher than that ofa a single-family home. The Comprehensive Plan designates this parcel as suburban residential which has the main purpose ofs single-family detached housing but other housing can be considered. Anything you do should add tol help create buffering and ai rural feel which have been addressed by proffers. The Planning Commission vote on the recommendation to deny was a 2-2 tie. The Mrs. Flynn wondered if the vote would have been different if the Planning Commission had seen thei information presented to the Board tonight. The applicant addressed comments regarding protection of the lake and traffic congestion SO no conditions are Ms. Kemp said the Board will be considering a proposed change to the R-2 zone which would allow this use by right and the special usej permit would essentially go away but the proffers recommended. will remain. The Chair opened the public hearing. Mr. Riaan Anthony said ift the Board approves the proposed changes to the R-2 zone on which a vote was previously delayed, the developer could put 10 units per acre which would increase the number of units from 19 to potentially 30. He recommends whatever is approved today bel limited by the concept of19 townhome units. The number oftownhomes will potentially increase and traffic will also increase. Mr. Anthony was also concerned about sewer service and the taxpayers paying for that service. We need to think about how we do things and ifit is appropriate not only for economic impact but also for residents. The public hearing was closed. Mr. Herring said if the ordinance amendment to increase the density in the R-2 zone is approved, then this special use permit would become null and void. The proffers approved with Mr. Frydl said it is the builder's responsibility to run sewer lines from the building to the line at the pump station. The water lines need to be upgraded. The purpose of connection fees for water and sewer is to build and improve infrastructure. Oft the $380,000 that would be collected, ap portion would be used to upgrade lines to make them satisfactory. The lines are not insufficient Mr. Herring reiterated that the proffers would limit the density in that the buffers would restrict the amount of acreage available for development. This does not mean the developer could not build more than 19 units but it would be less than 301 because oft the proffers. Mrs. Flynn asked if any special use permit approved for a R-2 zoned property would go away. Ms. Kemp said patio homes and townhomes will bei moved to a usel by right. Ifa SUP was approved for a townhouse community, then additional units may be allowed by right. Mr. Frydl said there are no townhouse or patio home projects currently approved. Mrs. Flynn said that doesn't make sense to her but that is a conversation for later. Mr. Frydl said Ms. Kemp explained it to staffi in a simple way. The change would allow something by right that was previously not allowed and ifconditions were placed on a special use] permit, then those conditions would no longer be valid as the use would be allowed by right. A condition cannot be placed on Mr. Herring said the restrictions would still be in play as they go with the land. Mr. Frydl said we won'thavet to encounter that at all as there are: no townhouse developments approved. Ms. Kemp explained that the conditions on a special use permit would not be valid for the property if the Board approves a change to the R-2 district. Mrs. Flynn felt this is important information as when the other issue comes up, she will be asking questions about special use permit conditions. Ms. Kemp felt this would be at tough enforcement issue as well. Mr. Frydl said, tol his knowledge, the only R-2 zoned property with conditions wel have is multi-family which will still be by special use permit. Mr. Frydl said thej proposal would have townhouses by right; density would change from 6to 10 units per acre; ai reduction in setbacks; and an: increase from 4% to 25% of open space and arequirement of180 square feet per unit ofactived open: space such as trails, playgrounds, pavilions, etc. RE: GREENE COMMONS GROUP Ms. Garton said the County entered into a Memorandum of Agreement with the Town of Stanardsville regarding construction of the pavilion in the back of the County Administration Building. Certain documents for the Greene Commons Group must be approved by the Board of Mrs. Flynn said she was a bit surprised that pets are not allowed in the farmer's market area per the proposed rules. Mr. Yost said the advisory council made recommendations on the rules for the farmers market and he can ask for additional review oft this requirement. Thisi item was presented for first review and will be on the agenda for the next meeting for Supervisors prior to the beginning of operations in April. action by the Board. RE: BOARD LIAISON REPORTS Mr. Cox said emergency services met last Tuesday and he is pleased that our three fire companies are starting to compliment each other in offering assistance. The committee needs Mrs. Flynn said a state representative will bel here in April to train members oft the Social Mr. Herring said the Planning Commission met last Wednesday and an ordinance revision restructuring and direction on what role it plays. RE: COUNTY ADMINISTRATOR UPDATE Ms. Garton said the County Administrator's proposed FY 19-20 budget was presented on March 12. The Board held a work session and made changes to the proposed budget to accomplish Increased the local transfers to schools sufficiently to provide local funding for a 3% raise rather than the 2% raise previously proposed though still not able to fund the full 5% that the following: Board of Supervisors March 26, 2019 Sheet 10 the schools had asked for One-time funding for a county pay study and facility renovations was eliminated One deputy fori increased court demands was added to the Sheriff's Office Ar requested position was added to the Treasurer's Office The full-time position requested by the Commonwealth's Attorney and required by the State is being discussed to bring down to a part-time position because there is a question There was an increase in use offund balance to balance thel budget but not much Board agreed tol budget balanced with an assumption ofa $0.05 tax increase on real estate from the $.77 equalized tax rate and advertised $.84 to give the Board a little wiggle room in case they are convinced to add something to the budget but the budget is balanced on The public hearing will be held at 6:30 p.m. on April 23, 2019. The Board will have a public hearing on thej proposed budget as well ast the tax rates. Tax rates willl be adopted that night but Code requires 7 days between the public hearing and approval of the budget which will be on Conversation with Matt Hardin, Commonwealth Attorney, is ongoing regarding the full- time position requested because of viewing footage from body worn cameras law enforcement carry. Mr. Herring pointed out that the legislation allows the Board to work out a compromise with the Commonwealth's Attorney that would cost less money than a full-time position. Thel boundary line adjustment documents are being finalized by the County Attorney and There was ai meeting last week on the Greene County Water Supply and Treatment Project and county officials and staff are working with RSA to discuss whether there might be some alternatives as to the way our agreement with them is currently structured. One option being discussed is modification ofthe agreement tol have RSA assume thei responsibility and debt fort the water treatment plant, the pump station and the lines associated with the project. The County would still construct, own and be responsible for the debt for the reservoir. This discussion is ongoing at a staff level. If details are worked out, the Board of Supervisors and the RSA Board A meeting with Greene County Rescue Squad was held because they have requested an increasei in funding for thej paid EMT's we contract with UVA in order to provide medical response for the community. They arei requesting an additional shift oftwoi responders from Sundaythrough Thursday night from 6 pm to 6 am because they are unable to get enough volunteer assistance to cover that shift. Funds ini the amount of$180,000 are included in the budget for next year but they have also asked for that service to start up as soon as possible. Staff is working with UVA to determine how quickly they can actually get that up and running. Once that date is determined, Ms. Garton said there is al huge reduction in volunteerism as it relates to fire and rescue all across the country. Citizens moving here from a city or very large jurisdiction are often not aware that emergency service personnel are volunteers. Although the Rescue Squad and Fire Departments make considerable effort to recruit, train and retain volunteers, the number of volunteers available to these organizations has steadily declined.
