RE: MATTERS FROM THE PUBLIC Mr. Steve Kruskamp said he requested, at the last meeting, that the Board of Supervisors and SheriffSteve Smith consider preserving our second amendment rights by adoptingaresolution that would place Greene County in line with many other counties in the Commonwealth of Virginia. He acknowledged the swift action oft the County Administrator and Board in placing this SO quickly on the agenda and urged the Board to vote yes toj preserve the Second Amendment Mr. Greg Trojan said he is an executive member of the Virginia Citizen Defense League (VCDL), a state-wide organization that works to protect rights, specifically the Second Amendment, of American citizens. Proposed legislation has been pre-filed that could turn a lotof of the United States Constitution Board of Supervisors November 26, 2019 Sheet 4 citizens ofthe Commonwealth into accidental felons by thei merej possession ofmagazines or rifles Mr. Dan Dobrowolski, retired US Army Major, said his daughter attends VA Tech and is amember oft the. Airforce ROTC. Her recently purchased a SIGI M17 gun for her, which is the same model she willl be issued as a newly commissioned Lieutenant in the US Air Force. Ifthese laws are passed, his daughter will be a class 6 felon for the mere possession of this weapon. That is absolutely unacceptable in this nation. Strongly urged the Board to make this county a Second Mr. Charles Covington, who served in the military for 21 years, said Greene County has a lot of military here and some have spent decades wearing a uniform to protect citizen rights. He Ms. Nancy Rodland spoke in support of citizen constitutional rights. The Second Amendment denies the government the authority to infringe upon our right to bear arms. She shared comments made by Mr. Mark Robinson, of Greensborough, NC addressing the discussion ofintended regulation and restriction ofthe Second Amendment in his community. She asked the Board, as an affiliate member of the Greene County Republican Committee, to support Greene County and citizens with a vote for the preservation ordinance and sanctuary for the Second Mr. William Crenshaw said a. Jewish: man once told him that when the German government came for their guns, they didn't fight and when they came for their lives, they couldn't fight. He Sheriff Steve Smith said hei is a strong supporter oft the Second Amendment and he and his deputies swear an oath to support the Constitution of the United States and Constitution of the Commonwealth ofVirginia. Heisre responsible for protecting the right ofcitizens tol keep and bear arms. If the proposed laws are passed, he will be placed at odds with many oft them and the oath hes swore as Sheriff. He will unequivocally be loyal to his oath of office and support the Second Amendment. The right to keep and bear arms shall not be infringed. Sheriff Smith said Edwin Mr. Ed Yensho, Chair of Greene County Republican Committee, referred to the unanimously passed resolution encouraging the Board to consider a Second Amendment Preservation Ordinance. Thereisagrowing! list ofpre-filed laws tol bei introduced in the upcoming General Assembly session which, if enacted, will not only blatantly infringe on the Second Amendment rights of Greene County citizens, but could make hundreds if not thousands, instant felons. While these proposed laws may have, good intentions, the reality ofs strict gun control laws isa dismal failure. Until we, as a society, recognize that cultural decline, mental illness and glorification ofviolencei in our entertainment and media are thei major cause ofescalating violence, we will continue to witness it's horror. Guns don'tkill, people do. He urged the Board to adopt the Second Amendment Ordinance and declare Greene a Second Amendment Sanctuary County. Ms. Kimmy Kruskamp said she is ar member of the Greene County Republican Committee and lives in the Ruckersville District. She asked the Board to uphold their duty as elected representatives for our district and adhere to the wishes of constituents. As a female, she asked the Ms. Carolyn Feazell said she has lived in Greene County over 45 years and her guns have never shot anyone. Her deceased husband, who is buried at Arlington Cemetery, would not that the legislature deems as inappropriate for a citizen tol hold. Amendment sanctuary. asked the Board to protect our rights. Amendment. felt this is a slippery slope. Consolvo, Commonwealth Attorney elect, agrees with these comments also. Board to not take away her right to defend herself. She said to put a stop to this before it gets Mr. Helmut Schmidt spoke in favor of the Second Amendment and said he immigrated from Germany to the United States in 2000. The gun rights in Germany are practically zero. He Mr. Errol Bodin said he comes from ai family with al long military history. Has a son in the Marine Corp and a son in high school who intends to enlist in the military. All have come home in one piece but have paid a very high price and he would not want to think it was for no reason. The Second. Amendment is onei important consideration when enlisting in the military. When guns are outlawed, only the outlaws will have guns. The Second Amendment deserves to be protected Mr. Josh Minter, who served for 3.5 years in thei military, said he recently moved to Greene County. He urged the Board to not be persuaded to adopt easy gun fixes to violence and throw away our God given right that has kept American enduring. His presence here today is to rally and give support for the Second Amendment resolution. Mr. Minter said Greene is a big county for the few deputies on shift to protect. Response times are not always ideal and people deserve Pete Costigan said he takes his dog for walks on Preddy Creek Trails, part of which is in Greene County, and recently heard hunter rifle shots while there which made his dog a little skittish. He is in favor of four things: 1. Hunters having the right to own and responsibly use appropriate hunting rifles. 2. Residents, ifthey choose, having the right tol legally own appropriate firearms for their own protection. 3. Restrictions oft the ownership and possession ofbump stocks and high-volume magazines. 4. Consideration by the General Assembly in the upcoming session ofs some form of "red flag" laws. Hei is not in favor of the Board of Supervisors supporting any Second Amendment resolution before the General Assembly has met to consider any new urged the Board toj protect the Second Amendment with everything they can. at all costs. the right to protect their loved ones. proposals regarding firearms ownership and use. RE: SECOND AMENDMENT RESOLUTION Mr. Taylor said this issue was placed on the agenda for discussion at the request of Mrs. Durrer. Therehavel been several different versions ofresolutions submitted. This follows Governor Northam's indication earlier this month that he would reintroduce gun control measures in the upcoming legislation session now that Democrats have taken control ofthe State legislature. There are parameters of State law that curtail local governments authorization to enact laws governing Mrs. Durrer said she would like to have this item on the action agenda for the December 10th meeting. Mr. Herring noted the Board has received multiple resolutions and noted the discussion would not have to be limited to a specific one. Mr. Martin said multiple resolutions could be concerned. Mrs. Durrer said that is what she would like and then the Board could come Mrs. Flynn said the oath of office that each Board member took states that each solemnly swears that they will support the Constitution of the United States. Our Constitution includes 25 active amendments and shep personally took an oath to support all ofthem. She asked that the Board consider stating in the resolution that no amendment is more important than another and the Board would resolve that public funds of the County of Greene would not be used to restrict any constitutional rights ofits citizens or to aid federal or state agencies int the restriction ofsaid rights. the ownership or use of firearms, etc. (15.2-915 of State Code) to a consensus. RE: PUBLIC HEARING - PRIVATE ROADSTANDARDS Mr. Frydl summarized the proposed revisions to the Zoning and Subdivision Ordinances ini regards to private road standards. The subdivision of land on private roads for multi-family neighborhoods is not currently allowed. The County, as a high growth development area, is The revisions include language that private roads shall be built to VDOT Secondary Street Acceptance Requirements; that the subdivision of lots fronting on private roads in the R-2, Residential, Planning Unit Development (PUD), and Senior Residential, SR Districts will be permitted; establishes minimum right of way for family subdivisions; reduces the minimum right ofway for all other minor divisions; eliminates thej private road construction standard for all minor divisions; requires that R-2, PUD, SR, and all Business and Industrial districts shall be built to VDOT Secondary Street Acceptance Requirements; and requires a road maintenance agreement The Planning Commission recommended these changes to the private road standards. Mr. Martin questioned thei requirement for a road maintenance agreement in the A-1 zone. Mr. Frydl said thist requirement would bei forany new: subdivisions andi revisionsinclude: at template with a list of what needs to be included in a private road agreement. An HOA could include the requirements for the private road agreement in documents as stipulated, record it with deed referenced in correct way and that should suffice. Mr. Herring noted that the extension ofa road within in an existing subdivision would require a road maintenance agreement. Mr. Frydl said this will make it clear for people who are buying into as subdivision with private roads. Ad date Route 670 Connector Road - Approved as Smart Scale project. Developing Route 638, Turkey Ridge Road Bridge Replacement - Date to be determined. Route 630, Rosebrook Road - Rural Rustic Road Project complete. Route 670, Preddy Creek Road culvert replacement - Utilities relocated by end of year. Right of way and easements acquired for guardrail on both sides ofroad Several roads arel being reviewed for speed and pending sign installation. Route 609, Fredericksburg Road-Moving forward with review for temporarytruck Mr. Denunzio said he will be leaving his position at the Charlottesville Residency effective December 10 as he has accepted a new position in the Staunton District. He introduced Allen Saunders, Louisa Resident Engineer, who will be filling in until ai replacement is hired. Mr. Martin asked about the pick-up of signs in VDOT right ofway during the sign clutter review on Route 29. Mr. Denunzio said signs causing a safety issue are removed immediately. Mr. Herring asked about the Virginia Byways project. Mr. Denunzio said hel had not heard isN November 2022. schedule. Mr. Frydl updated the Board on Smart Scale 2020. Request is to authorize Mr. Taylor to write a letter about the preferred submission. The proposed Smart Scale 2020 project is potential safety improvements at thei intersection of Route. 29 and Carpenters Mill Road and is actually two smaller projects at the intersection. It was the consensus of the Board to authorize the Smart Scale 2020 application for the two projects referenced. RE: HEALTH DEPARTMENT Dr. Denise Bonds, Director oft the Thomas Jefferson Health Department, presented copies of the Department's annual report and said the community health improvement and health assessment for 2019 is done. She reviewed statistical data for the Greene County Health Department for fiscal year 2019 and noted the State is switching data systems for environmental Dr. Bonds said there is concern that the Health Department does not have authority to inspect tattoo parlors without express written authorization at the county level. There are potential health. Board of Supervisors November 26, 2019 Sheet 8 risks for hepatitis C, HIV, and skin infections at these parlors. Shel has shared model language of Dr. Bonds said the Health Department utilizes social media to share information with citizens. Most of the staff at the Greene County Health Department live in Greene County, are well-connected with the community, and do a great job ofs sharing information about services. Dr. Bonds thought the regulation of tattoo parlors is a missed opportunity to ensure the health of citizens. The goal is tol help educate and make sure people are operating in a safe fashion and abiding by the law. Mr. Taylor said he will have further information and a draft ordinance other localities that do regulate tattoo parlors with Mr. Taylor. with aj presentation for the Boards consideration at a future meeting. RE: JAUNT, INC. Mr. Taylor said the retirement of Mrs. Ginger Morris earlier this year as the Manager of Greene Transit has presented a potential "fork in the road". He has had multiple conversations with' Transit staffa and DRPT about opportunities toi improve service in Greene County. Thisi is not meant as a criticism ofMrs. Morris or staff. Mr. Taylor said the involvement OfJAUNT might be Mr. Brad Sheffield, Executive Director OfJAUNT, Inc. gave a quick overview OfJAUNT and some oftheir recent successes. JAUNTI has 125 staff, members, 88 vehicles, and as $13: million Greene County Transit has a strong community identity with a long history. Mr. Sheffield said potential opportunities include empowering staff, inspiring professional growth, regional connectivity, service coordination, maximization ofr resources, and implementation oftechnology. Mrs. Flynn commented on the differences and innovation seen recently in. JAUNT. She has long supported Greene County becoming part of the regional transit program. Greene County Transit isi important in the county and going to ai regional service would allow expansion ofservices Mrs. Durrer asked about an inclement weather policy. Mr. Sheffield said JAUNT does not follow school closure and relies on drivers to make judgement calls of conditions where they are operating. People being transported do not have the luxury of being cutoff due to possible Mr. Sheffield said next steps would be up to the Board of Supervisors but a possible next step would bet tol haveJAUNT apply fort the grant onl behalfofGreene for operating capital funding. Mr. Taylor said a resolution will be presented at the December 10th meeting for consideration by the Board of Supervisors. RE: QUATERLY FINANCE REPORT Mrs. Tracy Morris, Director of Finance, presented the quarterly financial report for the fourth quarter ending September 30, 2019. The budget was appropriated on June 25, 2019 with 100% being appropriated to the Schools and 50% to the remaining departments. The balance remaining int the contingency line item is $42,602.50. Supplemental appropriations in the amount of$535,016.40: have been received primarily from grants, donations, and carryover funds. The Board of Supervisors November 26, 2019 Sheet 9 cash balance per the Treasurer's report to the Board as of September 30, 2019 is $5,325,152. Mr. Martin asked ifthere werei issues with the 50%a appropriation. Mrs. Morris said several vendors have contacted the office about receiving partial payments. RE: APPARATUS PROGRAM FOR VOLUNTEER FIRE DEPARTMENTS Mr. Cox said the need for a ladder truck in the County has come to the forefront and the three volunteer fire companies arei in agreement. The ladder truck will bes shared by three volunteer fire departments, owned by the County, and most likely housed at Stanardsville Fire. All three companies will receive training in operation. The fire companies have agreed to forego their allocation for vehicle purchase after the completion oft this cycle and that amount ofmoney should come close to paying for the ladder truck. Accessories will be needed and the County will be responsible for maintenance of the vehicle. This will be on the agenda for the December 10th meeting. RE: PUBLIC SAFETY RADIO SYSTEM UPGRADE Mr. Jeremy Thomas, Senior Account Manager for Motorola Solutions, Inc. reviewed a briefhistory ofthe project to date. Phase 1, the needs assessment, has been completed by Black & Veatch. Technical specifications were developed by Black & Veatch during Phase 2. Motorola presented proposal and the system design and price negotiations completed Phase 2. Phase 3 will The system is based on APCO: Project 25 Standard and will be a shared master sitei regional system with Madison County. Greene and Madison will both benefit from the other's tower sites. Our system will have five tower sites, 5 VHF channels, and 4 dispatch consoles at the Sheriff's Office. Redundancy hasl been designed in the system. The most important aspect ofsystem design isc coverage. Mobile coverage would be 95%. Portable in street coverage would also be 95% with Mr. Thomas also discussed the maintenance and lifecycle of the system. Maintenance includes network monitoring, technical support, dispatch service, onsite support, preventive maintenance and infrastructure repair. System upgrades would be scheduled every 4 years. Mrs. Meador said if this maintenance schedule is maintained, theoretically, we will never be in the The system price is based on a competitively bid contract for Fluvanna County. System pricing is $8,877,647 less $2,420,873 in incentives and less $498,333 ifa a contract is signed by 12/20 resulting in a total system price of $5,958,441. Mr. Cox asked what terms Motorola offers. Mr. Thomas said Motorola has a lease/purchase program with the first payment due one year after Mr. Herring asked if the five tower sites are existing. The system will use existing tower sites and supplement with additional towers sites. Mrs. Meador said Greene and Madison are working with cellular providers about new tower locations. So far, our social media presence is limited but we want to grow tol become much more engaged with the community in aj positive, forward looking and uplifting way bymoderating Mr. Herring asked ifsocial media will be archived. Mr. Taylor said the County will have toi investigate archiving. Mr. Herring also asked if the policy should be more specific at to what Mrs. Flynn suggested Ms. Kemp be prepared to weigh in on potential legal risks ofal broad policy versus ai more specific one. Ms. Kemp said shei is probably more conservative than others noting therei isn't clear guidance from the Supreme Court. The trend is government is using social media in ways that hasn' 'tl been seen. This proposed policy is a little broad. Ms. Kemp said she is Mr. Martin suggested a draft Greene County social media policy be developed that would be acceptable to legal counsel and staff. All street names shall be subject to the approval oft the Zoning Administrator shall bear thei names oft the existing streets. the County and in the postal district, irrespective of the use of the suffix street, road, avenue, boulevard, drive, way, place, court, lane, etc. In all other respects said Zoning Ordinance of the County of Greene shall remain unchanged and be in full force and effect.
