IN PERSON IN THE COUNTY ADMINISTRATION BUILDING MEETING ROOM AND BYZOOM VIDEOC COMMUNICATION Present were: Dale Herring, Chair Marie Durrer, Vice Chair Steve Bowman, Member Abbey Heflin, Member Davis Lamb, Member Ron Williams, Planning Commission Member John McCloskey, Planning Commission Member Brenda Garton, Interim County Administrator Kelley Kemp, Assistant County Attorney Kim Morris, Deputy Clerk Jim Frydl, Director of Planning and Zoning Stephanie Golon, Deputy Planning Director Melissa Meador, Director of Emergency Services Staff present: RE: COMPREHENSIVE PLAN WORK SESSION (JOINT MEETING WITH PLANNING Mr. Frydl shared with the Board the draft Comprehensive Plan update that the Planning Commission has worked on for the past two years. He introduced the two Commissioners who were in attendance, Ron Williams and John McCloskey, who would be able to answer any questions from Board members. The Planning Commission held a series of public meetings over the past two years highlighting a particular chapter or chapters within the Comprehensive Plan, which is the community's) long-term planning document that is revised every five years. Mr. Frydl said one. key chapter within the Comprehensive Plan is thel Land Use chapter, noting that whenever ar rezoning request comes into the department, it is reviewed within the parameter of whether it furthers the goals of the Comprehensive Plan. The Planning Commission held public meetings for each chapter at least twice. Mr. Frydl highlighted key proposed changes in the updated Comprehensive Plan, including updated figures from the 2020 census and a recommended new chapter for Flex Technology Research and Development that would be designed for high-salary jobs. Such a development would not be commercial or retail or industrial. Mr. Frydl said Ms. Golon did a tremendous job compiling all the comments from citizens and staff and puttingi itinto COMMISSION) one document and thanked her for ajob well done. Board of Supervisors March 28, 2023 Sheet 2 Mr. Williams reiterated Mr. Frydl's statement that the update was created as a group effort that included citizen comment. Mr. Williams said each chapter included valuable comprehensive input on what would be beneficial for the County. He said he views the Comprehensive Plan as a snapshot in time that shows the status of the County and is part aspirational, such as the goals and objectives. He said the Comprehensive Plan shows what the citizens and leadership plan for the County's future. He said he believes it is an excellent document. Mr. Herring asked Mr. Williams what he thought the biggest change in the draft Comprehensive Plan update from the previously adopted plan. Mr. Williams said the Land Use category was one of the biggest categories, but that the goals have not really changed. He said the guiding principals in the Comprehensive Plan remain having a designated growth area toj preserve the rural character of the remaining County. He said he felt that the chapter dealing with education received significant updates to include a fleshed-out strategic plan. He said that provided an excellent snapshot oft the accomplishments within the public schools and what the vision is moving forward. Mr. Bowman, who serves as the Board liaison to the Planning Commission, congratulated them on the updated plan. He said the discussions were often long and detailed and he felt the Planning Commission clearly addressed every issue possible. He said that he feels the Comprehensive Plan is not a vision statement for the County and though it is a detailed look at various aspects, it is not a vision statement. He said he hopes the Board will address that and look forward. He noted that Mr. Jay Willer had requested something like the Ruckersville Advisory Committee for the rural portion of the County to advise about the future. Mr. McCloskey said Mr. Willer raised the point of changing the chapter from agricultural tor rural because there are many who reside in the rural areas who are not farmers and though they want toj preserve farming, he thinks a citizen group that represents the diversity of our rural areai is something he hopes the Board will take on. He said he doesn't know ifit needs to be as detailed as the Ruckersville Area Plan or have the Thomas Jefferson Planning District Commission involved. Mr. Bowman said the County has seen a number of requests come forward for the rural area and there has been pushback to those. He said he would like to see some additional options put forth and incorporated into either the zoning or planning process that give people other options than either by-right or do nothing. One of the things he said he is coming away with is that this needs tol be done now or there will not be a rural area left and that is his biggest concern. Mr. Williams said tundamentally the Planning Commission is in agreement with the input from Mr. Willer and they did make ai revision to add it to the goals and objectives on Land Use as aplaceholder for whatever: needs to come next. He said that traditional agriculture is on the decline and the best and highest use for that property, from a landowner standpoint, is to convert it for housing. He said he does not think that's completely incompatible with rural and that rural can sometimes bei in the eye oft the beholder and tough to nail down a definition. He said there is plenty of! housing already in the rural portions that do not look like a high-density housing development. Board of Supervisors March 28, 2023 Sheet 3 plan. He said he welcomes ai forum where new: input, ifite exists, could be gathered, and workedi into the Mr. Bowman asked whether the Board of Supervisors ought to appoint or direct such a group or the Planning Commission or the County Administrator. Mr. Williams said the initiative needs to come from the Board of Supervisors. Mr. Bowman asked about a comment from Mr. James Higgins regarding affordable housing definition. Mr. Williams said he welcomed the opinions but was not sure if they should make their way into the Comprehensive Plan, but rather the zoning ordinances. Mr. Bowman said he felt the document was more prescriptive verses visionary and asked whether that was intentional. Mr. Williams said hei felt the language is about encouraging activities that solve a particular need, but that does not mean it is the only solution that will work. Mr. McCloskey said as they went through the document, they noticed many goals without movement, and he said some are meant to be more than five-year goals and while the document must be updated every five years it is more ofa a 20-year planning document. Mr. Lamb asked what was meant by "missing middle" income housing in the plan. Mr. William said iti is a term that is used to describe alternate forms of density with certain price points. Mr. Frydl said "missing middle" is between single family and high-density apartments and the types of homes that come between that such as duplexes and town houses, which are not allowed by-right in any zoning. He said the goal is tol have more affordable housing. Mr. Frydl said it is the subdivision ordinance and zoning ordinance that are the action tools to make the goal of the Comprehensive Plan happen. He said if the Board valued increasing affordable housing, it would direct staff to create the tool to make it happen. An example is something Mr. Willer mentioned, clustered developments. Cluster development is now allowed within our law and the County has not taken steps to allow cluster development in the rural area. Instead of all houses that might be allowed facing the road, they might be back over a hill and within a smaller area, so it creates the impression of green space. It has been brought up by citizens, Mr. Frydl said, but it's not a tool within Greene's1 law. Mr. Herring asked for further clarification. Mr. Frydl said there might be a clustered subdivision in our growth area for higher density. However, in the rural area, cluster divisions would not increase the density allowed on the land. For example, someone can build 25 homes on 100 acres. Instead of building them all on road frontage sO that all you see is houses, they are built on smaller lots which saves money on the infrastructure and put in a corner of the parcel, but the remaining is left with open space and tress. It looks like any rural lot because the homes are together. Mr. Herring asked what the driving force is for the technology flex development. Mr. Frydl said it was a collaboration with Economic Development who has seen prospects seeking that type ofzoning. He said the County's current zoning offers only basic industrial, commercial, and retail. He said the County has no identified locations for such development, which are often higher- paying jobs. Mr. Frydl said the Planning Commission unanimously voted to include the Board of Supervisors March 28, 2023 Sheet 4 information in the Comprehensive Plan. Mr. Herring said the Comprehensive Plan noted how many people commute to jobs outside of Greene County. Mr. Frydl said the recommendation is that we identify an appropriate spot for such development. He said they may remain zoned agricultural, but it would require property owners to come forward to ask for rezoning before the use could move forward. Ms. Heflin asked whether the new use would have to be added into the County's Zoning Ordinance. Mr. Frydl said it would and would need board support before it could be added as a separate section. Mr. Bowman asked if once the Comprehensive Plan is approved will the planning and zoning department make recommendations for what to change SO that thej plan can bei implemented. Mr. Frydl said staff could identify a list of things and present them to the Board with the recommendation oft the Planning Commission and the Board could direct the staff on what to work on. He said staff have always gone through that step to make sure the Board is aware and committed to the changes and gives direction. Mr. Williams said he believes that Economic Development would welcome that as well because as requests come in, they are not able to point tos something that satisfies their criteria. Mr. Herring asked whether the Planning Commission had enough citizen input throughout. Mr. Williams said they would welcome higher participation, but the opportunity was afforded to the community on multiple occasions. Ms. Heflin said that before the Comprehensive Plan is on the agenda for a vote, she would like to have a more definite plan for what the Board would like to go back to the Planning Commission that would help implement the plan. Mr. Bowman said he would like to have one more work session, which is scheduled for the first meeting in May. Mr. Herring thanked the Planning Commissioners for their work on the Comprehensive Plan and Mr. Williams and Mr. McCloskey for their presence at the work session. RE: MATTERS FROMTHE PUBLIC Mr. Keith Bourne was present to discuss the tax rates for the fiscal year 2024. He asked the Board to keep in mind that citizens have been facing high inflation prior to the average 25% property assessment increase, as well as higher personal property tax levies. He asked that the Board not consider anything higher than the $0.66 cents per $100 of assessed values as it would be cruel to the taxpayer. Mr. Greg Pumphrey was present to speak about the tax levy, as well. He noted that traditionally Greene County has a been place where working-class families could afford to buy a home and raise their families. He asked the Board to consider whether raising the tax rate is the correct thing to do for their neighbors. Ms. Carolyn Feazell has been a property owner in Greene County for more than 50 years. She said she questions the kind of] Board the County has ifit raises the tax rate sol high on residents. Board of Supervisors March 28, 2023 Sheet 7 She said people are constantly being taxed more and have more expenses. She said the stock market is going down and wondered what will happen when things crash down. She said she does not believe values will continue to rise as banks are closing down. She said she feels the County iss spending money on unnecessary things. She asked the Board to consider that when setting a tax rate. Mr. Steven Kortepeter told the Board that residents do not understand the situation with the water system and feel money has been mismanaged by the County. Mr. Kortepeter asked the Board why it continues to hire out for consultant firms, costing the County additional funds. He also noted the increased number is the Fiscal Year 2023 budget for fines and penalties, which is putting the County nearly $900,000 in the hole for Fiscal Year 2024. He said he would like to see more affordable housing options for teachers and other government workers. regularly update the website with the draft changes for the plan. Mr. James Higgins was present to discuss the Comprehensive Plan. He asked that staff Ms. Brittany Bornstein was present to discuss the tax rates for Fiscal Year 2024. She said she is disgusted with how the Board handles taxpayer money. She said the County is taxing residents for failed projects oft the past. She asked the Board to vote for the lowest tax rate possible and not just a few cents off. reviewing the budget. Mr. Joey Bornstein thanked Mr. Lamb and Ms. Heflin for putting citizens first while RE: PUBLICHEARINGTO CONSIDER MENDMENIIOCHAETER 3HWATER AND Mr. Frydl told the Board the ordinance needed to be amended from the previously adopted ordinance in ways that are specific to Greene County. One significant change was the removal of wording that the County department would install infrastructure on behalf of citizens. Mr. Frydl said the staff is too small at this time for that responsibility. Developers are responsible for installing infrastructure to specifications. The updated ordinance removes installations fees from SEWER OF GREENE COUNTY CODE the ordinance. Mr. Lamb said the document includes wording about not trespassing on the properties. He said he recalled in previous discussions that the public would be able to access the reservoir once itis completed. Mr. Frydl said there is another section on recreation. He said if they allow recreation on the lake there would be hours it is open and that would not be trespassing. The treatment plant would only be allowed with permission and around the water intake. RE: JAUNT QUARTER UPDATE Mr. Ted Reick, Jaunt CEO, was present to discuss changes made at the regional transportation provider to improve services to Greene County citizens as well as the Fiscal Year 2024 budget request. He said Jaunt has worked to improve communication with the public and will have a new phone system installed by June. He said Jaunt's goal was to be at 88% on time, which has been exceeded. Jaunt is hiring a safety manager, he said. Saturday service was added, as were additional services to Charlottesville, and Jaunt saw a 43% increase in riders through the first months of Fiscal Year 2023 as compared to Fiscal Year 2022. Jaunt has implemented a more transparent budget process, he said. Jaunt is returning about $177,000 to Greene County because ita accumulated excess cash from COVID-19 relief funds. The Board thanked Mr. Reick for his presentation. RE: POCOSON: MOUNTAINTOWER SITE Mr. Frydl updated the Board about the emergency radioj project and the necessity of at tower on Pocoson Mountain for its suçcess. Current emergency radio coverage is about 65% in vehicles and less on portable radios throughout the County. The emergency radio project is a joint project with Madison County where we could approve some towers that benefit our neighboring county, and they could put some that benefit Greene SO there is overlap. The Pocoson Mountain tower is the final one needed for the project and has been identified by the radio partner that this location is needed to communicate from Tower Mountain, back to Flattop Mountain and back to the Sheriff's Office tower and east to Ruckersville and into Madison. The new system will provide 95% coverage 95% of the time, bringing a major improvement to public safety. The tower site is at the end of the state maintained Pocoson Mountain Road onto a private driveway. The tower is al lattice tower of 120 feet. Mr. Frydl showed the Board photos from the balloon test at the site. The County has a 30-day minimum public comment period required by law and asked a public hearing be held to be sure the public has a chance to speak. RE: RESOLUTION TO AUTHORIZE THE ADVERTISEMENT OF THE PROPOSED Ms. Garton told the Board that the Board has settled on a budget that was balanced on a tax rate of 73 cents per $100 of assessed value, and while the tax rate of 76 cents per $100 of assessed value has been advertised the County needs to advertise the proposed budget. A public hearing on the budget is scheduled for April 25. She noted that the Board may still change the budget before it is adopted at the first meeting in May. She asked the Board to approve the BUDGET FOR FISCAL YEAR2 2024 resolution to advertise the Fiscal Year 2024 budget of $108,611,561.00. Board approved the resolution as presented. RE: BOARDLIAISON REPORTS Mr. Bowman said he attended the RSA meeting on March 16 and all the documents were signed that day and transported to Ms. Kemp and were delivered to Richmond by our attorney. Ms. Durrer was at the RSA meeting as an alternate due to Mr. Martin being out of town. He attended the Board of Zoning Appeals on March 22 regarding Natural Roots Farm, owned by William and Rebecca Lunsford. They requested an appeal of the Zoning Administrator's determination that the operation of a campground without a special use permit and tourist lodging offered in a camper is in non-compliance with the definition of tourist lodging. The Board of Zoning Appeals voted 3-1 to uphold the Zoning Administrator's: ruling. Mr. Herring said at ESAB the recruitment and retention group came back with two suggestions. One suggestion is related to retirement plans for the volunteers and the other is tax Board of Supervisors March 28, 2023 Sheet 10 relief for volunteers. At this point they said they would prefer to pursue tax relief for volunteers and will come back with additional information regarding the request in the future. RE: COUNTY ADMINISTRATOR REPORT Ms. Garton told the Board her focus since the previous meeting has been on the budget and the compensation and classification study. All employees completed Position Analysis Questionnaires and the next phase is comparing the salaries to other localities. She told the Board that a date for the transition from RSA could not be set until the State Corporation Commission rules on the transition. Once it is approved, the County can apply for the transfer of the DEQ and VDH permits. RE: OTHER ITEMS FROM THE BOARD Mr. Bowman asked whether an open burning ordinance could be added to an upcoming ESAB agenda for discussion. He said volunteers recently responded to a control burn after phone calls. Mr. Bowman said he worries about the volunteers' safety and would like people to let dispatch know if they are going to have a control burn. He said he is very supportive of the fire company'si recruitment and retention and thinks ChiefDusty Clay did a good job summarizing the elements of the plan. Mr. Bowman said the first thing is pretty simple and that'so offering tax relief for active volunteers. RE: ADJOURN Board meeting was adjourned. WITNESSETH: WHEREAS, the counties of Fluvanna and Greene are both located in the 16th Judicial Circuit of the WHEREAS, by the current assignment of the judges of the 16th Judicial Circuit, Fluvanna and Greene are WHEREAS, Fluvanna and Greene have determined that Judge Barredo needs judicial assistant services and that it is lawful and appropriate that they provide for such judicial assistant services for Judge Barredo; and WHEREAS, judicial assistant services include the salary, benefits, and operating expenses of the Judge's WHEREAS, based upon the existing caseload, it has been determined that it is most efficient that Judge Barredo have his principal office inl Fluvanna, and Fluvannai is willing and able toj provide appropriate office WHEREAS the Fluvanna and Greene have determined that based upon the time and resources spent on Greene cases, Greene should contribute to a portion of the cost of providing suchj judicial assistant services; NOW,THEREFORE, for and in consideration of the mutual covenants set forth hereinafter, and pursuant tot the provisions of Virginia Code Section 15.2-1300, the parties hereby agree as follows: Commonwealth and are served by the circuit courts thereof; and served by the Honorable Judge Barredo; and judicial assistant as enumerated in Fluvanna's annual adopted budget; and space and to provide for judicial assistant services for Judge Barredo; and (1) Fluvanna agrees to provide for judicial assistant services for Judge Barredo. Such services may be provided in any manner which may be determined to be acceptable by Judge Barredo and Fluvanna; provided, however, that the Fluvanna covenants that the manner of providing for such services shall be at all times lawful under the laws of the Commonwealth of Virginia and of the (2) Greene agrees to pay to Fluvanna fifty percent (50%) of the judicial assistant's salary and benefits and fifty percent (50%) of operational costs providing for such services, as determined (3) In each year during which this agreement shall remain in effect, Fluvanna shall provide to Greene a proposed budget setting for Greene's share of the estimated amount necessary for the provision of such judicial assistant services. Garton, Clerk Greene County Board of Supervisors Board of Supervisors March 28, 2023 Attachment E RESOLUTION OF THE GREENE BOARD OF SUPERVISORS REQUESTING THAT VDOT MAKE IMPROVEMENIS TO SOUTH RIVER ROAD WHEREAS, Section 33.2-332 ofthe Code of Virginia, permits thel hard surfacing of certain WHEREAS, any such road must be located in a low-density development area and have WHEREAS, the Board of Supervisors of Greene County, Virginia ("Board") desires to consider whether Route 621, South River Road, approximately 0.55 miles to the end of State unpaved roads deemed to qualify for designation as a Rural Rustic Road; and no more than 1,500 vehicles per day; and Maintenance, should be designated a Rural Rustic Road; and WHEREAS, the Board is unaware of pending development that will significantly affect WHEREAS, the Board believes that this road should be SO designated due to its qualifying WHEREAS, this road is in the Board's six-year plan for improvements to the secondary NOW, THEREFORE, BE IT RESOLVED, the Board hereby designates this road a Rural Rustic Road, and requests that the Residency Administrator for the Virginia Department of the existing traffic on this road; and characteristics; and system of state highways.
