HENRY COUNTY BOARD OF ZONING APPEALS MINUTES OF MEETING July 24, 2024 The regular meeting of the Henry County Board ofZ Zoning Appeals was held on Wednesday, July 24, 2024, in the Summerlin Board Room of the Henry County Administration Building at 1 pm. Chairman Manker Stone, Paul Setliff, Lisa Spencer, and Deborah Hairston were in attendance with Mike Hall absent. Recording Secretary, Wanda Setliff, and Planner/Community Motion to approve the minutes of May 29, 2024, was made by Paul Setliff, seconded by Lisa Development Specialist, Micah Montgomery, were also in attendançe. Spencer, and followed by a unanimous vote with one absent. S-24-04P Patricia J.A Adkins A request for a Special Use Permit was received under Section 21-602 of the Henry County Zoning Ordinance to allow for the establishment of a Class B Home Occupation. The specific business will be a hair salon. The property is located at 1107 Hilltop Drive, in the Collinsville District, and is zoned Suburban Residential District S-R, as shown on Tax Map 28.6(63)/95,96. The property is located within a designated Growth Area as defined by the Henry County Comprehensive Plan. Because this project would be a one operator home occupation, it would not generate significant traffic or demand for additional utilities, therefore staff considers this use Staff has reviewed the application and suggests the BZA add the following minimum conditions to be consistent with the Comprehensive Plan. as part of any motion to approve. Special Use Permit must be exercised within one year Applicant must comply with all aspects of Section 21-103, Class B home occupations Off street parking must be available for at least two vehicles in addition to the number Ift the applicant chooses to install a sign at the home to identify the business, then the sign already owned at the residence can be no larger than 4 square feet and cannot be illuminated The public hearing opened at 1:04. Manker Stone asked if anyone present would like to speak on behalf of the Special Use Permit. Patricia Adkins spoke on her behalf, stating that she has been a hairstylist for 28 years. The current facility where she works is being sold, and the rent is increasing. She would like to continue her business from her home, which has ample parking and is handicap accessible. Manker Stone asked ifthe salon would be situated in the basement or upstairs. Patricia Adkins responded that the salon area would be located in an upstairs room, which will bec converted from a bedroom. 1 Deborah Hairston asked, "How many clients do you have on a daily basis?" Patricia Adkins mentioned that she typically does 3-4 hair colors a day with haircuts in between. She has reduced her working hours and now only works on Tuesday, Thursday, Friday, and Saturday. Some days she may have 5-6 clients, but on average, she sees around five clients daily. Manker Stone asked if anyone else wanted to speak in support of the request. When no one came forward, Mr. Stone inquired if anyone wished to speak against the project. Again, no one came forward. The public hearing closed at 1:08. Manker Stone asked for comments from the board. Paul Setliff made a motion to approve the Special Use Permit including the 4 recommended conditions from staff, and Lisa Spençer seconded the motion followed by a unanimous vote of4- Owith one absent.
