Attorney: made a statement that it is expected that the condemnation filing may not be necessary and the property owner representative has recently been in communication. Council member Bertaut asked fora brieftimeline ofthe negotiation of easements. Staffi responded that property owners were initially contacted in 2021 in which there was one change in property ownership since then. There were no public comments received. MAYOR AND COUNCIL COMMENTS Council member Williams thanked citizens for data driven comments on potential annexation process. She thanked Parks and Recreation department and staff for another great event oft the Wine and Food Festival. She mentioned to conserve water under the current "drought watch" and mentioned upcoming town events and future meeting topics. Council member Williams Council member Stought shared attending an information meeting hosted by Mayfair at Harmony Middle School regarding the potential annexation in which the applicant attended. He wished everyone a great upcoming school year. He continued to show concern for the: rushed process by Planning Commission regarding the Zoning Ordinance rewrite. Council member Stought shared being thankful to the first Council member Luke showed gratitude for the event over the weekend. She shared concern for the traffic in Purcellville and the decision making in regards to the flow of cars. She commented Council member Bertaut noted there is a shared taste for the possible annexation/boundary line adjustment and the vote tonight would start the ball rolling between staff and the County. He would like to see that questions and concerns are addressed. He commented on the projected timeline and process of the Planning Commission regarding the Zoning Ordinance rewrite. The upcoming Planning Commission public hearing willl bet the first of more public hearings on the Council member Wright passed on his comments and would make use of the time when Vice Mayor Rayner addressed Council member Luke's comment on EDAC and shared that the opening ofo Street has not been discussed ini meetings. He shared listening to the citizens on their thoughts of the potential annexation and he would like more information on the expected water and traffic ofthis project. The Town is not voting tonight to annex, but to gather more information not negotiate. Mayor looks forward to the future Park and Recreation events planned in town. ACTION ITEMS a. Valley Commerce Center. Annexation Application Jordan Andrews, Planner, gave the report and reviewed the town annex process and following of code. He gave an update from the. July gth meeting and the request from Town Council to gather more: information with a possible MOU with the applicant. He shared conditions that the County has put forth and this would not be al boundary line adjustment. Mr. Andrews shared the County Council had a discussion and shared their concerns with staff, Town Attorney John Cafferky, lawyer representation Randy Minchew, and applicant Chuck Kuhn regarding this annex process and next steps. Mr. Kuhn shared hel has $300,00 worth of! professional studies on the planned industrial complex to share. He also shared that hel has protected thousands ofacres and this particular location would be developed and not remain open space. Mr. Kuhn shared that proffered out any data center project. Andrea Broshkevitch, Director of Engineering and Capital Projects, gave the report and shared this is thel highest priority project after the Reservoir Intake Repair. The bids submitted were. all from Water Storage Tank contractors. Council reviewed the project timeline from 2021 to now and the ARPA and CIP project funding.
