Mayor Carson asked what the conditions for this special use permit. City Manager Pam Madison gave the conditions as: Full-Service Restaurant, Side Walks, Security Cameras, No Truck' Wash, Nol Repair Shop. It was initially approved in 2019 and itexpired. The applicant came back for a second special use permit and Council worked with the applicant and his attorney requesting a three-month extension and Council gave him a six-month extension. The special use permit expired and the UZB recommended that the Council add a Councimember Towe stated this item was tabled from last month's meeting SO that staff could Pam Madison briefed the Council about what staff has learned regarding sidewalks and the timeframes for installation on GDOT right of way versus the applicant's property. Brady Hammonds addressed the Council and said the D.O.T. permit coordinator advised him that a permit could take one to six months for approval. Approval for a permit on the applicant's property could take a month for the design element and then a month or two to geti it scheduled, depending on contractor availability. Mr. Hammonds provided a delineation of potential sidewalk installation on applicant's property, advising that this would present challenges regarding sign location, but it could be worked out at a staff level versus going through D.O.T. This would still be designed according to the City's ordinances and specifications. Mr. Hammonds said he has Mrs. Madison clarified that the applicant has not committed to installing sidewalks. We would need that agreement. The applicant is asking the Council for relief from the sidewalk requirement. Applicant, Alfonce Chelino, said he has put a lot of work into the building and has spent over $795,000. Mr. Chelino stated that feels the truck stop is needed, and he doesn't have problems with crime and drugs on his properties. Mr. Chelino stated putting sidewalks on his inside property would be too close to the fuel pumps. He again stated he is seeking relief from the sidewalk Mrs. Madison said the applicant has requested relief from installing sidewalks at the Unified Zoning Board level. The UZB has recommended to the Council that sidewalks be included and Mr. Hammonds said the item was tabled at the November 2023 UZB meeting and at the December 11, 2023 meeting, the UZB recommended approval with conditions. Mr. Hammonds read the conditions into the record. (a) A truck wash or repair shop shall not be permitted. (b) Building shall be used for primary tenant space, no multi-tenant space, (c) a full-service restaurant, (d) Sidewalks shall be installed along highway 140, (e) Security Cameras installed and maintained, (f) Special Use Permit will expire if business closes for a period greater than one Chris Green of 65 Woodland Bridge Dr. said he has been following this for two years and the applicant keeps asking for delays. Mr. Green said this should not have been allowed to go oni for sol long and that het feels if anything goes wrong, the applicant would not be ablei toi follow through ina a timely manner. Mr. Green asked if gaming would be allowed and expressed concerns about Mr. Chelino stated he has submitted photos tot the Council as requested. He said regarding crime, he has zero drug problems and no problems with crime at his other businesses. Mrs. Madison also said that the applicant has had a business license to operate a convenience store with gas station for over a year. Councimember Towe made a motion to approve. Councilmember Jenkins seconded the motion. Mrs. Madison asked if they were going to give a timeline. Councimember Towe advised six months. The applicant then requested three to four years toi install sidewalks. Mr. Chelino said he is requesting more time, but he would doi it. Councimember Jenkins asked if the applicant was willing to puti it sidewalks on his property. There was discussion about the design to allow sidewalks on the applicant's property. Mrs. Madison advise that Mr. Chelino would have to consult with his design engineer. Brandon Bowen stated that Mr. Chelino does have approval to operate as a convenience store and that Mr. Chelino only needs the approval of a special use permit to operate as a truck stop. Councimember Towe asked what the applicant's response was to the condition of sidewalks. The applicant asked that he be allowed to operate with conditions that he installs sidewalks within Councimember Holcomb asked if the city could pull his license in two years if he don't build the sidewalks. Mr. Bowen said if these things weren't accomplished, the special use permit would terminate. Mr. Bowen further stated it is easier to deny a permit than to shut someone down that Councimember Towe asked to remove his motion. Mr. Bowen said the motion has a second. Lilian Kipton again spoke to the Council, asking them to give her brother a chance stating if they Mr. Bowen asked for a vote. No vote was made, and the motion failed. Mr. Bowen proposed a recommendation to require the condition that sidewalks be installed within one year. Mayor Pro Tem Castro said it can be a convenience store and make money and then come before the Council later and that the Council has been more than patient. Mr. Castro also stated that Daniel Branch of 702 MLKI Drive spoke to the Council saying there is trouble everywhere and we have police for that. Mr. Branch also stated that he grew up working at truck stops.
