Call to Order Mayor Turner called the meeting to order at 6:32 p.m. PRESENT: Mayor Josh Turner, Council Members Nan Bowen, Annie Sutton, Jeremy McClure Also present were City Administrator Kevin Harris, City Attorney Keith Whitaker, and 2. Invocation - Family Pastor Ryan Elrod, Cleveland Worship Center, and White (Mayor Pro Tem), and C.J. McDonald City Clerk Lisa Ritchie County Ministerial Alliance 3. Pledge of Allegiance 4. Approve Agenda Motion by Council Member McClure, seconded by Council Member McDonald, and voted, unanimously, to approve the agenda with the following amendments: Move item 11 to item 10 (under public hearings) Item number 12, add purchase of a trailer Add Real Estate under Executive Session RECOGNITION 5. Proclamation recognizing City Council Member CJ McDonald - 2024 Readers' Choice "Best City of Cleveland Official" Mayor Turner read the Proclamation. Motion by Council Member Bowen, seconded by Council Member Sutton, and voted, Council Member McDonald expressed his appreciation to City of Cleveland staff unanimously, to approve the Proclamation. members and to the Mayor and Council Members. PUBLIC COMMENTS There were no comments from the public. PUBLIC HEARING 6. Second Public Hearing Resolution 2024-20 Authorize the Municipal Court of the City of Cleveland to charge a technology fee Mayor Turner opened the Public Hearing. Mr. Harris addressed the Mayor and Council Members. He stated that the State of Georgia allows cities to charge a $10 technology fee/user fee to help pay for the IT support for tickets to those found guilty of a crime rather than to the citizens. Currently, citizens pay the fee. There were no comments from the public. Mayor Turner closed the Public Hearing. 7. Second Public Hearing and consideration - Resolution 2024-21 for a 12-month Moratorium on Cannabidiol (CBD) Stores Mayor Turner opened the Public Hearing. Mr. Harris stated that the moratorium is for the purpose of allowing a study for the regulation of CBD stores, expiring by August 12, 2025. There were no comments from the public. Mayor Turner closed the Public Hearing. Motion by Council Member Sutton,seconded by Council Member McClure, and voted, unanimously, to approve Resolution 2024-21 for a 12-month Moratorium on Cannabidiol (CBD) Stores. 8. Second Public Hearing and consideration - Resolution 2024-22 for a 6-month Moratorium on Vape Shops Mayor Turner opened the Public Hearing. Mr. Harris stated that the moratorium is for the purpose of prohibiting new smoke and vape shops, current shops will not be affected, for 6 months to allow staff to review land use and zoning regulations for additional/new shops. The moratorium will expire February 5, 2025. There were no comments from the public. Mayor Turner closed the Public Hearing. Motion by Council Member McClure, seconded by Council Member Sutton, and voted, unanimously, to approve Resolution 2024-22 for a 6-month Moratorium on Vape Shops. 9. Third Public Hearing and consideration - Resolution 2024-23 to approve the Water and Sewer Services, Sanitation, Building Permits, Zoning, Court Technology, and other administrative fees amending Chapter 24, Fees, Fines, and Other Charges for FY 2025 through FY2027 Mayor Turner opened the Public Hearing. Mr. Harris stated that the fees will increase over 3 years, allowing everyone to plan accordingly. He said Enterprise Funds, by law, are required to not operate as a deficit. Mr. Solmon addressed the Mayor and Council. He stated that the increases are necessary to remain current with infrastructure (sewer, water, pipes, etc.). He also said that current commercial dumpster customers will continue the service, but commercial dumpsters will not be offered to new commercial customers. There were no comments from the public. Mayor Turner closed the Public Hearing. Motion by Council Member McDonald, seconded by Council Member McClure, and voted, unanimously, to approve Resolution 2024-23 amending fees for Water and Sewer Services, Sanitation, Building Permits, Zoning, Court Technology, and other administrative fees for FY2025 through FY 2027. 10. Consider an application from B. David Barrett, etal., requesting annexation and zoning for approximately 4.9 acres in three tracts, 032 081, 032087, 032088, located between the present City Limits (Pardue Circle) and the Georgia Department of transportation (By-pass, Hulsey Road). Said parcels to be subdivided into four tracts. Requested of zoning classification of tract 1 and 2 are B-2, Highway Commercial District. Request zoning classification of tracts 3 and 4 are R-1 Single Family Residential. Registered agent listed as B. David Barrett; partner Don Allison representing. Mayor Turner gave the Public Hearing instructions and procedures. Mayor Turner opened the Public Hearing. Council Member McDonald recused himself due to a conflict of interest. Mayor Turner verified with Dr. Barrett that he had submitted a Disclosure of Campaign Contribution Certification and that he had not, in the last two years, immediately proceeding with his application date, made any contributions aggregating more than $250 to any government official involved with the review or consideration of this application. Dr. Barrett confirmed that he had not. Mayor Turner verified with Dr. Barrett that all the property taxes for this property Mayor Turner disclosed that Dr. Barrett is his sister's father-in-law, and Council Member McClure disclosed that Dr. Barrett is his distant cousin and counsel confirmed that the relationships are not close enough to constitute a conflict of Economic Development and Planning Director Tom O'Bryant addressed the Mayor and Council Members to discuss the item. He said that the Planning and Zoning Board recommends approval of the annexation and the zoning requests. The White County Dr. Barrett addressed the Mayor and Council Members. He said he has no plans to develop the property at this time. He said he would probably sell the property. Mayor Turner asked for a show of hands by all in opposition to the item, there were none.
