MEETING MINUTES June 5, 2024 Carroll County Planning and Zoning Commission Location: Reagan Room, 003 Michael Kane, Vice Chair Ralph Robertson Steven Smith Peter Lester Matthew Hoff Tom Gordon III, Ex-officio Members Present: Janice R. Kirkner, Chair Members Absent: Richard J.: Soisson, Alternate Present with the Commission were the following persons: Randolph Mitchell, Mary Lane, and Alexander Lehigh, Bureau of Comprehensive Planning; Laura Matyas, Bureau ofDevelopment Review; Christopher Heyn, Department ofl Planning and Land Management; Michelle Ostrander, Attorney; Daphne Daly, Planning Commission Secretary; and, Denise Mathias, Clerk. Madam Chair Kirkner called the meeting to order at approximately 6:00 PM. CALLIDORPRNTICON: PLEDGE OF ALLEGIANCE ESTABLISHMENT OF QUORUM Ms. Mathias took attendance and noted that seven members were present, and a quorum was established. REVIEW AND APPROVAL OF AGENDA Secretary Daly noted one amendment to the agenda, minutes from thel May 21st meeting would be available at the next meeting for review and approval. On motion of Mr. Lester, seconded by Mr. Kane and carried, the. Agenda was approved as proposed with the exception of striking item #5. REVIEW AND APPROVAL OF MINUTES On motion ofMr. Kane, seconded by Mr. Smith and carried, the Minutes from April 16, 2024, were approved. COMMISSION MEMBER REPORTS A. COMMISSION CHAIR None Planning and Zoning Commission Official Minutes B. EX-OFFICIO None June. 5, 2024 C. OTHER COMMISSION MEMBERS Mr. Kane mentioned he and Secretary Daly attended the emergency room expansion plan presented by Carroll Hospital a couple of weeks ago. He discussed some of the proposed changes and thanked Chair Kirkner for the opportunity to attend. ADMINISTRATIVE REPORT A. ADMINISTRATIVE MATTERS None D. OTHER TEXT AMENDMENT: DEVELOPER'S RIGHTS AND RESPONSIBILITIES AGREEMENTS The Board ofCounty Commissions are considering legislation that would allow for the County to enter into a DRRA with a developer and have asked for the Planning and Zoning Commission's recommendations for related amendments to the Carroll County Code ofOrdinances. Mary Lane presented a PowerPoint to go over what a DRRA is, included information on the questions the Commission members discussed during the May 21st meeting and reviewed Frederick County's code related to DRRAS as an example of what the Planning and Zoning Commission could consider. Discussion will continue at the next meeting scheduled for. June 18, (DRRA's) 2024. Public Comment: Clark Shaffer, Attorney representing St. John Properties, explained how DRRA's work, benefits, and why they are used from his experience and research. 2023) PLANNING ANNUAL REPORT. -INTRODUCTION AND] POSSIBLE CERTIFICATION the past year. The Land Use Article of the Annotated Code of Maryland requires the Planning Commission to file an Annual Report with the local legislative body describing deyelopment-related activity over Randolph Mitchell presented a PowerPoint on the highlights of the Annual Report, describing development-related activity over the past year. The Commission members discussed how DRRA's could affect Commercial and Industrial properties in the future and suggested clarification be made on the numbers reported for Ag Preservation programs. 2 Planning and Zoning Commission Official Minutes Decision: June 5, 2024 The Commission, on motion ofMr. Kane, seconded by Mr. Robertson and carried, voted to certify and adopt the 2023 Planning Annual Report and forward it to the County Commissioners for their acceptance and transmittal to the Maryland Department of Planning.
