ORDINANCE NO. 2018-02 AN ORDINANCE OF THE CITY OF SOUTH PASADENA, FLORIDA, REPEALING CHAPTER 189, VEHICLES TRAFFIC, SECTION 189-4,PARKING RESTRICTIONS ON PRIVATE PROPERTY, SUBSECTION B, COMMERCIAL PARKING LOTS, TO REMOVE PROHIBITION ON PARKING BETWEEN THE HOURS OF 2:00 AM AND 6:00 AM, PROVIDING FOR SEVERABIDITY, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 189-4 B. of the Code of Ordinances now provides that no owner of commercial property shall permit parking on said property between the hours of 2:00 a.m. and 6:00 a.m. unless said business is open to the public during those hours or the property is licensed as a parking lot, vehicle sales lot or vehicle-for-hire business; and WHEREAS, it has come to the attention of the City Commission that many commercial businesses require that their owners or employees work at the premises during those hours and the City's police department has issued warnings or citations to such persons who have parked their vehicles in commercial parking lots during the prohibited hours; and WHEREAS, the Commission considered providing an exception for authorized business owners and employees; however, it was determined that there is no practical way of identifying vehicles of those excepted persons without imposing an undue burden on the business owners or employeesi and WHEREAS, to the knowledge of the Commission, there have been no significant instances of vehicle parking during the prohibited period other than parking by business owners and employees for their business purposesi and WHEREAS, in order to prevent the issuance of further citations for violation of this City Ordinance to persons who must park at their place of employment during the prohibited hours, it is deemed appropriate to repeal Section 189-4 B. of the Code of Ordinances in its entirety. the City of South Pasadena, Florida: NOW, THEREFORE, BE IT ORDAINED by the City Commission of ORD 2018-02-1 SECTION 1 Repeal of Code Section 189-4 B. Section 189-4, Parking Restrictions on Private Property, Subsection B., Commercial parking lots, is hereby repealed in its entirety, and existing Section 189-4 C. shall be re-lettered as Section SECTION 2 Severability In the event of any portion of this ordinance is, for any reason, held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. ORD 2018-02-2 RESOLUTION NO. 2016-06 A RESOLUTION OF THE CITY OF SOUTH PASADENA, FLORIDA AMENDING RESOLUTION NO. 2013-28 MODIFYING THE GUIDELINES OF THE BUSINESS REVITALIZATION COMMITTEE. WHEREAS, the City Commission recognized a need to revive and strengthen the local business community and passed Resolution No. 2013-28 establishing a Business Revitalization Committee (BRC) to pursue such endeavors; and WHEREAS, as a result of unforeseen circumstances facing the Commission, the BRC has not been formally initiated following its establishment; and WHEREAS, the guidelines listed in Resolution No. 2013-28 have been found to be more restrictive than intended and it is the desire of the Commission to modify the Committee's policies to be more. flexible in order to adapt to the city's changing needs. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of South Pasadena that the Resolution No. 2013-28 is hereby amended to modify the Business Revitalization Committee guidelines to be as follows: 1. COMMITTEE CHAIR The Business Revitalization Committee (BRC) shall be chaired by a member of the City Commission for a term of two (2) years. The Chair shall be appointed by a majority of the Commission and may serve multiple consecutive terms. 2. MEMBERSHIP The Committee shall strive to have no more than ten (10) and no fewer than seven (7) members, not including the Chair or advisory staff. A majority of the active members shall constitute a quorum. Members shall be appointed by the Chair and shall serve until resignation or until which time as they are informed in writing that they have been removed by the Chair. The Department Head for the Community Improvement Department shall attend meetings and act as an advisor to the Committee as requested. RES 2016-06-1 3. MEETINGS Committee meetings shall be held at the discretion of the Chair, subject to the availability of a quorum. 4. REPORTING The Chair, or a member selected by a vote of the Committee, will report directly to the City Commission regarding the Committee's findings and/or recommendations at any of the monthly Administrative Workshops or at a Regular Commission Meeting if necessity requires and upon approval of the Commission.
