SNEADS TOWN COUNCIL REGULAR MEETING FEBRUARY 8, 2022 The Town Council oft the Town of Sneads, Florida, met in a regular session at the Sneads Town Hall on Tuesday, October 12, 2022, at 6:00 p.m. Mike Weeks called the meeting to order with the following present: Mike Weeks, Donovan Weeks, George Alexander, Angela Locke, and Tony Money; Council Members Daniel Cox, Attorney Lee Garner, Town Manager Mike Miller, Police Chief Sherri Griffin, City Clerk Danielle Guy, Deputy Clerk And the following were absent: All stood for the Pledge of Allegiance. Alexander seconded. All voted aye. None Donovan Weeks made a motion to approve the January minutes as presented. George Sherri Griffin, City Clerk presented Financial Statements and Budget Review Summary for December and January. (See Attached) Tony Money made ai motion to accept them as Tony Money made a motion to pay approved bills. George Alexander seconded. All voted aye. First discussion/actions item was Stormwater Project with DEO #M0010. The Council was asked toa approve the Signature Agreement, Approve the CDBG Grant Administration and Program Delivery, along with Engineering Contract with Melvin Engineering. After discussion, Donovan Weeks made a motion to approve all pending review by Town Attorney. George Alexander Next discussion/actions item was Hometown Revitalization Program with DEO #M0055. The Council was asked to approve the Signature Agreement, Approve the CDBG Grant Administration and Program Delivery, along with Engineering Contract with Melvin Engineering. After discussion, Tony Money made ai motion to approve the Signature Agreement pending review by Town Attorney. Donovan Weeks seconded. All voted aye. Regular Meeting February 8, 2022 Page 2 Mr. Garner asked the Council to approve an RFP to be advertised for the installation of sewer grinder stations at Sneads Park. This will bej paid by using ARPA Funds and Alday-Howell! Engineering will be over the project. Tony Money made a motion to approve for the advertisement for RFP fori installation of sewer grinder at Sneads Park. Donovan Weeks seconded. All voted aye. Property at Gerald St and Paula St was discussed again. Back in August 2021, it died for lack of asecond, but has been asked to be brought back up by citizens, as to whether tol have aj public hearing to surplus this property or not. After discussion, Tony Money made ai motion to have a public hearing to surplus the property. Donovan Weeks seconded. Tony Money, Donovan Weeks, and Mike Weeks all voted aye, while George Alexander and Angie Locke voted nay. Towns Recreation Funds Receivables and Expenditures from Hurricane Michael were discussed. (See attached) Mr. Garner and Sherri Griffin went over thei items and answered questions from Council members or those present. (See attached) He: stated that himselfa and Gary Pittman met with FDOT, and they have agreed on doing the work/ cleaning of the ditch at Hwy 90/ River Rd, which goes down past the high school football field. Mr. Coley stated that it Mr. Garner invited everyone to the Pirate Heritage Festival, April 1st& 2nd at Three Mr. Garner stated that the Red Rock for the ballpark has been ordered. He ended up ordering four loads instead oftwo and it will be delivered on the 15th. cleanup for the Stormwater Project. does include some paving. Rivers State Park. Attorney Cox gave updates on what was going on in the legislative session. He said that one bill that he was watching and would keep us updated on was about retirement benefits for elected Tony Money asked Mr. Garner where we were with the Public Safety Building. Second, we have also been approved for our Hometown Revitalization Grant in the amount of $951,762.00 that will allow us tol help some businesses that were affected by Hurricane Michael and purchase the old buildings on Gloster next to the Log Cabin. My thanks to Melvin Engineer's for their persistence in both grants. We are still waiting for the agreement on resurfacing several of the streets. 2. Next isi information on installation of sewer grinder pumps at the bathroom facilities in Sneads Park that has been designed and will be paid for with ARPA funds in the estimated amount of $157,380. Ia am requesting permission to go out for an RFP on this project. Alday-Howell will be the Engineer on this project as part ofc our cooperative agreement for engineering services. We have already expended $106,000 for the rehabilitation oflift station No. 9, along with $61,500 to replace pump #2 at the spray field from ARPA funds. In November you approved use of these funds for these projects, along with three (3) other projects involving wastewater infrastructure 3. The lighting project has been successfully put in the Senate -1 finally- = but the pavilion project has still not yet been put in by Senator Gainers office. There are no other updates on the Town's appropriations att this time. Legislative Discussions The House Ways and Means committee heard HB 777 by Rep Robinson. This bill requires all non-sales tax referendums to go on a general election ballot. This bill aims to move referendums to the general election, versus in a special election, as voter turnout for a general election is sO much higher. Referendums are sO important, and should have the maximum The Senate Committee on Environment and Natural Resources heard SB 1434 by Senator Rodriguez and SB: 1110 by Senator Rouson. SB 1434 requires any local government who receives state appropriated funding for a capital outlay project within 15001 feet oft the coast to complete a sea level impact projection study. SB 1110 by Senator Rouson targets grease haulers that are paid a price to fully remove, and properly dispose of, use cooking grease. Often these grease haulers either accidentally, or purposefully, pour some grease down a drain, and that damages the environment. This legislation will allow municipalities and local governments have al better ability to track the amount of grease removed The House Commerce Committee heard HB 489 that extends Visit Florida at least through 2028. Visit Florida is vital to producing and driving tourism within Florida. These two bills' house companions have not made iti to the House Floor yet. SB 620 establishes a local governments liability for business damages cannot exceed 7 years lost profit. It authorizes businesses, that have operated in Florida for at least 3 years, to sue a local government if that local government enacted an ordinance that caused said business to lose 15% ofi its profit. There are exemptions to the types of ordinances: land development regulation, building code and fire code, growth management and debt finances. For al business to be able to sue, they must send a demand letter to the local government within 100 days of the ordinancesenactment. The local government has 180 days to response, and a local government can cure the issue by amending or repealing the ordinance. This legislation also provides for a prevailing business to claim their attorney's fees. SB 620 was amended on the floor to lessen the business damages to thet future loss of profits, or the numbers of years a business has been in operation, upt to 7 capped. The amendment removed the 60 month gross receipt provision. The amendment also changed the legislation sO that al business just doesn't have to bei in business in the state, but in SB: 280 was then also heard. SB: 280 required al local government to complete al business impact statement before enacting certain ordinances. Ifa local government enacts an ordinance that has already been preempted, and then that fact that business has to bei in business within thej jurisdiction of the local government. local government is sued, that case willl be expedited for al hearing by the courts.
