MINUTES TOWN OF OCEAN RIDGE JANUARY9,2024 SPECIAL MAGISTRATE/COMMUNITY STANDARDS HEARING Present: Special Magistrate Amity Barnard, Town Attorney Christy Goddeau, and Town Clerk Kelly Avery. The meeting was called to order at 10:00. A.M. by Special Magistrate Barnard. Special Magistrate Barnard explained the hearing process, noting that the Town will call cases as they appear on the agenda. All those persons planning to provide testimony were sworn in by Special Magistrate Barnard. A. ADOPTION OF NOVEMBER 7,2023 MINUTES The Community Standards Hearing Minutes ofNovember 7,2023, were adopted as submitted by Special Magistrate Barnard. B. CASE NO. 2023-013 TURTLE BEACH OF OCEAN RIDGE CONDO ASSN. 5101 N OCEAN BLVD, OCEAN RIDGE, FL3 33435 RE: PALM BEACH SHORE ACRES BLKS. A, B& ZTHI PT OF LTS 14 & 15 BLK A LYG E OF & ADJ TO OLD OCEAN BLVD & PALM BEACH SHORE ACRES BLKS A, B &ZTH PT OF LT 16LYGEOF OLD OCEAN BLVD (LESS S5FT) BLK. A NATURE OF VIOLATION SEC 70-6 Beach Signs Town Attorney Goddeau summarized the case for the Special Magistrate. She stated that an Affidavit and Notice of Violation was served by certified mail, Ocean Ridge Cad Report, photos taken at the property, mail in receipt and the administrative costs in the amount of One Hundred Community Standards Officer Sergeant Aaron Choban provided background information on the Attorney Spencer Sax and Mark Feinstein, HOA President ofTurtle Beach of Ocean Ridge Condo Town Attorney Goddeau asked Mr. Sax ifhe had any objections to the documents in the file. Mr. Sax had objections to the Police Incident Report, Ocean Ridge Cad Report, photographs, and certified mail receipt. The Respondents entered photos and a site plan into evidence. Special Magistrate Barnard entered as exhibit two (2) of seven photos and one site plan into evidence without objections from the Town into the record. She also entered the Town exhibits as exhibit Mr. Sax asked Community Standard Officer Sergeant Coban various questions about the case. Seventy-Two Dollars and Fifty-Three Cents ($172.53) was in the file. case. Association, spoke about the case. one (1) which were the original case files over objections into the record. SPECIAL MAGISTRATE CODE ENFORCEMENT HEARING OF JANUARY 9, 2024 Town Attorney Goddeau asked Community Standard Officer Sergeant Choban follow-up questions. Special Magistrate Barnard asked the Town specific questions about the case and asked what the Town was seeking for this case. Town Attorney Goddeau stated that the Town was seeking bring the signs in compliance with the Town's Code within ten days or they are assessed with a Fifty Dollars ($50.00) a day fine. More discussion followed regarding the language in the Town Attorney Goddeau requested to submit a copy oft the previously approved signs permit into evidence. Special Magistrate Barnard entered the document into evidence with objection from the Town Code regarding signs and the location oft the signs. Respondent. There was more discussion regarding the location oft the signs. Town Clerk Avery provided an explanation on annual maintenance permits. Special Magistrate Barnard requested a three (3) page memo from both parties outlining their position regarding the case. She stated that the memos were to be emailed to the Town Clerk on or before February 2nd by 3:00 pm. She further stated that the order was continued and scheduled the meeting for February 20th at 10:00 am. D. ADJOURNMENT The hearing was adjourned at 11:35. A.M.
