Burney Hayes of 848 Sherwood Drive addressed the Board and asked if any of us have as say sO on why there are 60 seconds in a minute, and why we have 60 minutes to determine and hour, and even why 24 hours that determines a day, and stated that we do not. He stated that when we come here the city is allowing big businesses to come into the City and bypassing fees. Fees that will be instrumental in helping with the development oft the City. He stated that coming before this Board hurts and that the city did a detrimental thing which had this Board on his back because he is trying to protect the inside of his house and it looks like he is derelict. He stated that he talked to Sarah Kirkland and was told that he should know that the rain comes off the road down to his house. He stated that this is the right Board but they are the wrong people that this needs to be addressed to because this Board is being used in his opinion as a battering ram to clean up the northwest neighborhood and therefore people do not have the greatest of finances and are being charged with giving the City with access to fines that help the City to improve specially because Connect Lake Wales is coming down. He stated that it hurts the residents that sO many fines are being given and at such a high rate of $250 per day for people who cannot afford the cleanup because they do not have the means necessary right away. He stated that he understands that it is not up to the Board to determine the time, but not everyone came with a silver spoon in their mouth and you have to be able to have a heart. He stated that he asks this Board to have a heart with what they are doing in regards to the fines because people are only trying and can only do what they are capable of doing especially when it comes to finances. 15 Tonya Christian of 2248 Mammoth Grove Road, stated that she has a question on the last case and that Mr. Wilson did address her question when he stated that the property owner would make a tattoo shop out of that home in a residential area and wanted to make sure that the Board was on top of it and they were. She stated that she Ivette Petalow of 119 D Street, addressed the Board and stated that she just moved here in April and that she attempted to get on the Board Docket. Mr. Wilson let Ms. Petalow know that if she has a pending case she cannot talk about her case because this is just open remarks, and her case cannot be discussed until iti is on the docket Mr. Wilson offered that if she wants to give some general comments not related to her case she may do so, but he will not allow her to speak about her case. Ms. Petalow stated that she was told that she could not come before the Board by Ms. Lozano and that the only way her case can be heard is if she has fines and the house will be foreclosed on. She stated that she has the newest house on D Street, and she Mr. Wilson stated that he does not like to be rude but that he cannot have her discuss this. She asked how she can come before the Board. He stated that if she has violations, then this case may be presented to this Board and that the recommendation is Ms. Petalow work with staff. He stated that staff is versed on this much more than the Board as the Board is volunteers who are trying to balance doing the right thing for the communities. He stated that the best thing is to work with staff to remedy whatever the Ms. Petalow stated that if the violation is saying something and you are not doing it, how Mr. Wilson stated that he understands but he cannot advise her or anyone on this board Ms. Petalow stated that she is disabled and sick and that is why she moved to Polk County sO that she could get closer to Tampa and Orlando doctors. Mr. Wilson directed Ms. Petalow to work with staff. appreciates the Board. because the Board cannot be prejudice to that. got Bev to clean up the back alley. violations are. do you go about that? can give her advice what her options are. Ms. Petalow stated that staff only gave her less than two months to move her food truck. Ms. Lozano stated that Ms. Petalow cannot speak on her violations. Ms. Lozano also stated that she would like to clarify that Ms. Petalow has asked to appear before the Board and that she has explained to Ms. Petalow on two or three occasions that if the case is scheduled for the Board it will be for possible fine assessment which is the last resort for non-compliance and that staff is asking her to comply because staff does not want to bring her case before the Board as staff is looking for voluntary compliance. Ms. Lozano stated that she has tried to explain to Ms. Petalow that this Board has no jurisdiction on things that she is asking for. 16 Ms. Jones stated that City Staff is really going to be the best option at this time and that ift there is another issue that she feels Code Compliance is not addressing then Ms. Petalow may want to contact Planning and Zoning and that this Board is basically here to determine whether you are out of compliance with the City code and what penalty and amount of time that you would have to come into compliance, and that if Ms. Petalow feels that her issue is not out of compliance then Ms. Petalow should talk to city staff and Mr. Wilson stated that for the sake of Ms. Petalow's issue to please work with staff. Ms. Petalow stated that she came toi the City Commission meeting and that she spoke to the City Manager and he asked her not to mention her citations at the meeting and she didn't as the City Manager said he would try to work with Ms. Petalow and the only thing Mr. Wilson stated that Ms. Petalow is working with the CEO of the City, and Mr. Wilson stated that he cannot tell her what to do next but this Board cannot entertain this case. not this Board. he did was grant her an extra week. 9) BOARDISTAFF COMMENTS/OTHER BUSINESS Mr. Bennett asked if he could have a couple of minutes to talk about snipe signs at the next meeting he would appreciate it. Mr. Wilson asked Ms. Lozano to add this item to the Mr. Gibson asked who maintains the median on highway 27. Mr. Lozada responded DOT (Department of Transportation) and that he would relay the message to the streets Ms. Hammel stated that she still thinks the Board is too soft and that she agrees with a couple of the public comments. She stated that al lot of these rules she does not agree with at all, but they are there and they need to be enforced because they are for the betterment of the City. She stated that the responsibility of property owners a long time ago everyone seemed like they did the diligence and they were responsible with their properties but now it seems like nobody feels like they could care less about this property and that this why we see sO many issues. She stated that the fact that people do not agree with her like the Board, that doesn't bother her al bit. She said she does not hold it personally and people can agree or disagree with her all they want and it doesn't really matter as we have a job to do and if we continue to pick and choose it seems like, then we are not helping the City at all but we have to do what we signed up for. Mr. Wilson stated as the current chair oft the Board he cannot stress enough how he appreciates everyone's time. He stated that he does not know how much the general public and even city leadership understand how this is one of thei toughest boards to serve on with the fact that we never get leadership here outside of when Mr. Bennett was the Development Services Director. He stated that the Board is giving up their time and we try to do the right things and he stated to Ms. Hammel not to feel like there was a personal attack on her and that she is right as sometimes he feels we get lost and as the chair he needs to control the meeting. He stated that Mr. Marino always rides out before the meeting and he sees stuff that some of us never get out to see and some of us live agenda. department as they may have a contact person for maintenance. 17 int these neighborhoods sO it is ok to share that information sO that it brings a different perspective as to why people are voting in any given way. He stated that all of us have committed to serving the citizens of Lake Wales. He stated that he knows that he uses the term education over and over again, but he wanted to express what is driving him crazy and he thinks leadership needs to come in here, is because that case is going to be about something that two or three months ago we had an issue with and sO he doesn't like to not be transparent with people as he grew up here and lives here and stated that there are people who have favorites sometimes. He stated that the food truck thing is going to be a problem and we need to educate the general public and it will come back to bite us and we need to start educating and talking openly. just like when we did the carwash thing. He stated that the Board is not city staff and as the Board we cannot offer advisement and that he knows personally the codified ordinance oft the food truck, staff is going to catch hell trying to enforce it and leadership needs to understand what they are getting into. He stated that he has mentioned to the Police Advisory Board that we need tracts of land for people to park their commercial vehicles and for people to park their food trucks. Mr. Wilson went on to mention violations of high grass and sidewalk violations on Washington Ave where the landlord is allowing his residents to drive on the sidewalk and that he would hate for the City to have to eat those fees when that sidewalk collapses. He stated that the public needs to be made aware of what they Mr. Bennet stated that there is not a requirement or code of ordinance that a director or City Manager be here and that he made it a priority as a leader to be here: one because oft the importance oft this, two: to show support to staff who arguably has the toughest job int the building and to be blunt he is a property owner himself and he cares about how Mr. Wilson stated that he totally understands that as he has been a director himself but sometimes going to public meetings to eradicate or avoid the very thing that might get to this chamber in a different capacity and no one has even graced appearance. Mr. Wilson stated that it is tough to sit on this Board and sometimes there is no recognition for folks. Mr. Wilson stated this Board is making decisions to potentially take people's property sO can and cannot do. the city looks. he thinks it is important for leadership to show up sometimes. 10) ADJOURNMENT With no further business to discuss, the meeting was then adjourned at 7:25 pm.
