CALL TO ORDER: The meeting was called to order at 9:00 A.M. by Special Magistrate William P. Doney. II. APPROVAL OF MINUTES: Special Magistrate Doney approved the minutes of April 3, 2024. III. SWEARING IN OF WITNESSESS: Special Magistrate Doney administered Oath to Code Enforcement Officer Joseph Petrick. CODE ENFORCEMENT REPEAT VIOLATION, FINE ASSESSMENT AND STATUS HEARING CASE NO. 24-00007 CLARIBEL ALEJANDRA MARTINEZ 5465 STRATFORD ROAD HAVERHILL, FL 33415 PCN: 22-42-43-35-15-000-0300 LEGAL DESCRIPTION: TOWNER PARK REPL LT 30 NATURE OF VIOLATION: Chapter 14 Section 14-2 Permit and inspection fees for building, electricity, and plumbing. Chapter 14 Section 14-7 Unsafe buildings and Code Enforcement Officer (CEO) Joseph Petrick testified this case was in reference to a Single-Family residence that was found in violation at the March 6, 2024, Special Magistrate hearing in violation ofTown Code Section 14-2 and 14-7 for an expired structures. 1 building permit for an above ground swimming pool. CEO Petrick stated the Special Magistrate Order gave the Respondent until April 5, 2024, to comply by obtaining a permit to demolish the pool, close the permit ift the pool was not installed or receive a fine ini the amount of$100.00 per day for each day the property remained out ofcompliance. He stated that on April 15, 2024, Deputy Town Clerk Jean Wible (who was presented at today's! hearing), received an email from the Respondent apologizing for the open permit however, no further action has been taken by the Respondent to close the building permit. CEO Petrick stated the Town was requesting a fine ofs $100.00 dollars per day beginning April 5, 2024, as indicated in the Special Magistrate orders from March 6, 2024, and the Iti is the Order of the Special Magistrate that a fine in the amount of Two Thousand Six Hundred Dollars ($2,600.00) is hereby assessed at a daily amount ofOne. Hundred Dollars ($100.00) per day for the violations which have existed on the property from April 6, 2024, through May 21, 2024, a period of twenty-six (26) days and such amount will continue to accrue at the rate ofOne Hundred Dollars ($100.00) per day until compliance is achieved. cost of$14.41 to bring this case to hearing today.
