July 2, 2024, at about 19501 hours, Chief Conner was dispatched to a dog bite that had just occurred. He contacted ten-year-old Grace Craps who had a laceration on her left calf that was allegedly the result of being bitten by an English bulldog while she was at 1051 Pacific Avenue in] Riol Dell. ChiefConnerin investigated the incident further and found three witnesses who all confirmed that Pedro, the English bulldog belonging to Dayana Blanchard, had bitten Grace Craps without provocation. In addition, Chief Conner learned that Pedro had al history of being aggressive towards children although there is no record ofhim biting anyone else. Rio Dell Municipal Code Section 6.05.030 defines al Potentially Dangerous Dog as, Any dog which, when unprovoked, bites a person causing less severe injury than as defined within the definition ofa "vicious dog" amongst other definitions. Consequently, Chief Conner, believing that he had probable cause that Pedro fit that definition, informed his owner, Dayana Blanchard, ofhis determination of Pedro as al Potentially Dangerous Dog. As set forth in Rio Dell Municipal Code Section 6.05.110(4), Ms. Blanchard has requested al hearing before the Rio Dell Rio Dell Municipal Code Sections 6.05.110 covers the regulation of vicious animals including Potentially Dangerous Dogs. In summary, it requires that a dog meeting that standard must be confined in a fenced yard, a structure, a vehicle, or on a leash at all times. Failure to meet these requirements can lead to further punitive action including administrative penalties, declaration of City Council to contest the Chief's determination. the animal as Vicious Dog, and/or the impoundment oft the animal. Iwasi further advised that the actual bite took place at 1051 Pacific, but the juvenile victim and her mother were now on First Avenue and that medical was also being dispatched. Iresponded wearing a distinctive police uniform and drivinga llocated the victim, later identified as Grace Craps, lyingi in her mother's arms while she was seated on the curb. The mother, later identified as Alyssa Craps, was holding a paper towel onto a wound) just above Grace's left ankle. There was no blood showing on the paper towel. Istarted to gather information, but medical personnel arrived and Istepped out oft the way. contacted a young woman who had at family resemblance to Grace and she confirmed that she was Grace's: sister. She provided additional information and shared a picture taken earlier of Grace's injury. Itappeared to be al laceration about twoi inches long and deep enough to require stitching. In listening to the medical personnel gather information, this description of thei injury was confirmed. loverheard Alyssa explain what had happened and learned the following: She and her daughter had been at 1051 Pacific doing some yard work as they intended to move to that location shortly. The neighbor and another woman came out with two dogs. One was al French bulldog that was friendly. The other was an English bulldog. The English bulldog struck at Grace and knocked her to the ground. The dog then stood over Grace with his hindquarters over her torso and with his teeth still latched onto her leg. Both women tried to pry the dog's mouth open without initial success. But eventually, Alyssa was able to pull her daughter free. Shet then rushed After Grace was transported by ambulance toi the hospital, Iwent to 1071 Pacific, Apartment A, where Dispatch told me the dog's owner lived. Therel Imet a woman who identified herself as. Jenna Hartzell. Jenna was on the phone and she told me the other person was the dog's owner, Dayana Blanchard. Icould hear Blanchard say that she would be home in an hour and l'asked. Jenna to end the call. Jenna did sO andi then told me thet following: She and her sister were home, but Blanchard was not. They let the dogs out, not knowing that Grace was present. Jenna was aware that the English bulldog, later identified as Pedro, did not like children. She tried to remain calm while trying to get Pedro away from the child, but did not want exacerbate the situation by moving quickly. Grace was able to pet the French bulldog. Then Pedro struck at the girl. Jenna and her sister, Kelsey Hartzell, tried to get Pedro off of Grace, buti it was difficult. Eventually, Alyssa was able to pull her daughteri free. Ata about 2115 hours on the same date, a woman came toi the: station andi identified herself as Dayana Blanchard. She told me that her dog had just bitten a young girl. She informed me oft the following: Her English bulldog was named Pedro. Shel had rescued him from Miranda's Rescue about four years previously. He never bitten anyone before this. She was aware that he did not like children as she believed that he had been beaten bya a child before: she obtained him. He had been treated by Ferndale Vet for a medical condition and was confident that he had received rabies vaccinations from that facility. However, she had no proof of that currently. She added that lexplained to Blanchard that the Police Department was going to declare Pedro to! be al Potentially Dangerous Dog. This would require that hel bel leashed or confined inside ofal building, fenced yard, or kennel. Violations could lead to more severe repercussions. You may appeal my determination by requesting a hearing within ten days of receiving this memo. The hearing will be scheduled before the Rio Dell City Council at the next available, normally scheduled meeting. You may request the comei@sipoliocelasoy Ifyou do request al hearing, you must still follow the requirements outlined in the attached City Code about keeping Pedro confined within an enclosure, leashed, or inside ofas structure or vehicle. Should you prevail at the hearing, these requirements will no Ihave examined the fenced area to the rear of your residence. It appears to be made from a plastic material. It does not meet the requirements of an Enclosure as defined in the attached City Code. A dog could easily chew its way through the fencing material ifit was SO inclined. The fence needs to be constructed from a metal material, preferably galvanized chain link, and be reinforced at the bottom to prevent the animal from digging/pushing his way underneath. BACKGROUND AND DISCUSSION Council approval ofa budget amendment for FY 2024-25 is requested to increase appropriations for the Per Capita Park Development Grant (Dog Park). Resolution 1439-2019 authorized the City of Rio Dell to enter into a contract with the State Department of] Parks and Recreation, approving the Per Capita Grant Funds application. Funding is from the California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access for All Act of2018. The amount allocated to the City of] Rio Dell is $177,952; no match is required because the City qualifies as At the. January 2, 2024, City Council meeting, staff was directed to review the list ofbids to complete the project and continue the item to the. January 161 meeting for final approval. After receiving several bids, Mobley Construction was the winning bidder, with a final bid of $198,600. Factoring in a 10% project contingency, the total estimated project cost was $218,460. The City received a change order that isi included with this report that describes the details of the request. The change order increases the contract price by $29,012.50. Additionally, the contractor provided a quote to clean the existing concrete culvert for an additional $3,800. The total cost of the additional work amounts to $32,812.50. The new total estimated project cost after factoring the change order and culvert work amount to $231,412.50. This will require an serving a severely disadvantaged community. An additional $40,508 was allocated from the ARPA-SLFRF Fund. additional $12,952.50 allocated from the ARPA-SLFRF Fund. The City received $801,152 in total ARPA: funding, of which $695,642 remains. The funds can be used for eligible costs incurred from March 3, 2021, through December 31, 2024, and the performance period ends on December 31, 2026. Fiscal Recovery Funds must be used in one of the eligible use categories specified ini the ARPA guidelines. Rio Dell will use these funds under the Government Services definition, including public infrastructure improvements. After the requested Budget Adjustment is finalized, the ARPA Fund will have $682,689.50 remaining to Staffr recommends approving the budget amendment to allocate $12,952.50 from the. ARPA- SLFRF Fund to complete the Per Capita Park Development Grant project.
