Aragauille  MINUTES OF CITY COUNCIL REGULAR SESSION MARCH2,2020  The Regular Session of the City Council of the City of Seagoville, Texas was called to order at 7:02 p.m. on Monday, March 2, 2020, at City Hall, 702 N. Hwy 175,Seagoville, Texas with  a quorum present, to wit:  Dennis Childress Jon Epps Jose Hernandez Rick Howard Harold Magill Mike Fruin  Mayor Mayor Pro Tem Councilmember Councilmember Councilmember Councilmember  The following staff members were also present: City Manager Patrick Stallings, Police ChiefR Ray Calverley,Community Development Director Ladis Barr, City Attorney Victoria Thomas, Finance Director Patrick Harvey, Director of Administrative Services Cindy Brown, and City Secretary  Kandi Jackson. He stated Mr. Conroy completed the annual audit for the City of Seagoville. Finance Director Harvey presented the CivyofSeagoville 's Comprehensive Annual Financial Report (CAFR) for Fiscal Mr. Conroy explained a letter has been submitted concerning the City of Seagoville's clean  for Fiscal Year 2019 (Finance Director)  Year 2019. audit report. Conduct a public hearing to discuss a change in zoning from Residential Single Family (R-5) to Plan Development-keidental Single Family-5 (PD-20-01) for approximately 29.25+ acres of land in the John D. Merchant Abstract 850, located southwest of East Farmers Road, between May Road and Alto Road, Seagoville, Dallas  County, Texas (Community Development Director) Mayor Childress opened the public hearing at 7:19 p.m.  Pat Atkins at 2807 Hays Lane, Rockwall, Texas presented the development and provided  elevations.  Councilmember Magill stated he liked the refreshing look of the renderings.  6. Discuss and consider approving an Ordinance of the City of Seagoville, Texas, amending the Comprehensive Zoning Ordinance and Map of the City of Seagoville, Dallas County, Texas, as heretofore amended, by granting a change in zoning from Residential Single Family (R-5) to Plan Development-Keidenta Single Family-5 (PD- 20-01) for approximately 29.25+ acres of land in the John D. Merchant Abstract 850, located southwest of East Farmers Road, between May Road and Alto Road, Seagoville, Dallas County, Texas, and being legally described in Exhibit "A" attached hereto and incorporated herein; providing for development regulations; providing for the approval of the concept plan, which is attached hereto and incorporated herein as Exhibit "B"; providing a repealing clause; providing a severability clause; providing a savings clause; providing a penalty fine not to exceed the sum ofTwo Thousand Dollars ($2,000.00) for each offense; and providing an effective date (Community Development Director) Motion to approve an Ordinance ofthe Cityo of Seagoville, Texas, amending the Comprehensive Zoning Ordinance and Map of the City of Seagoville, Dallas County, Texas, as heretofore amended, by granting a change in zoning from Residential Single Family (R-5) to Plan Deriopmemi-kesiaenta. Merchant Survey, Abstract No. 850, as depicted in Exhibit "A", which is attached hereto and incorporated herein, to the abutting property owner; providing for the furnishing of a certified copy of this ordinance for recording in the Real Property Records ofI Dallas County, Texas, as a quit claim deed; and providing for an effective date Motion to approve an Ordinance of the City of Seagoville, Texas, vacating, abandoning and releasing a 15foot (15) wide by 354.10 feet long alley way, being 4,912 square feet, located on Lot IR, Block 4 of the Town & Country Shopping Center, John D. Merchant Survey, Abstract No. 850, as depicted in Exhibit "A", which is attached hereto and incorporated herein, to the abutting property owner; providing. for the furnishing ofa certified copy ofthis ordinance for recording in the Real Property Records of Dallas County, Texas, as a quit claim City Attorney Thomas stated the Ordinance Caption and Section 1. ofthe Ordinance needs to be revised to state " inj favor ofthe abutting property owner that is the owner of the underlying fee". Councilmember Hernandez accepted her revision, seconded by Magill; motion passed 8. Discuss and consider: a Resolution ofthe City Council ofthe City of Seagoville, Texas, ratifying and approving the Economic Development Incentive Agreement by and between the SEDC and John Bunker Sands Wetland Center, Inc., in an amount not to exceed One Hundred Thousand Dollars ($100,000.00), to be paid in two installments, said agreement being attached hereto as Exhibit A; authorizing the City Manager/Executive Director to execute the Agreements; providing for a repealing clause; providing for a severability clause; and providing an effective date (Community Development Director) Motion to approve a Resolution of the City Council of the City of Seagoville, Texas, ratifying andapproving the Economic Development Incentive Agreement byand! between the SEDCand John Bunker Sands Wetland Center, Inc., in an amount not to exceed One Hundred Thousand Dollars (S100,000.00), to be paid in two installments, said agreement being attached hereto as Exhibit A; authorizing the City Manager / Executive Director to execute the Agreements; providing for a repealing clause; providing for a severability clause; and providing an Councilmember Fruin stated he was surprised to see the Incentive Agreement with John Bunker Sands Wetland Center, Inc. on this Agenda because he thought it had been denied. He explained he felt like the Cityy was not receiving a good return on their investment. Aftersome discussion, Mayor Childress called ford a vote.
