CITY COUNCIL SPECIAL MEETING MAYI 15,2014 present, to wit: The City Council held a special meeting on Thursday, May 15, 2014 at 6:01 p.m. with a quorum Harold Magill Dennis Childress Bill Chambliss Terri Ashmore Lee Landess Peggy Day Mayor, absent Mayor Pro Tem Councilmember Councilmember Councilmember Councilmember The following staff members were also present: City Manager Larry Graves, City Attorney Bob Hager, Special Counsel Darrell Noga, HR Director Cindy Brown, and City Secretary Dara ITEM 1. The City Council recessed into Executive Session at 6:01 p.m. pursuant to Section 551.071 and 551.074 oft the Texas Government Code to seek legal advice from the City Attorney and special legal counsel regarding risk assessment for pending claim number 450--2014-01071; and, seek legal advice and deliberate whistle blower claim(s), risk assessment and employment duties, assignment or charge(s), ifany, against the City Manager, City Attorney and City Council. ITEM2. Councilmember Ashmore made a motion, seconded by Councilmember Day, to amend the employment contract of City Manager Larry Graves providing a 36 months' severance provision; in exchange, Mr. Graves will hereby execute a release of liability to the City and City Council members for any conduct occurring during his employment; and, further in exchange agrees, at the appropriate time, to reimburse the SEDC any funds that were used in his home by Ms. Roberts (former SEDC President/CEO) without his consent; Mr. Graves will release any grievance; and authorize Mayor Pro Tem Childress to execute necessary documents.
