Special Presentation Mayor Frealing presented a proclamation to Sergeant Larry Weikert, retired on April 12, 2024 after 35 years ofs service. Council Business Meeting Minutes May 13,2024 Page 1of10 President Matthew Moon added that in addition to Sergeant Weikert's service to the Borough of Gettysburg as a Code Enforcement Officer and Police Officer, he also served with the Gettysburg Fire Department including being chief for twelve years. He thanked Sergeant Weikert for his service and said that the service hel has given to the community is invaluable. Public Comment (Restricted to Items on the Agenda) There was no public comment. Current and Old Business Department of] anming/Zoning/Code Enforcement Planning Director John Whitmore gave the following report: the Planning Commission will meet on Monday, May 20th at 7:00 PM and they will review the Gettysgo/fProject Subdivision and Land Development Plan, and Spectra Kote will present their plan that will be reviewed in June; the Zoning Hearing Board will meet on May 22nd at 7:001 PM and they will be discussing the Welcome Center Project; they are finalizing the draft Zoning Ordinance and plan toj provide it to the public later this week; he will present the draft Sign Ordinance to HARB on May 15th, which has been going through the review process; and he has been working with Adams County in regards to the ownership change to the Mercy House to make sure that the zoning for the project is permitted in the Elm Street Overlay. Moved Mr. Berger seconded Ms. Lawson to enact Ordinance No. 1490-24 for the purpose of amending the text of the Gettysburg Borough Zoning Ordinance in order to add a"Library" use, as a principal use ofland and buildings, tol be permitted by right in the INS- IInstitutional-1 Zoning District ofthel Borough ofGettysburg. President Matthew Moon pointed out that this motion is not Borough Council weighing in on whether or not the library moves to ai new. location, but it is for the purpose ofi investigating what uses are allowed in the Institutional District zone. Coordinator of Historic & Environmental Preservation Coordinator of Historic & Environmental Preservation English gave the following report: HARB's. Annual Historic Preservation Awards Ceremony will bel held on Wednesday, May 15th at 5:45 PM and all are welcome to attend; al Rain Barrel Workshop is scheduled for May 30th at 5:30: PM which will be free to Borough residents and have a nominal fee to non-residents; the paper shred event will be held on. Friday, May 17th, began preparing for the Gettysburg Borough Stormwater invoices to be mailed by July 1st, and the DEP Recycling Performance 904 Grant program opened for applicants on May 11th. Ms. Lawson seconded Mr. Berger to accept the recommendations accept the recommendations of the Borough of Gettysburg Historic Architectural Review Board (HARB) following its review on April 17, 2024 and approve the grant of Certificates of Council Business Meeting Minutes May 13,2024 Page2of10 Appropriateness: for the following applications as presented: COA 23-0081 MAJOR PROJECT: 148-150 W. Middle Street - Made Clean LLC for the window replacement project that would restore the four front façade windows using wood two-over-two divided lite, replace the remaining side and rear façade windows using one-over-one vinyl windows, and repair all wood window trims by replacing the black casings with wood trim thatiswhite in color on the front elevations and using composite or extruded PVC casings that is white in color in the side and rear elevations as submitted in the application dated November 7, 2023; COA-230003 MAJOR PROJECT: 615 York Street - Schmuck Lumber Company for the proposed façade renovation changes to the front of the structure creating a new central retail entrance to the building that would modify the windows, doors, roof, ramp, and masonry as presented in the application dated April 4, 2024. Motion carried unanimously. Parking Department Parking Manager Fissel gave the following report: people are using the Pay-by-Phone App more than using cash to pay for parking; the touch screen doors were installed on the Kiosks and have been working fine; and the reserved parking spaces in the garage decreased a little due to a business finding another location to park. Ms. Sanders asked ift there has been any data collected on the Bus Parking Pilot Program Parking Manager Fissel responded that there were two bus companies that had applied to see how it is going. for the permit, but there were no businesses that applied to date. Public Works Department Public Works Director Harbaugh gave the following report: the Public Works crew began prestaging blocks for the Memorial Day Parade; the spring brush pickup is scheduled for May 20th through May 2314, the agility program projects have been coordinated and scheduled for the months of March through September, and noted that the Borough' 's agility project will begin late June rebuilding Legion Alley from Baltimore Street to Washington Street and Gilliland Alley from Water Street to Railroad Street. Borough Engineer Chad Clabaugh, Borough Engineer gave the following report: Gettysburg Inner Loop Phase B2 design has been completed and the permits have been obtained, sO the Borough isi ini the process of preparing the bidding documents; completed the land development review for Gettysgolf and will provide comments at the Planning Commission meeting in May; reviewed a minor revision to the Gettysburg Tour Center landscaping and provided recommendations for approval, noting that the construction is mostly completed; and reviewed ai revision to the lighting project at the Shippensburg Physical Therapy Land Development on Water Street and provided recommendations to the applicant. Council Business Meeting Minutes May 13,2024 Page 3of10 Police Department ChiefGlenny gave the following report: breaking in to cars has been occurring frequently in the Borough and stressed the importance of securing your cars, and gave a shout out to the officers for a job well done in catching an individual that broke in to several vehicles in the Borough; Sunday, May 12th was the beginning of Police Memorial Week; May 15th is Peace Officer Memorial Day in which a ceremony takes place in Washington, DC where they will add names of fallen officers to the Memorial Wall; and thanked Sergeant Larry Weikert for his many years ofs service to the police department and wished him happiness in his retirement. Chief Glenny gave a brief explanation regarding the motion to transfer Sergeant Larry Weikert'ss service weapon tol him. He said that in this country there is a Law Enforcement Officers Safety Act that was passed in 2004 that allows for active, retired and separated law enforcement officers who are separated in good standing to carry a concealed firearms anywhere in the United States. He said that there are ai number of agencies that gift the service weapon to an officer. Moved Mr. Bales seconded Mr. Berger to adopt Resolution No. 051324-1 authorizing the transfer of a certain Borough-owned police service weapon (Serial Number: BECF928) with an estimated fair market value of $300.00 to retired Borough Police Officer, Sergeant Larry Weikert, in honor of his more than 20 years of service as a full-time law enforcement officer upon his retirement from the Gettysburg Borough Police Department. Yea: Mr. Bales, Mr. Berger, Mr. Moon. NAY: Mrs. Butterfield, Ms. Lawson and Ms. Sanders with Mayor Rita Frealing voting Yea to break the tie vote. The vote passed 4 YEA/3NAY. Councilwoman Butterfield thanked Sergeant Weikert for his years of service to the community and also to the family members of those who serve and are also deserving of our thanks. She asked Chief Glenny if the cost was included in his budget and also asked if other communities gift service weapons; and ifso, is it frequent or on rare occasions. ChiefGlenny responded nol he didi not include this in his budget. He said that the agencies that hel has been associated with does gift firearms and that he received his firearms when he retired from those agencies. He said that he would not characterize it as being done frequently nor would he say that it is rare. Councilwoman Butterfield went on to express her concern that this motion will set a precedent that Council will feel obligated tol honor going forward and does not feel that we should be speaking for future Councilors. She went on1 to: say that her personal opinion to thank an officer would be to place their badge and accessories in a shadow box frame instead oft the firearm. She said that she is not anti-firearm and noted that shel has a concealed carry permit. Chief Glenny responded that the police department already gave Sergeant Weikert a Councilwoman Lawson also expressed her appreciation to Sergeant Weikert and his family and said that she has known him for over twenty-five years when he was the Borough's shadow box with those accessories. Council Business Meeting Minutes May 13,2024 Page 4of10 Code Enforcement Officer and when she worked as the Chief Spokesperson for Gettysburg College. She said that they collaborated closely with the Regulated Rental Unit Ordinance. She said that he also serves the community by serving with the Gettysburg Fire Department and was their chief for twelve years. She said that this is the first time the police department is planning to give a service weapon to ai retiring officer and said that she would have liked more time to discuss it. She expressed her concern that this will set a precedent going forward. She made it clear that she holds Sergeant Weikert in high regard and SO her vote: is nothing against him. Councilwoman Sanders agreed with her colleagues and said that it sets a dangerous precedent moving forward and that we should not speak for future Councilors. She said that Borough Council works with the municipal budget and taxpayers' dollars sO we need to consider that. Future Councilors will need to decide ift this type of gift during retirement is equitable. She said that this has nothing to do with Sergeant Weikert and noted that she has heard wonderful things about him. Office of the Manager/Ireasurer/Secretary Manager Gable gave the financial report as: follows: in Fund 01, Revenue verses Expenses there, is approximately a $33,000 deficit as of April 30th which is typical for this time of year; currently the Borough is just under $1 million in the General Fund 01, and just over $1.8 million in liquid cash for daily expenses; Capital Projects Fund 18 has restricted funds to be used for the Flap Grant match, Welcome Center local match and the Interloop Phase B2 in which these funds have been invested into the PA Local Government Investment Trust (PLGIT) earning 5.41 percent interest. The remaining $45,000 in] Fund 18i isi for one-time projects liket the upgrades to the security system, installation of new computers, etc.; Liquid Fuels Fund 35 has $795,000; Capital Reserve Fund 30 has $870,000 remaining which are: reserved for capital projects which have not yet been restricted by Council; and the American Rescue Plan Act (ARPA) Fund 96 has $1.61 million which the Borough will begin to draw down during the next pay cycle to support salaries of staff as directed by the authorizing legislation. Manager Gable gave an update on the Cozen O'Conner Public Strategies Agreement which is a cost-share agreement between the Borough, the Gettysburg Municipal Authority, and the Gettysburg Storm Water Authority. Cozen O'Conner will meet with Senator Casey'sstaff, and the Borough had a virtual meeting which went well. Cozen O'Conner is aware oft the Borough's Council Business Meeting Minutes May 13,2024 Page5of10 projects and grant application status. A similar meeting is scheduled with Senator Mastriano next week. Manager Gable gave an update on the America250PA commemoration of the founding of the United States of America. The Pennsylvania Commission for the United States Semi- Quincentennial was established by the Pennsylvania legislature and the governor in 20181 to plan, encourage, develop and coordinate the anniversary. All sixty-seven counties in the state are encouraged to develop a local county commission. Adams County has developed a Steering Committee which includes the Borough of Gettysburg and they have since created subcommittees fort the following: Civic Engagement Committee, County Heritage Committee, Events Committee, Fundraising Committee, and Marketing Committee. Councilwoman Lawson asked if these are all of the subcommittees. She suggested including the Adams County Library, The United Lutheran Seminary, and the Lincoln Cemetery toac committee. Manager Gable responded that these are the only committees as of now but more could be added. He said that they are not able to approach all these organizations; but if there is something they want to bring to their attention, it could be incorporated into a larger countywide event. Moved Ms. Lawson seconded Mr. Bales to approve: all bills and payrolls for the month Moved Ms. Sanders seconded Ms. Lawson to authorize Borough Manager, Charles R. Gable, MPA to submit a grant application to the U.S. Department ofTransportation, for the Safe Streets and Roads for All (SS4A) grant program, in the amount of$150,000.00 and to commit local match dollars in the amount of the required 20% match of $30,000.00. as presented. Steinwehr Avenue Heart of Gettysburg Battlefield (SAHGB) Councilwoman Butterfield gave the following report: Borough Manager Gable and Planning Director Whitmore attended the meeting and spoke about issues that the BID is concerned with focusing on signage, garbage contracts and garbage hauling companies. Adams County Boroughs Association (ACBA) Mayor Frealing announced that the next meeting of ACBA is scheduled for Monday, May 20th to be held at the. Adams County Emergency Services building at 6:30 PM. She noted that anyone is invited to attend these meetings. Adams County Council of Governments (COG) Councilwoman Butterfield gave the following report: the next meeting of ACCOG is scheduled for Thursday, May 23rd at the Adams County Emergency Services building; and she serves on the collaborative subcommittee where they continue with the survey concerning the cybersecurity for various organizations.
