Giasantle MINUTES OF CITY COUNCIL REGULAR SESSION JUNE 4, 2018 The Regular Session of the City Council of the City of Seagoville, Texas was called to order at 7:40 p.m. on Monday, June 4, 2018, at City Hall, 702 N. Hwy 175, Seagoville, Texas with a quorum present, to wit: Dennis Childress Jon Epps Jose Hernandez Rick Howard Harold Magill Mike Fruin Mayor Mayor Pro Tem Councilmember Councilmember Councilmember Councilmember The following staff members were also present: City Manager. Patrick Stallings, Police Chief Ray Calverley, Community Development Director Ladis Barr, City Attorney Alexis Allen, Finance Director Patrick Harvey, Senior Finance Accountant Gail Lawrence, Police Support Services Christine Wirth, Director of Administrative Services Cindy Brown, and City Secretary Kandi Jackson. Invocation - Invocation was led by. Harold Magill. Pledge of Allegiance - Pledge of Allegiance was led by Mayor Childress. Government Finance Officers. Association (GFOA) Budget Award. Recognition for Budget Award - Mayor Childress presented the Finance Department with the Citizens Public Comment Period- This portion of the meeting is to allow each. speaker up to six (6) minutes toaddress the council on items not) postedont the current agenda. Council may not discuss these items but may respond with factual data or policy information, or place the item on a future agenda. Citizens wishing 10 speak on posted agenda items will be called upon at that time. Anyone wishing to speak shall submit a Speaker Request Form to the CONSENT AGENDA- The Consent Agenda contains items which are routine in nature and will 1. Conduct a public hearing to discuss and consider an Ordinance of the City of Seagoville, Dallas County, Texas, amending the comprehensive zoning Ordinance by adopting the recommended language for creating a new zoning district called Highway Overlay District as shown in Exhibit "iv",attached hereto and incorporated herein; providing for a repealing clause; providing a severability clause; providing for a savings clause; providing for a penalty of fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and providing an effective date (Community Development Director) Mayor Childress opened the public hearing at 7:44p.m. Gary Denson spoke against the Highway Overlay District. He stated he owns five (5) properties that are impacted by the Highway Overlay District and he explained the areas ofthe Highway Overlay District that would negatively impact his properties. Mayor Childress closed the public hearing at 7:50 p.m. 3. Discuss and consider approving, rejecting, or tabling the Highway Overlay District (Community Development Director) Councilmember Hernandez stated he requested the Highway Overlay District be put on the Agenda because he felt like that was a way to start cleaning up the area around the highway. He. statedthere are businesses along the highway that complywith the ordinances and there are businesses that do not comply. It was his intent to clean up the area around the highwayforc compliance. He also statedi there are items ini the Highway Overlay. District that he does not agree with and he would like Staff to continue working on and updating Motion to table the Highway Overlay District for Staff to continue modifying the Zoning Ordinance of the Highway Overlay District, and update Council every three (3) toj four (4) months - Hernandez, seconded by Epps; motion passed with all ayes. 5/0 the Highway Overlay District. 2 Seagoville City Council Regular Session June 4, 2018 4. Discuss and consider al Resolution of the City Council of the City of Seagoville, Texas, approving the terms and conditions of the agreement for professional services between the City of Seagoville, Texas and A+ Food Industry Inspections, Inc., for food establishment inspections, which is attached hereto and incorporated herein as Exhibit A, and authorizing the City Manager to execute said agreement; providing for a repealing clause; providing for a severability clause; and providing an effective date Motion to approve a Resolution of the City Council of the City of Seagoville, Texas, approving the terms and conditions of the agreement for professional services between the City of Seagoville, Texas and A+ Food Industry Inspections, Inc., for food establishment inspections, which is attached hereto and incorporated herein as Exhibit A with changes in the terms and conditions of the agreement, Section 2.2, Fto allow A+ Food Industry Inspection, Inc. to offer. food handler certification courses for the employees of those businesses located in the City of Seagoville and Kaufman County, provided the Professional cooperates with management regarding hosting of the classes, and provided the fee(s) the Professional charges for such classes do not exceed the fee(s) charged by the Professional for the same classes held elsewhere within the North Texas region and authorizing the City Manager to execute said agreement; providing, for ar repealing clause; providing, for a severability clause; and providing an effective date Hernandez, seconded by Epps; motion passed (For-Hernandez, Magill, and (Police Support Services Manager) Eppydgans-Howard and Fruin). 3/0 3 Seagoville City Council Regular Session June 4, 2018 5. Discuss and consider the approval of a Resolution of the City Council of the City of Seagoville, Texas approving an agreement for professional engineering services on a defined scope ofs services basis by and between the City of Seagoville: and Halff Associates, Inc., a Texas Corporation, for the reconstruction, mill and overlay ofaj portion of Malloy Bridge Road located in Kaufman County that was annexed by the City of Seagoville, on or about August 28, 2017, in an amount not to exceed thirty six thousand seven hundred dollars and zero cents ($36,700.00), which is attached hereto and incorporated herein as Attachment 1; authorizing the City Manager to execute said agreement; providing for a repealing clause; providing for a severability clause; and providing an effective date Motion to approve a Resolution of the City Council of the City of Seagoville, Texas approving an agreement for professional engineering services on a defined scope of services basis by and between the City of Seagoville and Halff Associates, Inc., a Texas Corporation, for the reconstruction, mill and overlay ofay portion of Malloy Bridge Road located in Kaufman County that was annexed by the CivyofSeagoville, on or about August 28, 2017, in an amount not to exceed thirty six thousand: seven hundred dollars and. zero cents ($36,700.00), which is attached hereto and incorporated herein as Attachment 1; authorizing the City Manager to execute. said agreement; providingforar repealing clause; providing. for a severability clause; and providing an effective date - Epps, seconded by 6. Discuss and consider an Ordinance of the City of Seagoville, Texas, amending the Code of Ordinances, Article 19.02, Solid Waste, subsection 19.02(b) by deleting all references to large brush and by adding subsection 19.02 (c) to provide for the location, day and times for placement ofl large brush at the curbline for collection; providing for the repeal of all Ordinances in conflict; providing a severability clause; providing fora penalty of fine not to exceed the sum of five hundred dollars ($500.00) for each offense; Mayor Childress stated he requested this item be placed on the Agenda to allow citizens Afier some discussion, a motion was made to approve an Ordinance of the City of Seagoville, Texas, amending the Code of Ordinances, Article 19.02, Solid Waste, subsection 19.02 (b) by deleting all references to large brush and by adding subsection 19.02 (c) to provide for the location, day and times for placement of large brush at the curbline for collection; providing. for the repeal of all Ordinances in conflict; providing aseverability clause; providing, forap penaltyoff fine not to exceed the. sum offive hundred dollars (S500.00) for each offense; and providing an effective date,- Hernandez, Council directed Staff to revisit the Ordinance in three (3) to six (6) months.
