COUNTIES OF DALLAS AND KAUFMAN CITY OF SEAGOVILLE CITY OF SEAGOVILLE CITY COUNCIL MINUTES The City Council of the City of Seagoville met in a Regular Meeting on Monday, August 20, 2012 beginning at 6:30 p.m. in the Council Chambers of City Hall, 702 N. Highway 175, Seagoville, Texas, with the following members present: Mayor Mayor Pro Tem Council Member Council Member Council Member Council Member Sidney M. Sexton, Jr Harold Magill Terri Ashmore Lee Landess Dennis Childress Peggy Day Mayor Sexton called the' Work Session to order at 6:30 p.m. WORK SESSION 1. Staff Updates & Presentations - Larry Graves, City Manager advised the Council the next meeting will be September 10th due to the Labor Day holiday. He gave an update on spraying for West Nile. Jeff Swaggerty, Code Enforcement Officer, 3. Conduct interview for Parks and Recreation Commission = Logan White and Scott Englert were interviewed and expressed interest in serving on the commission. 4. Adjourn - Mayor Sexton adjourned the Work Session at 7:05 p.m. presented the new Code Enforcement software to the City Council. 2. Discussion of Agenda Items - None REGULARI MEETING CALL1 TOORDER Mayor Sexton called the Regular Meeting to order at 7:05 p.m. INVOCATION AND PLEDGE OF ALLEGIANCE Council Member Childress gave the invocation and led the pledge of allegiance. CITIZEN'S INPUT None CONSENT AGENDA A. Consider approval of the August 6, 2012 City Council Minutes. Department of Public Safety for the Failure to Appear Program. B. Consider approval of an Interlocal Cooperation Contract between the Texas Mayor Pro Tem Magill made a motion to accept the consent agenda. Council Member Landess seconded it and the motion passed 5-0. City Council Regular Meeting Minutes August 20, 2012 Page 2of3 INDIVIDUAL CONSIDERATION 1. Consider and act upon Resolution No. 24-R-12 authorizing Dallas County to resell tax foreclosed property by public or private sale to the highest qualified purchaser. Council Member Day made a motion to approve Resolution No. 24-R-12. Council Member 2. Consider and make appointments to vacançies on the Parks and Recreation Council Member Landess made a motion to appoint Logan White and Scott Englert to the Commission. Council Member Childress seconded the motion and it passed 5-0. 3. Conduct a public hearing on Zoning Request #Z2012-03 to establish a Specific Use Permit (SUP) for an extension of church services on the subject property located at 618 Netherland Drive and if granted, authorize the Mayor to execute an Ordinance Ashmore seconded the motion and it passed 5-0. Mayor Sexton opened the public hearing at 7:11 p.m. Melvin Oatman, Jr., Pastor of the church addressed the Council about their intent on using the facility. He stated it will be used for fellowship meetings and Bible classes. Mayor Sexton asked Pastor Oatman if he agrees to all seven of the special conditions set forth by the Planning and Zoning Commission. Pastor Oatman agreed. The public hearing was closed at 7:14 p.m. Council Member Childress made a motion to approve the SUP for an extension of church services at 618 Netherland Drive subject to all seven conditions below. Council Member Landess 1. No one shall occupy the main structure until the structure is brought into compliance with all of the City's building codes, proper inspections have been performed by the City's building official, and a final certificate of occupancy is issued by the City's 2. Installation of a 6' wooden privacy fence or chain-link steel fencing with interwoven slats is recommended for visual screening from the residential properties on the southwest, northeast and northwest sides of the subject property as per the City's 3. The subject property shall remain in compliance with the City's Zoning Ordinance, Section 25.02.716 - Site and Building Lighting, listed above to minimize the amount ofobnoxious glare or direct illumination across the subject property's property lines. 4. The SUP shall be revoked if at any time the structure is used to provide living quarters for an individual(s) past the church's special event periods (vacation bible 5. Individual Consideration, Cont: 4. Conduct a public hearing on Zoning Request #Z2012-04 to rezone Lot2 2, Block A of the Ott Addition from its current Light Manufacturing (LM) zoning to Heavy Manufacturing (HM) zoning and amend the Comprehensive Land Use Plan. Mayor Sexton opened the public hearing at 7:17 p.m. Jerrel Ott addressed the City Council about allowing this zoning request to pass. He advised that he and his father will comply with any requests the City Council would make of them. The public hearing was closed at 7:19 p.m. Mayor Pro Tem Magill made a motion to deny the zoning request, with prejudice. Council Member Dennis Childress seconded the motion and it passed 5-0.
