ANNOUNCEMENTS: Councilmember Lewis led the Council, Staf and Citizens inp prayer and pledges to the U.S., Texas, and Mayor's Announcements - Mayor Gardner spoke about several events happening in Palacios within the next month, including polling locations, spring clean-up, Town. Hall Meeting, National Day of! Prayer, Movies int the Park, vessel removale event, Boys and Girls club annual fundraiser. Council Members. Amnouncements - None CITIZEN COMMUNICATION FORUM: - Public Comments 1. Jim Motz spoke about a lighthouse he would like to build but feels the City of Palacios is preventing his project from moving. forward. Motz claims he now plans to build the lighthouse on a barge ini the bay and has the support of his neighbors and the Army Corps 2. Donna Nyzio, who runs the 6th Street Laundry Mat, asked Council not to pass the final reading of Ordinance No. 2023-0-06 regarding water rate increase. Nyzio asked Council tor review reports she obtained from the City, regarding readings from a data log that was pulled from a bad meter before they passed the ordinance. Steve Wier wanted to state for the record he. supports Mr. Motz lighthouse project, and voiced his concerns regarding his opinion oft the City, not allowing Motz to movef forward with) his plans. PRESENTATIONS: City Manager Update City Manager, Cynthia Raleigh gave many updates regarding ongoing projects ini the City. DISCUSSION. AND ACTION] ITEMS: Minutes Discuss and approve the special meeting minutes of March 18, 2023, regular city council meeting minutes of March 23,2023, and the special meeting minutes of March 30, 2023. Presented by Mayor Gardner. Councilmember Schulman made a motion to accept the minutes of March 18, 2023, as written. Councilmember Samora seconded the motion. 2. Downtown! Revitalization, Project TxCDBG Contract No. CDM21-00451 Bid Acceptance Discuss and select bidder to complete the sidewalk project on Main Street. Presented by Engineer Matt Glaze. Councilmember Woolf made a motion to accept base bid from Staff Concrete Construction. Councilmember Glenns seconded the motion. Passed unanimously. 3. Finall Reading Ordinance. No. 2023-0-061 Increase Water/Wastewater. Rates Discuss and approve final reading of Ordinance No. 2023-0-06 regarding a 15% increase in water and wastewater rates for the citizens of Palacios. Presented. by City Manager, Cynthia Raleigh. Councilmember Glenn stated he) hadi not personally received any comments or concerns from any citizens regarding the increase inj water rates. Coumcilmember Trainor asked) how much more money the City would be receiving. City Manager, Raleigh explained it would be an increase of 15% more than the prior year's revenue. Councilmember Schulman stated she had not personally had any citizens reach outz tol her with concerns or complaints regarding increasing rates, but she did) have concerns about Donna Nyzio's comments about her meter readings and information she provided during Citizen' 's Forum. Raleigh explained the customer: 's meter was bad, was replaced, ando offeredacredit on) her bill. Nyzio claimed from the audience that the City) had ani issue with their sofware and her complaint had nothing to do with the increase in water rates. Raleigh explained to Council the meter was inaccurate. Schulman asked ift the new meters would be more accurate and streamlined, and if the customers would have the capability to. see their daily consumption in real time. Raleigh explained all those things would be possible with the new meters. Maria Ayala explained how a data log is obtained by our sofware. Trainor disagreed with Ayala's explanation. Councilmember Samora also commented that she had not personally received any complaints. from citizens regarding water rates. Councilmember Woolf made a motion to pass thej fnal reading of Ordinance No. 20023-0-06 toi increase water/ wastewater rates by 15%. Councilmember Lewis seconded the motion. City Secretary, polled the votes, showing Comcilmembers Glenn, Woolf Lewis, Samora, Schulman, and Mayor Gardner voting 4. First Reading Ordinance No. 2023-0-02 Jake Brake Prohibiting engine braking within city limits. Presented by Tobie Bias, ChiefofPolice. Bias explainedt the term "Jake Braking" to Council.. Bias also explainedi to Council the needj for an ordinance to prohibitj jake braking came on by citizen complaints. Council discussed costs for signage andj fees associated with tickets issued for jake braking in city limits. Councilmember Glenn made ai motion to accept the frst reading of Ordinance No. 2023-0-02 regarding jake brakes. Councilmember Samora seconded the motion. City Secretary polled the votes, showing Coumcilmembers Glenn, Trainor, Woolf Lewis, Samora, Schulman, and Mayor Gardner voting "Aye,' and First Reading Ordinance No. 2023-0-07 Stop Sign Authorizing the placement of stop signs for northbound and southbound traffic on 4th Street att the intersection of Lucas Ave. making saidi intersection: a 4-way stopi intersection.. Presented by Tobie Bias, ChiefofPolice. Bias explainedi to Council the needj for the stops signs was brought on by citizen' 's complaints. Councilmember Glenn made ai motion to accept thej first reading of Ordinance No. 2023-0- 07. Councilmember Samora seconded the motion. City Secretary polled the votes, showing Councilmembers Glenn, Trainor, Woolf Lewis, Samora, Schulman, and Mayor Gardner TISD Tower Lease Agreement Action approving the updated agreement between the City and TISD for internet towers at Well No. 6 Elevated Tank. Presented by City Manager, Cynthia Raleigh. Raleigh explained to council the extent ofthe agreement with TISDandi the CilyofPalacios, how mucht they will payz monthly, andi the expansion of public wi-fis services to extend along the South Bay Seawall. Councilmember Glenn made a motion to accept the Councilmember Glenn abstained.. Motion carried. "Aye," "and Councilmember Trainor voting "Nay". Motion passed. no councilmember voting "Nay".
