CALLTOORDER Mayor. Jim Gardner called the City Council meeting to order at 6:01PM. CERTIFICATIONOF, AQUORUM Mayor. Jim Gardner certified a quorum was present. Presentations shall be no longer than three (3) minutes. Public hearing was opened at 6:02pm. There were no comments from the public. Public hearing was closed at 6:04pm. ANNOUNCEMENTS: Mayor's Announcements - Mayor Gardner announced information about the Redfish Rodeo, aj fishing tournament t0 take place on October 7, that could bring in potential revenue. for local businesses. Mayor also let the public know flyers were available to the public to learn how to read consumption on their phones for the new meters. Mayor recognized five students from the Youth Matagorda County Leadership Group. Council Members Amouncements - Councilmember Glenn asked the public to come to City Hall if they have real questions and expressed his disagreement with a letter to the editor in the Palacios Beacon. CITIZEN COMMUNICATION FORUM: Joe Monk publicly withdrew his request to speak. Donna Nyzio with 6'h Street Laundry expressed her disagreement with the water and. sewer rates. CITY OF PALACIOS PUBLIC HEARING AND REGULAR CITY COUNCIL MEETING MINUTES- SEPTEMBER 14, 2023 Janie Arroyo pled with Council to help her with the unsafe neighborhood. she resides in. Cindy Raleigh, City Manager, asked to set up a meeting with her to discuss. further at a later time with Code Compliance and the Chiefofl Police. DISCUSSION/ ACTIONI ITEMS Minutes Discuss and approve minutes from the regular City Council meeting of August 24, 2023. Presented by Mayor Gardner. Councilmember Schulman made a motion to approve the minutes of August 24, 2023. Councilmember Glenn secondedi the motion. Motion passed unanimously. 5161 Perryman Consider and take action necessary tor ratify City Manager's Conditional Approval of Encroachment on City Right-of-way. Presented by City Manager, Cynthia Raleigh. Raleigh explained the situation to Council, and how the City planned to resolve the issue. Councilmember Glemi made ai motion to approve the allowance oft the encroachment ont the city right-ofwayat516 Perryman. Councilmember Woolfs seconded the motion. Motion, passed unanimously. 3. First Reading Ordinance No. 2023-0-15. Juvenile Curfew Discuss and approve first reading of Ordinance No. 2023-0-15; an ordinance of the city of Palacios, Texas, amending the Code of Ordinances by repealing any conflicting ordinances; and providing an effective date. Presented. by City Attorney, Anne Marie Odefey. Odefey explained the reason for the ordinance was to comply with state law. Councilmember Glenn made a motion to approve Ordinance No. 2023-0-15. Councilmember Hink seconded the motion. City Secretary polled the votes showing Councilmembers Glenn, Trainor, Woolf Hink, Schulman, and Mayor Gardner voting "yea"; and First Reading Ordinance No. 2023-0-16 Regarding Fences Discuss and approve first reading ofOrdinance No. 2023-0-16 repealing Section 3.13 of the Code of Ordinances for the City of Palacios regarding fences. Special item requested by Mayor Pro Tem Woolf and Councilmember Glenn. Presented. by Mayor Pro Tem Woolf Mayor Pro Tem Woolfdiscussed the reason for his request was to ease the strain of regulations for new businesses coming into town. Woolf further explained fences woulds still be regulated for health ands safety reasons in other areas of the Code of Ordinances. Councilmember Schulman made a motion to approve. first reading of Ordinance No. 2023-0-16. Councilmember Trainor seconded the motion. City Secretary polled the votes showing Councilmembers Glenn, Trainor, Woolf, Hink, Schulman, and Mayor Gardner voting 5. Resolution No. 2023-R-24 Disaster Declaration Related to Drought Discuss and approve Resolution! No. 2023-R-24 declaring disaster for the City of Palacios related to drought conditions. Presented by Mayor Gardner. City Attorney, Odefey explained the declaration to Council. Councilmember Glenni maded ai motioni toa approve Resolution No. 2023-R-24.. Mayor Pro Tem Woolf 6. Resolution No. 2023-R-25 Disaster Declaration Related to Shrimp Dumping Discuss and approve Resolution No. 2023-R-24 declaring disaster for the City of Palacios related to illegal shrimp dumping. Presented. by Mayor Gardner. City Manager, Raleigh explained the reason for the resolution was to show support) for our locals shrimping industry. Councilmember Glenn made amotion to approve Resolution. No. 2023-R-25. Councilmember Hink secondedi the motion. Motion Councilmember Wier being absent. First Reading passed.
