Regular Session 2.A 2023-7-PUD Hope Ranch Public Hearing and possible action on a request for a Zoning Map Amendment to rezone 24.744 acres int the William Roberts Survey, Abstract 524, from the Residential Estate (RE): zoning district to al Planned Unit Development with the base zoning districts of 2.91 acres of the Local Commercial (C-1): zoning district, 8.07 acres oft the Townhomes(TH) zoning district, and 13.76 acres of the High Density Multi-Family (MF-2) zoning district, for the property generally located at 2101 Shell Road. (2023-7-PUD) = Sofia Nelson, Travis Baird, Assistant Planning Director- Current Planning, presented the staff report. Norm Ashby, applicant, approached the podium to address the Commission and spoke on previously approved city projects related to the development request. Ryan Johnson, LSI architect planner, approached the podium to address the Planning Director Commission and provided a presentation. Chair Dickey opened the public hearing. Heath Culp, 383 Logan Ranch Road, approached the podium to address the Commission and shared his concern with transportation due to Shell Road being a two-lane road with no shoulder. Culp noted the concern with transitional uses and mentioned that the community center overlapped his property. Culp highlighted that the community center is designed for medium family density. Culp shared that this request would not provide more housing needed for Georgetown but would add more traffic with the travel required to go the property. Culp mentioned that the impervious cover deviation would increase wastewater run-off into the nearby creek. Culp highlighted that the driveways are required to be separated by 425 feet and believed that the request did not comply. Culp questioned the need for a variance and stated that codes exist for a reason. Culp highlighted that the only criteria that was met was the criteria that mentioned paperwork. Culp believed that the proposition was to make more money instead of the good of the community. Culp concluded with his concern on how Chair Dickey closed the public hearing and asked for a motion from the dais. Moved by Michael L Price; seconded by Mike Tiland to Deny the PUD request. Commissioner Price explained that the criteria that do not comply outweigh the compliant criteria. Additionally, Commissioner Price felt that the feedback provided during the last meeting were not accomplished by the applicant. Commissioner Tiland shared his concern with the density, transition between zoning Commissioner Noble shared that density and traffic on Shell Road was a concern. Commissioner Heintzmann agreed with previous comments and shared that density and deviations from city standards were significant. Commissioner Heintzmann continued to share that she was concerned with traffic on Shell Road. Commissioner Heintzmann noted that feedback from previous meetings were not addressed during Chair Dickey shared that commercial uses underneath the apartments and a community center thought process would have been preferred. Chair Dickey noted that Shell Road would take time to develop and echoed that the density was a concern. Allen, Chere Heintzmann, Michael L Price, Mike Tiland, Stephen F Dickey, Shelley G GI Rodocker Public Hearing and possible action on a request for a Zoning Map Amendment to rezone 0.36 acres out of Block 26 (Lots 3-4), City of Georgetown, from the Residential Single- Family (RS): zoning district to the Office (OF): zoning district, for the property located at 510 S. Church Street, Georgetown, Texas. 2024-11-REZ) = Maddison O'Kelley, Preservation and Redevelopment Manager Maddison O'Kelley presented the staff report. Commissioner Noble inquired about the restrictions for a demolition of the structure on the site. O'Kelley explained that the existing structure is protected as a historic resource, SO a Certificate of Appropriateness would be required for approval ofa demolition and site improvements on the lot would be reviewed by the Historic and Commissioner Heintzmann noted the concern of scope creep and shared the need to balance the neighborhood and transition of improvements to downtown. Peter Verdicchio, applicant, approached the podium to address the Commission and Commissioner Heintzmann asked how parking would be addressed. Verdicchio explained that a 2,000 square foot building with an office use requires up to 7 parking spaces and added that the corner lot would meet that parking requirement. O'Kelley clarified that applications for demolition of historic buildings are required regardless of land use or zoning. Chair Dickey opened the public hearing. Liz Weaver, 1221 South Main Street, approached the podium to address the Commission and shared that the home needs to remain a part oft the neighborhood. Weaver highlighted that the subject property is outside of the transition zone adopted with the Downtown Masterplan. Weaver noted the permanent uses that would not be compatible with adjacent residential properties. Weaver highlighted that the waste, garbage and smells from a nonresidential zoning district would be unpleasant for adjacent neighbors. Weaver highlighted the permitted temporary uses such as transient mobile. or outdoor food vendor and noted that it would not be compatible for neighboring properties. Weaver explained that the Unified Development Code. rewrite notates the possibility of merging the office zoning district with the C1- local commercial zoning district. Weaver shared that merging the two zoning districts would increase the permitted uses. Weaver suggested that the Commission strongly consider denying the request. Weaver highlighted that the applicant mentioned repurposing the house but highlighted that the applicant wants to sell the house; therefore, making the decision on what to do with the house up to the new Julie Faircloth, 504 South Myrtle Street, approached the podium to address the Commission and shared that she owned her property since 1968 and an additional property in the Old Town overlay. Faircloth asked that the Commission deny the rezoning request. Faircloth highlighted that the property is in a residential owner. neighborhood and noted 6 residential homes adjacent toi the property. Faircloth noted that the area is a quiet neighborhood. Faircloth asked that the Commission deny the rezoning request because a potential restaurant would be undesirable. Faircloth concluded with a request to maintain the integrity of downtown. Chair Dickey closed the public hearing and asked for a motion from the dais. Moved by Doug Noble; seconded by Chere Heintzmann to Deny the request. Commissioner Noble shared his concern with the creep in the neighborhood and parking. Commissioner Price shared that living next to the Wish Well House would not be ideal. Commissioner Allen inquired about the restaurant limitation under the office zoning O'Kelley explained that the limitations in the Office district included the following: the gross area cannot exceed 2500 square feet, the eating establishment would need to be secondary and supportive to the primary use, the eating establishment should not bei ina building which contains no other uses, and a drive-thru restaurant would not be permitted. (2024-6-SUP) = Olivia Beams, Historic and Downtown Planner Olivia Beams presented the staff report. Commissioner Allen noted the intended hours of operation for the request and asked if the Planning and Zoning Commission should have concern about compliance with the Texas Alcoholic Beverage Commission requirements with serving alcoholic beverages at a Beams explained that the Unified Development Code does not restrict hours of a bar but noted that the restrictions are found in the Code of Ordinances which are reviewed prior toi issuance of the TABC permit. Beams added that staff did not review hours but explained that the Commission could conditionalize hours if they choose to. Travis Baird, Assistant Planning Director- Current Planning, approached the podium to address the Commission and explained that the TABC regulations on the sale and service of alcohol is not necessarily regarding the hours of operation.
