TOWN OF PLYMOUTH SPECIAL MEETING MINUTES MAY 17, 2024 - VIA COUNCIL CHAMBERS AND ZOOM 7:00 p.m. I. CALL TO ORDER - Mayor Brian Roth Mayor Roth called the special meeting to order under emergency authorization from the State under Public Health and Public Safety for Sanitation and welcomed all attendees. PUBLIC HEALTH/PUBLIC SAFETY - SANITATION Mayor Roth stated that this meeting is a follow-up from previous discussions. He reported that he drove around major sections of the community and that there were massive amounts of garbage in the streets. Mayor Roth further stated that he and Town Hall have received a lot of phone calls from citizens that are not happy. He named several streets that looked as though the garbage had been picked up and several streets where there is still garbage. Mayor Roth then stated that the Town has a public health issue. He recounted what happened in the Fall and how the problem was solved. Mayor Roth repeated that there is a health problem in the streets; however, his biggest concern is the health problem Councilman Wobbleton agreed that it is evident that we have a trash issue, and asked how it can be solved. Councilwoman Teel asked if the solution that was used for the Fall can be used again and deduct it from the Contractor's pay. Attorney Isenberg interjected that the written terms of the contract do not contemplate that as a remedy for a breach. She also stated that she would rather Councilwoman Nixon stated that there was no reason to have an emergency meeting. She also stated that it is not up to the Town to make a back-up plan, but itis up to the Contractor. Counciwoman Nixon stated that is what the in the homes. She warned the Council to be careful sO as not to call for another lawsuit. Counciwoman Nixon also stated that during the Monday night meeting, the Council asked the Contractor to do something about this and that he is doing it. She disagreed with Mayor Roth's statement and reported that she has been riding around the Town as well. Councilwoman Nixon asked if Town Manager Floyd and Public Works Director Wright have been receiving updates. Public Works Director Wright shared with the Council the updated information After a continued enthusiastic discussion, Attorney Isenberg asked for a motion to go into closed session. Councilwoman Nixon stated that she would not go into closed session because there was no reason for it. She instructed the Director of Public Works to check on the Contractor to make sure that he is doing what he is supposed to do, and then the Council can take action. Councilwoman Nixon then asked to be excused from the meeting. Councilwoman Byers made a motion to excuse Councilwoman Nixon from the meeting with a second from Councilman Councilwoman Byers made a motion to go into closed session under $143- 318.11 (a)(1) to prevent the disclosure of information that is privileged or confidential pursuant to the law of this State or of the United States, or not considered a public record within the meaning of Chapter 132 of the General Statues and $143-318.11(a)3) to consult with an attorney employed or retained by the public body in order to preserve the attorney-client privilege between the attorney and the public body, which privilege is hereby acknowledged with a second by Councilman Wobbleton. OPEN SESSION Mayor Roth asked Attorney Isenberg to give a summary as to where the Town is, moving forward. Attorney Isenberg stated that her summary is legal advice that she gave in closed session. She stated that she would defer to Town Manager Floyd to give any summaries. Mayor Roth then asked Town Manager Floyd to give a quick summary of what the Town will be doing going forward. Town Manager Floyd stated that staff will make contact with the Contractor to see ifv we can get some assistance from him to help get caught up on his garbage routes, after which she will give Council an update. IV. ADJOURNMENT There being no further business, a motion to adjourn the meeting was made by Councilwoman Teel with a second by Councilman Wobbleton. The motion passed unanimously.
