MINUTES King City Council Regular Meeting July1 1,2024 The King City Council convened for its regular meeting at the King City Hall, Council Chambers, 229 S. Main St, King., on Monday, July 1, 2024, at 6:00 pm. The purpose of the meeting was to discuss and make decisions on various city matters. Present at the meeting were Mayor Rick McCraw, Mayor ProTem. Jane Cole, Councilwoman Terri Fowler, Counciiman Michael Lane, City-Manager Scott Barrow, City Clerk Nicole Branshaw, City Engineer Ben Marion, Director of Finance and Personnel Susan O'Brien, City Planner Jon Grace, Police Chief Jordan Boyette, Senior Center Director Paula Hall, Interim Water Plant Superintendent Mark Danley, Supervisor of Public Works Ricky Lewis, Superintendent of Public Utilities Chuck Moser, Fire Chief Steven Roberson, Public Works Maintenance Worker Elijah Booe, City Attorney Walter W. Pitt Jr., Chaplain Scott Vernon and Chaplain Rick Hughes. Councilman Tyler Bowles was absent from the meeting. Mayor McCraw called the meeting to order. Chaplain Scott Vernon offered the invocation. Mayor McCraw mentioned the community announcements listed on the agenda. Cole seconded the motion, which was carried by a unanimous vote of 3-0. Councilwoman Fowler moved to excuse Councilman Tyler Bowles from the meeting. Mayor Pro Tem ADJUSTMENTS TO AGENDA Mayor Pro Tem Cole made a motion to table agenda item number #5, CONSIDERATION OF RESOLUTION 2024-11, to set a public hearing at a future. meeting and to add an additional closed session N.C.G.S. 143-318.11 (a)(3) to the end ofthe meeting to consult with the Attorney to protect the attorney-client privilege. Councilman Lane seconded the motion, which was carried by a unanimous vote of 3-0. PUBLICCOMMENT Mayor McCraw opened the floor to receive public comment. REQUEST A PUBLIC HEARING ON TEXT AMENDMENT - City of King's Water Supply PUBLICI HEARING FOR ORDINANCE, AMENDMENT IN CITY OF KING CODE OF ORDINANCES- Chapter Mayor McCraw opened the public hearing for the ordinance amendment in the City of King code of ordinances - Chapter 32, Ordinance # 2024-08 at 6:05 pm. There being no one to give written or verbal requests wishing to speak, Mayor McCraw closed the public hearing at 6:05 pm. The City of King Planning and Inspections Staff is requesting that changes be reviewed and approved to the City of King Code of Ordinances. The affected chapter is Chapter 32-Zoning. 32, with amendments being adopted as Ordinance # 2024-08. Amendments are being adopted as Ordinance #2024-08. Sec 32-433.- Signs permitted by district. Type of sign-Mounted or Applied No greater than 18 in. projection from wall except in B-1 zoning where a 36-inch projection from wall is allowed. Sign shall not exceed above the wall surface. Sec. 32-428. - Prohibited signs. Signs prohibited in all districts are as follows: (6) No private sign shall be erected in the public right-of-way nor project over the public right-of-way. At all intersections, no signs shall interfere with clear sight distance for any driver crossing or entering a roadway. Wall signs shall be permitted to project up to 18 inches, or 36 inches in B-1 zoning, from a building wall over the public right-of-way if such projection is necessary to the installation of the sign. Sec. 32-245. - Residential multifamily apartments (R-MF-A). (a) Apartment means two or more dwelling units in single ownership where the units are rented or leased. The development shall consist of one or more multifamily buildings on a single tract of land and shall have no more than 16 32 units per building. In accordance with the Code of Ordinances, Chapter 32-Zoning, Sec. 32-96, the City of King Planning Board/Board of Adjustment reviewed the foregoing amendments on June 24, 2024. It made a formal recommendation to the City Council. The Planning Board voted unanimously to recommend that the City Council approve Ordinance #2024-08. Motion Mayor Pro Tem Cole made a motion to table Sec. 32-245. - Residential multifamily apartments (R- MF-A) at this time and made a motion to table Sec 32-433. - Signs permitted by district, Sec. 32- 428. - Prohibited signs for a recommendation from the Downtown King Partnership. Councilman Lane seconded the motion, which was carried by a unanimous vote of 3-0. **SEE DOCUMENT WATERSHED REVIEW REQUEST WS-014 for Reaper Holding LLC on 1060 Meadowbrook Drive This tract is located at 1060 Meadowbrook Drive. It is currently vacant and zoned L-I (light industrial). This tract lies within the city's WS-IV watershed and would only allow for a 24% built- upon area with curb and gutter. The developer wishes to utilize the 10/70 provision in our This tract contains 3.43 Acres, which would put it under watershed review. The site, as submitted, would cover 41.05% of the site or 1.41 acres. They are only allowed 24% with curb and gutter, equating to 0.82 acres out of the total 3.43 acres. CONSIDERATION OF RESOLUTION 2024-11 This Resolution is for the City/County Economic Incentive project we have been working on to extend sanitary sewer to the Reaper & Duggins site on Meadowbrook Road. Action The Council's consensus was to table this item and set a public hearing on August 5, 2024, for all INTERLOCAL AGREEMENT REGARDING FIRE PROTECTION AND RESCUE SERVICES WITH FORSYTH Forsyth County has presented a new Interlocal Agreement with the City to provide fire and rescue protection to the county portion of the King Fire District. The current agreement has been in place Manager Barrow and Fire Chief Roberson have reviewed the proposed agreement, as well as our City Attorney Pitt. City Attorney Pitt and Forsyth County Attorney have also discussed and clarified parties to review the incentive agreement again. CO. since July 2019. the intent within this agreement. Fire Chief Roberson provided City Council with the cover letter that outlines the significant changes between the 2019 agreement. Included with this cover letter ist the current Interlocal Agreement, which was not in the agenda packet. All were provided for the Council to review. In the newly proposed Interlocal Agreement item #14 is new language that has been added this year. ** Attaching copy of the cover letter to the minutes, a current copy of the 14.Notwithstanding anything to the contrary herein, the County may choose to pay the City forit its Fire Services fromfunds levied and colectedfromacountywdeservice districttax; rather than from separate funds levied and collected specifically for each individual fire and service district. The change would not be made without a new fire funding plan, which would be developed with input from County staff and representatives of the individual fire departments and governing boards, and adopted by the County Board of Commissioners. If the County makes such a change, the County Board of Commissioners will determine, as a part of its annual budget, the amount of funds collected from such countywide service district that is to be distributed to the City. In the event the County adopts countywide service district funding as the sole source off funding for the City's Fire Services, the Department may terminate this Agreement by providing the County with 90 days' notice if the level of funding provided to the Department is less than the amount provided in the prior year in which the District Tax was used to fund the 2019 Interlocal Agreement is already on file in Clerk's office ** City's Fire Services. Municipalities are to adopt street closure guidelines for special events per NC DOT requirements. West Stokes High School contacted the City Clerk, Nicole Branshaw, to inform the City that the WEST. STOKES HIGH. SCHOOL HOMECOMING PARADE: Friday, October 4, 2024, 4:00 p.m. - 5:00 Staff recommends approval of amended Ordinance 2024-02.02 as prepared by Clerk Nicole Branshaw regarding the special events City Council has previously agreed to co-sponsor for 2024 p.m.; Route Description: Dalton Road from West School Street to White Road with the updated West Stokes Homecoming Parade date of October 4, 2024. Motion Mayor Pro Tem Cole moved to approve the amended Ordinance 2024-02.02 with the updated West Stokes Homecoming Parade date of October 4, 2024. Councilwoman Fowler seconded the "Councilman Lane asked the City Clerk the reason why the King Christmas Parade time was changed, stating that he had heard from a few Downtown businesses and restaurants that had concerns that the parade time would affect the business hours for downtown. From as far as staff could remember, King Masonic Lodge requested the time change from 2 pm to 12 pm due to several parade participants wanting to participate in the Pinnacle parade that started that same day, usually around 5 pm, sO changing King's parade hours from 2 pm to 12 pm would allow time motion, which was carried by a unanimous vote of 3-0. **SEE DOCUMENT #4** fori families to attend or participate in both. It was the consensus of the Council to ask Larry Bridges with the Masonic Lodge to attend the next Council meeting to discuss the Parade with the Council. Central Park does not allow bicycles within the park. This rule is posted on the rules at Central Park and is in place for the safety of all citizens using the parks. With new technologies worldwide, electric bicycles are becoming more popular. The signage does not state that electric bicycles are On June 13+h, 2024, the Parks and Recreation Advisory Board held its monthly meeting and discussed electric bike use in city-maintained parks. If electric bikes are not allowed, signage throughout the park would need to be changed to notify citizens about the change. Electric bikes pose more of a safety threat than normal bicycles and are a nuisance to citizens enjoying the parks. The budgetary impact would be the Cost of signs, which can be absorbed in FY 24-25 Parks and The Parks and Recreation Advisory Board voted unanimously not to allow electric bikes in both parks. Staff would recommend following the Parks and Recreation Advisory Board's recommendation to not allow electric bikes in either of the city-maintained parks. Bicycles are still ELECTRIC BICYCLES AT CENTRAL PARK. AND RECREATION ACRES not allowed in either park. Bicycles are allowed at Recreation Acres Park. Recreation's normal operating budget. not permitted in Central Park but are permitted at Recreation Acres. MOTION Councilman Lane moved to approve not allowing electric bikes in either of the city-maintained parks, with a new rule being added to signage. Mayor Pro Tem Cole seconded the motion, which was carried unanimously, 3-0. SURPLUS AUCTION ON GOVDEALS.COM AC City auction is held when surplus items have accumulated in a quantity that warrants holding an NCGS 160-270(c) authorizes the city to advertise electronic auctions only through electronic means.
