Kiker received timber sale bids on referenced property on January 6, 2016. Two bids were received with the highest bid in lump sum amount at $136,526.00 from DeBerry Land & Timber Inc. of Troy, NC. Background: A new commercial development (grocery store) is proposed for the property located at 705 US Hwy 74 Bus. E. which is immediately adjacent to Aldi and directly across from the entrance to Falling Creek Plaza (Walmart). During the process of preparing title work for the subject property, a subdivision plat recorded in 1998 was discovered that created a 50-foot wide public right-of-way through the property labeled on the plat as "Draper Drive". Obviously, no street was ever constructed; however the right-of- way was officially offered for public dedication via the recordation of the subdivision plat. The current property owner wants to withdraw the offer of public dedication, sO the proposed new development can move forward. The City Council must consent to the withdrawal of dedication. A resolution regarding the proposed withdrawal of dedication was prepared for the City Council's consideration by Alden Webb on behalf of the property owner and the proposed developer. Staff Comments: Board's review. 1. A copy of the proposed resolution and subdivision plat are included in the agenda packet for the 2. The plat should never have been approved by City staff, because it is contrary to requirements set forth in the City's UDO - then and now. Subdivision plats involving the dedication of a public right- of-way cannot be approved until the street construction is completed; or a financial guarantee is deposited with the City ensuring the completion of the street. The plat was approved during a period when no planning staff was employed by the City. Staff Recommendation: the resolution as requested. City staff recommends the Board review the proposed resolution and recommend the City Council adopt Planning Board Recommendation: Council adopt the resolution. The Planning Board reviewed the request on January 5, 2016 and recommended unanimously the City 9- RESOLUTION REGARDING PROPOSED WITHDRAWAL OF DEDICATION OF THE WHEREAS, Richmond Hospitality, LLC has submitted to the City of Rockingham a proposed Withdrawal of Dedication regarding an unopened right-of-way depicted as Draper Drive on a survey plat attached hereto as Exhibit A and described in Plat Slide 663-J recorded in the Richmond County Public WHEREAS, pursuant to G.S. 136-95, the Property Owners have requested that the Rockingham City Council adopt a resolution indicating that the dedicated right-of-way described in the proposed NOW, THEREFORE BE IT RESOLVED, by the Rockingham City Council that the street depicted as Draper Drive on Exhibit A attached hereto in not part of a street plan adopted under G.S. 136.66.2.
