Background: Request for Right-of-way Abandonment: Phil Patterson has requested the abandonment of the 60-foot wide right-of-way located between River Road and US Highway 220 adjacent to property at 215 River On May 3, 2022, Phil Patterson submitted a written request for the City Council to abandon the 60-foot wide right-of-way located between River Road and US Highway 220 adjacent to property at 215 River Road. The right-of-way is a remnant portion of the River Road right-of-way left over from the realignment of River Road with Midway Road during the construction of the interchange of US Highway 220 with Midway Road. The right-of-way is 60 feet in width and approximately 200 feet in length. Staff Comments: agenda packet. 1. A map illustrating the location of the right-of-way requested for abandonment is included in the 2. The subject right-of-way is a former NCDOT right-of-way. As indicated by the email correspondence from Matthew Kitchen, NCDOT District Engineer, included in the agenda packet, NCDOT officially abandoned maintenance of the right-of-way and has no interest in the property. Pursuant to NCGS 160A-299, the City Council must take action to officially close and abandon the right-of-way. This action is required by City Council even for those rights-of-way abandoned by NCDOT. 3. Pursuant to NCGS 160A-299, the right-of-way would be divided equally between all adjoining property owners if abandoned by the City Council. Staff Recommendation: of-way as requested. City staff recommends the Board review the request and recommend the City Council abandon the right- Planning Board Recommendation: The Planning Board reviewed the request at their June 7, 2022 meeting and recommended unanimously the City Council abandon the subject right-of-way as requested. 14 RESOLUTION OF INTENT AF RESOLUTION DECLARING THE: INTENTION OF THE ROCKINGHAM CITY COUNCILTO CONSIDER THE ABANDONMENT OF THE UNIMPROVED 60-FOOT WIDE RIGHT-OF-WAY LOCATED BETWEEN RIVER ROAD AND US HIGHWAY 220 ADJACENT TO PROPERTY AT215 WHEREAS, the City Council of Rockingham has received a written request from an adjacent property owner to abandon the unimproved 60-foot wide right-of-way located between River Road and WHEREAS, the Planning and Zoning Board reviewed the request and recommended unanimously to the City Council the abandonment of the unimproved 60-foot wide right-of-way located between River Road and US Highway 220 adjacent to property at 215 River Road; and WHEREAS, the NCDOT officially abandoned maintenance of the subject right-of-way and has WHEREAS, North Carolina General Statue 160A-299 authorizes the City Council to close public WHEREAS, the Rockingham City Council considers it is advisable to conduct a public hearing for the purpose of giving consideration to abandon the unimproved 60-foot wide right-of-way located RIVER ROAD US Highway 220 adjacent to property at 215 River Road; and provided written documentation of such; and streets and alleys; and between River Road and US Highway 220 adjacent to property at 215 River Road. Massey, Jr., Assistant City Manager Date: June 2, 2022 Re: Demolition Ordinance for Dilapidated Dwelling located at 211 S. Brookwood Avenue City staff recommends the City Council approve a demolition ordinance for the dilapidated dwelling located at 211 S. Brookwood Avenue and identified as Richmond County PIN 7473-14-33-7921. A copy of the demolition ordinance and photographs of the property are included in the agenda packet. As background information, City staff initiated minimum housing proceedings in February of 2022. The property owner, Johnnie Thomas, and parties of interest were notified of a hearing with the Code Enforcement Officer regarding the condition of the dwelling. The notice was sent via certified and regular mail; published in the Richmond County Daily Journal; and posted on the subject property. No one attended the hearing with the Code Enforcement Officer. The Code Enforcement Officer issued his findings of fact and directed the property owners to either repair or demolish the dwelling by May 31, 2022. Again, the notice was sent via certified and regular mail; published in the Richmond County Daily Journal; and posted on the subject property. WHEREAS, the City Council of the City of Rockingham finds that the dwelling described herein is unfit for human habitation under the City Housing Code, and that all the procedures of the Housing Code WHEREAS, this dwelling should be removed or demolished, as directed by the Building Inspector, and: should be placarded by placing thereon a notice prohibiting use for human habitation; and WHEREAS, the owner of this dwelling, Johnnie Thomas, has been given a reasonable opportunity to bring the dwelling up to the standards of the Housing Code in accordance with G.S. 160D- 1203 pursuant to an order issued by the Building Inspector on March 2, 2022 and the owner has failed to NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Rockingham, that: have been complied with; and comply with the order; Section 1. The lien shall be filed in the office of the City Tax Collector and City Clerk, and shall have the same priority and be collected in the: same manner as the lien for special assessments in Article 10 of G.S. Chapter (b) Upon completion of the required removal or demolition, the Building Inspector shall sell the materials of the dwelling and credit the proceeds against the cost of removal or demolition. The Building Inspector shall certify the remaining balance to the Tax Collector. If a surplus remains after sale of the materials and satisfaction of the cost of removal or demolition, the Building Inspector shall deposit the surplus in the Superior Court where it shall be secured and disbursed County PIN# 7473-14-33-7921. Section 2. and G.S. 160D-1203. Section 3. (a) The cost of removal or demolition shall constitute a lien against the real property 160A. int the manner provided by G.S 160D-1203. 17 Section 4. June 30, 2021,the City of Rockingham budgeted for a project to be funded by the Coronavirus State and Local Fiscal Recovery Funds of H.R. 1319 American Rescue Plan Act of 2021 (CSLFRF) in the amount of $2,530,0001 through the adoption ofa Grant Project Ordinance. These funds may be used for the following categories ofe expenditures, to the extent authorized bys state law: 1. Support public health expenditures, by funding COVID-19 mitigation efforts, medical expenses, behavioral healthcare, and certain public health and safety staff; 2. Address negative economic impacts caused by the public health emergency, including economic harms to workers, households, small businesses, impacted industries, and the 3. Replace lost public sector revenue, using this funding to provide government services to the extent of the reduction inr revenue growth experienced due to the pandemic; 4. Provide premium pay for essential workers, offering additional support to those who have borne and will bear the greatest health risks because of their service in critical infrastructure 5. Invest in water, sewer, and broadband infrastructure, making necessary investments to improve access to clean drinking water, support vital wastewater and stormwater public sector; sectors;and infrastructure, and to expand access to broadband internet. TAXES LEVIED. There is hereby levied the Ad Valorem tax rate of $.58 per $100 valuation of taxable property, as listed for taxes as of January 1, 2022, for the purpose of raising revenues to finance the foregoing appropriations. This tax rate is based upon an estimated total valuation of $694,453,368 (624,918,280 property and 69,535,088 auto) and an estimated collection of 99.36% for property and collection rate of Auto Tax in accordance with Statutory Authority. SECTION 4. SPECIAL AUTHORIZATION. The Budget Officer shall be authorized to reallocate departmental appropriations among the various line item expenditures of the department as said officer believes necessary. The Budget Officer shall be authorized to effect interdepartmental transfers, in the same fund, provided that no departmental budget shall be reduced by more than ten percent without the prior approval of the City Council. Any such transfers shall be reported to the City Council at its next regular meeting and shall be entered into the minutes. 30 Budget Ordinance 2022-2023 Page 6 SECTION 6. DISTRIBUTION. Copies of this Ordinance shall be furnished to the Finance Officer of the City of Rockingham to be kept by her for her direction in the disbursement of funds.
