DEPARTMENT OF AGRICULTURE AND MARKETS ARTICLE 10 ISSUE STATEMENT BACKGROUND On or about September 18, 2018, Bluestone Wind, LLC filed an application seeking authorization to construct and operate a commercial scale 124-megawatt wind energy project located within the Towns of Sanford and Windsor in Broome County. Following a Procedural Conference held on February 20, 2019, a Ruling on Schedule was issued by hearing examiner on March 7, 2019 setting forth dates for events through evidentiary hearing. Pursuant to said Ruling each party is required to submit a Written Statement of Issues setting forth the Article 10 issues it proses to litigate. ARTICLE 10 ISSUES DAM hereby submits that, at this time, there are no issues that are subject to litigation.
