Development Services Director Chancey stated at ap previous commission meeting, construction noise was discussed. A motion was made to redraft the construction noise ordinance with no restriction on work hours Monday through Saturday and having no commercial construction allowed on Sundays, with provision for emergencies such as natural disasters. At thep previous meeting, Attorney Landt wasi instructed to research Florida Statutes regarding construction on Sundays. Attorney Landt stated in 1949 the United States Supreme Court recognized the right of citizens tol be free of unreasonable noise. He also stated that it was left to individual municipalities tor make the decision and in Florida, therei ist nos statute that prohibits municipalities from prohibiting noise on certain days. 11/07/2023 Commission! Motion made by Commissioner Goldman to approve, Ord 2023-17 Construction Noise on Final Reading, Title Only with amendments to delete section 38-47 Subparagraph 1 and insert "clearly audible"i in the definition of section 38-46 subparagraph A; Seconded by Commissioner Smith. Resolution 23-14, Authorizing FDEP SRF Loan - WW42076 Mayor Dobkowski read Resolution 23-14, Authorizing FDEP SRF Loan WW42076, Title Only. Mark Brewer of Angie Brewer & Associates came forward and gave and overview of the process for the FDEP Statel Revolving Loanl Fund Program and discussed grant andl loan funding for the Motion made by Commissioner Goldman to approve Res. 23-14, Authorizing the DEP SRF Loan Agreement for the construction oft the Water Reclamation Facility Expansion Project; Seconded by Motion was called by at roll call vote.. Ayes: Livsey, Smith. Goldman, Dwyer, Dobkowski SCHEDULED AUDIENCE: Sue Mosley - Belleview Christmas Parade expansion oft the City's Sewer Treatment Plant. Commissioner Dwyer. Sue Mosley came forward and provided an update ont the Belleview Parade, which is scheduled for December 3rd. Ms. Mosley stated there were more entrants than last year, and shel has volunteers from the Ocala Parade, but she was still raising money for the insurance requirements and she would need an extension for submittal of the policy. Ms. Mosley requested approval of the date that Motion made by Commissioner Goldman to approve the request tol hold the Belleview Christmas Parade on Sunday, December 3rd, and instruct the Police Department to coordinate the road Motion was called by a roll call vote. Administrator: Updates Administrator McKamey stated the Attorney was making minor modifications to the Community Center Rental Agreement to accommodate the MCSB using the facility for after-school tutoring. While the rentals fees are waived in the code, the revised agreement also waived the deposit with accommodations and addressed other issues such as stipulating no alcoholic beverages on the premises. Attorney Landt stated these were necessary and the agreement could be used asa Administrator McKamey reminded the Commissioners to register for the upcoming Cyber Security Training at the MCI Emergency Management Center ift they were interested in attending. Administrator McKamey recommended canceling the November 21, 2023 and January 2, 2024 template for future similar circumstances.
