Public Works Director Titterington stated the City Code ofOrdinances, Subsection 86-82(1)0)-(4), provides for an automatic adjustment ofthe System Development Charges based on the utility construction index as published in the "Engineering News Record, Twenty Cities Construction Cost Index". Harvey Vandeven Harvey Vandeven came forward to discuss the placement of billboards on 132nd on the extension on CR 484. He owns an industrial/commercial park there and would like to consideri including two Development Services Director Chancey stated that when our ordinance was created those roads were not annexed in 2014. Her recommendation is to adjust the code to allow placement of billboards and add them to the roads approved for billboard placement. billboards. Jaideep Cherelela, concerning 5272 SE 120th St (38525-001-00) and 12006 SE HWY 484 (38525-001-01) Development Services Director Chancey stated the subject properties are owned by Sean D. Carpenter, who previously owned and operated Top Tech of Belleview located at 12006 SE HWY 484. According to City Code, a request for lien forgiveness can be presented to the Code Enforcement Special Magistrate for a recommendation to the Commission based on the following factors from Section 2-233 (b)(3): a. The gravity oft the violation; b.Any actions taken by the violator to correct the violation; c. The length of time taken to correct the violation; d. The cost of repair or corrective actions; and e.Any previous violations committed by the violator. The Special Magistrate heard the request for lien forgiveness at the January 9th Code Compliance There is at total of 13 code enforcement liens between both parcels and both parcels are in foreclosure proceedings initiated by the City of Belleview. Mr. Carpenter has not contacted the City concerning either property since the fire at Top Tech of Belleview in 2021. UNSCHEDULED AUDIENCE: Dana Bielke came forward to discuss a noise complaint that she continues tol have with two businesses that her property backs up to, Opus Bar and Tropical Café. Commissioner Smith stated that he would like the City to find a resolution to this. Sharon Shanks came forward and also spoke about the noise level coming from the same establishments. She also complained about the speed at which people drive on C-25 currently. Mayor Dobkowski stated that iti is a delicate balance between the business and the residential zones, ChiefHolland suggested incorporating this issue into our nuisance ordinance. In other municipalities when a business gets enough calls, they become a nuisance, and the business could Attorney Landt stated that what Mrs. Bielke stated is true and the Supreme Court did state that people do have the right tol have quiet enjoyment oft their home. However, the problem is these two establishments are properly zoned for the business they are conducting and have done business fora long time with no interference from the City. He also stated even though they have beeni in business Attorney Landt suggested that the City staff and himselfhave a meeting regarding this issue to Mayor Dobkowski stated due to the holidays and sickness among employees, staff was not able to meet on this since the last meeting and that it will be discussed before the next meeting. Michael Bielke came forward and stated that they are not looking to have these businesses shut down as he feels they have ai right to operate. What they are looking for help on noise protection from the business owners. Public Works: Award of Wastewater Facility Hurricane Shutters Public Works Director Titterington stated the Public Works department solicited bids for Hurricane Shutters for the Wastewater Treatment Facility, Project No. 4486-003-R. This project is funded through the Hazard Mitigation Grant Program through FEMA, which granted us $21,294.90 where the city will match funds up to the total project cost of $30,000. The city received one bid per the attached bid tabulation. It is recommended to award the bid to Presco South Construction. This purchase is funded through the Hazard Mitigation Grant Program through FEMA, which granted us $147,501 where the city must meet a 10% match to that cost. The city received three (3) bids per the attached bid tabulation. While there is a lowerbid, it did not comply with the City's request for bids. Therefore, he recommended awarding Cummins Sales & Service in the amount of$156,607. Public' Works: Unbudgeted Splash Pad Maintenance D Public Works Director Titterington stated the Public Works Department provides annual maintenance on the Lake Lillian Splash Pad each year. Upon inspection this year it was determined that the splash pad surface has deteriorated to a point that someone could be injured (cut) by the pitted-out surface. The City has been working with Softroc, a company experienced in splash park maintenance throughout the state. Softroc has estimated it will cost approximately $29,595 to Public Works Director Titterington stated this is specialized work and would like to move forward scope of work includes resurfacing the pad itself, adding padding to the walkway just complete the maintenance on the splash pad surface. this out the bid process. Public Works Director Titterington stated once the Administrator McKamey reported that a city truck was hit while at a stop light and was totaled. The Administrator McKamey also reported there was no reported damage as a result of the. January testing is completed they will remove the well.
