Angela CCO Ellington presented the cases to the Special Magistrate as one timeline as the properties have the same property owner and are located immediately next to each other. Ms. Angela Dempsey spoke on her own behalf. EN23-0067: Based upon the testimony, case documentation, and discussion, the Special Magistrate found that Angela Dempsey, owner of property located at 5130 SE 112th Street Rd, Belleview, Florida (Parcel ID# 38507-001-01) violated the following City of Belleview Code of ordinances, as referenced in the findings of fact: Article II Sec 38-32 Numbers 2 and 3 Article II Chapter 82-34 The Special Magistrate ordered the following corrective action: 1. Assess ai minimum Code Compliance fee of$350 for City expenses (staff time, Supplies, and vehicle use) incurred ini this case plus attorney fees for this hearing. 2. Properly remove all discarded appliances, furniture, household trash, metals, junk, and debris from property. Properly register, store, or remove all dismantled wrecked, derelict, or abandoned vehicles. All violations to be corrected by March 12, 2024. 3. Af fine of $250.00 per day will be assessed starting March 13, 2024 ifviolations are not 4. Based upon the testimony, case documentation, and discussion, the Special Magistrate finds that Marilyn David, owner of property located at 6556 SE 107th PL, Belleview, Florida (Parcel ID# 3796-002-004) violated the following City of Belleview Code of Ordinances, as referenced in the findings of fact: Article II Sec 38-32 Numbers 1,2,3, and 4 The Special Magistrate ordered the following corrective action: 1. Assess a minimum Code Enforcement fee of$350.00 for City expenses (staff time, supplies, and vehicle use) incurred in this case plus attorney fees for this hearing. 2. Obtain necessary permit(s) and remove mobile home. Remove all rubbish, refuse, junk and other abandoned material. Cut and maintain grass and vegetation at a height less than 12-inces from the ground. All violations to be corrected by March 12, 2024. 3. A fine of $250.00 per day will be assessed starting March 13, 2024 ifviolations are not corrected. 4. Ifthe property is not maintained as required per code by City of Belleview Code of Ordinances, staffis directed to request funds from the City Commission on behalfo ofthe Special Magistrate to correct all violations. Based upon the testimony, case documentation, and discussion, the Special Magistrate finds that Joyce M Gibson, owner of property located at 6411 SE 112th Street, Belleview, Florida (Parcel ID# 3871-004-001) violated the following City ofBelleview Code of Ordinances, as referenced in the findings of fact: Article II Sec 38-32 Numbers 1 and 3 The Special Magistrate ordered the following corrective action: 1. Assess a minimum Code Enforcement fee of $350.00 for City expenses (stafftime, supplies, and vehicle use) incurred in this case plus attorney fees for this hearing. 2. Case # EN23-0098: Contreras Giovanna Loyold, Belleview Mi Pueblo Ms. O'Neill notified the Special magistrate that Ms. Contreras has paid her Code fee and no further complaints have been received.
