He: also asked fora al Noise Ordinance. 3/05/2024 Commission Meeting Page 1of5 ChiefHolland stated that no one on city staffi informed the bar owner of the scheduled decibel ChiefHolland presented information regarding decibel levels taken for two weeks. After discussion at the February 20th meeting, his officers were instructed to take decibel readings from 10PMto2 AM: from a downloaded decibel reading app on the cell phones. Noise levels were to be checked at 41 locations around the bar. During this period 316 readings were taken with the highest reading of 74.1.The average reading for the two weeks was 56.4. It was noted by an officer that the thump of Commissioner Goldman asked the attorney to research another avenue to help regarding bass rather Attorney Landt stated that hel has not researched bass vibration but has researched decibel levels or audible levels. He feels that the sound barrier is the most practical solution and feels it will help alleviate the issue oft the bass vibration. He further suggested that the code be amended for the future shielding of residential areas from commercial areas with sound barriers. ChiefHolland stated that a noise ordinance would have to bel handled by Code Enforcement and is Commissioner Livsey stated that he feels the citizens may need toj pursue their own litigation. Administrator McKamey stated at the February 20th meeting staff presented the Commission with information regarding increased buffer requirements and the City of Ocala's s process for allowing bars into certain zoning and areas for discussion for the future. Unfortunately, this situation is unique due to the fact this business has been there for a very long time and was there before the Commissioner Goldman stated he feels drafting an ordinance that would be difficult to enforce in court is not the direction the City should go and that staff should reach out to the property owner and begin the sound barrier process with the previously discussed bamboo. Commissioner Goldman also stated that the City should begin the process of setting funds aside to mitigate further issues Public Works Director Titterington stated that he has corresponded with a bamboo farm for guidance on how to plant and create a barrier. Development Services: 484 Holdings Business Park Phase I Preliminary Plat Development Services Director Chancey stated 484 Holdings Business Park is a commercial park located on SE 132nd Street Rd. Nash Plumbing and Mechanical is part ofthis development and has already begun construction. No variances have been requested. Attorney Landt has reviewed the preliminary plat. The Developer's Agreement was approved in February 2023. Administrator: Updates Administrator McKamey stated that the city is waiting on DEP paperwork for the Water Reclamation Project and we will be soliciting qualified bidders' cost estimates. She also reported on the bills being voted on at the legislative level. Administrator McKamey also attended the Special Magistrate hearing and was impressed with the Magistrate as well as the staff. She suggested reviewing the fees associated with this process. Commissioner Dwyer suggested using case restitution forms to bill back the fees to the filer. She also stated that the City has received an amendment to extend the ongoing water project through February 2025. COMMIESIONUPDATI: Commissioner Dwyer stated that he met with Jim Couillard of Marion County and that although there is $200,000 earmarked for the redesign of the park there are currently no funds earmarked for the construction. He is disappointed and will be setting up a meeting with league officials and Commissioner Goldman inquired about contacting the DOT regarding median maintenance and the new median placement and constriction which he feels is poorly placed and constructed.
