prated Meeting Minutes Tuesday May 18, 2021 Belleair Bluffs Town of Belleair Shore Regular Meeting of the Board of Commissioners Regular Meeting of the Board of Commissioners PRESENT: Mayor Schmidt, Vice Mayor Roseman, Commissioner Tolbert, Commissioner Blume, Commissioner Niewiarowski, entered 6:30pm, Attorney Regina Kardash, Cpl. Krlin Roll Call: 6:00 pm Call to order by Mayor Schmidt Approval of Agenda: voice vote was unanimous. No comments. Itv was moved by Commissioner Tolbert and seconded by Commissioner Blume to approve the agenda. The Comments from the public on any agenda item: Approval of Meeting Minutes April 20, 2021 Tabled for June 15, 2021 meeting. Sheriff's Report April 2021 statics reported by Cpl. Krlin. No arrests. 216 events. Direct patrols 142, illegally parked 45, house checks 14. Ordinance violations were 9. Went up from 2 from last month. All were warnings. (5 umbrellas, 1 noise, 2 dogs, 1 miscellaneous incident report). No citations for ordinance violations. 23 citations issued (parking tickets). Commissioner Blume thanked for information and questioned what County status of when we will begin giving tickets for ordinance violations. Counsel Kardash stepped in to advise Commissioner Blume that she had a meeting with Captain Leiner and Deputy Doherty last month to update our Code Enforcement ordinance to allow for an administrative civil citation that will be implemented later on. Once this new ordinance is implemented our code enforcement process will be changed. At this time, the Town implements a system that adopts a county system that no longer exists. Counsel and Cpl. further explained to Commissioner Blume. Commissioner Blume gave his interpretation and thoughts on the umbrella ordinance. Treasurer's Report and Approval of Expenditures Clerk/Treasurer, Barb Colucci went over balance sheet and P&L from March and April 2021. March 2021 expenditures: Regions Bank Svc Chg $30.40, Clerk/Treasurer salary $896.50, FLLeague of Cities Annual Dues $520.00, Persson & Cohen $1760.00, Waste Services $1077.75, Duke Energy $246.36, PCSO: $2924.00, PCSO Code Enforcement $35.91, Verizon $68.904. It was moved by Vice Mayor Roseman and seconded by Commissioner Tolbert to approve both the treasurers report and expenditures. The voice vote was unanimous. April 2021 expenditures: Regions Bank Svc Chg $30.32, Clerk/Treasurer Salary $896.50, Waste Svcs $1077.75, PCSO $2924.00, US Treasury $540.00, Duke Energy $246.52, Fast Signs $137.26, Verizon $58.97, PCSO Code Enforcement $35.91, Persson & Cohen $1800.00. Commissioner Tolbert questioned our legal services from our profit and loss. What portion is for litigation counsel? Counsel noted she is not lead litigation but providing support services. Commissioner Blume questioned if we would be re-imbursed by Belleair Beach in the end. Counsel explained that our interlocal provides for any litigation and noted that Belleair Beach is not part oft this litigation. Itv was explained that our litigation Counsel is responsible for pursuing the fees etc, but that she cannot speak to when and how he would do that. Counsel Kardash continued explanations. Counsel noted that ift the Commission wanted more information, that she would request another shade meeting with litigation Counsel Scarritt. It was moved by Commissioner Tolbert and seconded by Vice Mayor Roseman to approve the expenditures. The voice vote was unanimous. Local Options Gas Tax Interlocal Counsel Kardash explained the additional Fuel tax approved by Pinellas County and discussion was had by Commission. The voice vote was unanimous to be a part oft the interlocal. Commissioner Blume had questions also regarding Penny for Pinellas money and ift this was part of this. All explained by Mayor and Counsel. Itwas moved by Commissioner Tolbert and seconded by Vice Mayor Roseman to approve the interlocal to be a part Town Counsel and Mayor continued to explain Penny for Pinellas dollars to Commissioner Blume. Counsel noted that the Town has seawall structure that was done in the 80's and that we would be able to apply for that oft the new LOFTt tax. The voice vote was unanimous. in the future. Flood Code Update Counsel explained flood code amendments and changes to our ordinances. Counsel noted that there are some issues that FEMA will be implementing in August. The Town's pending new ordinance has been approved and she will bring it forward to Commission when finalized. When the final approval is received, the Town will have toa approve the Ordinance in 31 meetings. The Commission willl have to review the ordinance as our 'local planning agency', then we will have to approve in 2 general meetings. The Town will also have to adhere to specific advertising requirements because this ordinance would be part of the Town's land development code. Commissioner Blume questioned Counsel on the dates happening from FEMA. Counsel Comments To be signed by Mayor Miscellaneous Qualification letter received after being approved at Auditor Selection Committee and presented to Commission. Mayor mentioned that he attended a Mayor's Council meeting where County Building inspectors were mentioned. He noted that the County inspectors are not insured. Counsel noted that if the Town wanted to use a private firm for inspection, it would be at a significant cost and the Town does not have the internal resources tol handle that. Old Business Draft AFR 2019/2020 presented to Commission. It was moved to approve the AFR by Vice Mayor Roseman and seconded by Commissioner Blume. The voice vote was unanimous. Emergency Management Contact - it was decided by Commission on order of contact. Preliminary TRIM Calendar -presented and explained to Commission. 2 Availability of Commissioners June 15, 2021 Mayor Blume Roseman Tolbert Niewiarowski Yes Yes Yes Yes Yes Mayor/Commissioner comments on non-agenda items: Commissioner Blume questioned new parking signs and questioned Cpl. Krlin on whether or not the gates are being closed according to the new signs. Commissioner Blume asked if there has ever been a discussion on locking the gates. Mayor noted that the gates have never been locked in his time living in Belleair Shore. Commission noted that there is more activity now and people are shining flashlights in resident homes. Mayor noted that all municipalities will not be allowing e-bikes on the beach. Mayor also noted that the County is having a contest on the design of the new Howard Frankland bridge and anyone can vote on the design. Commissioner Blume brought up the parking passes at 19th and 12th street access with NFL Films and ESPN using 1700 Gulf Blvd (Mr. Mallah) for a Tom Brady Charles Woodson interview. Commissioner Blume noted that the Belleair Beach Mayor was at the accesses taking pictures of the accesses and of him personally. Commissioner noted that the Belleair Beach Mayor was in everybody's face and causing a disturbance. Commissioner Blume requested that the clerk let him know if something like that will be happening in the future. Mayor says that is okay for clerk to do that. Mayor noted that he called Counsel to make sure that we would be able to provide the permits and the Town is able to do this per Counsel. Public comments on non-agenda items: None.
