AN EFFECTIVE DATE. a. Open the Public Hearing 6:07pm Counsel noted that there is a blank for a filing fee for Special Magistrate review. Fee has been seen anywhere from $100.001 to $1000.00. Filing fee is paid by the person who has the fine against them and wants to appeal the amount of the fine. No Public Comments. b. Close the Public Hearing 6:11pm It was moved by Commissioner Tolbert and seconded by Commissioner Niewiarowski to adopt Ordinance 2021- 02 and add a $250.00 filing fee. The voice vote was unanimous. PCSO Law and Code Enforcement Contract FY 21-22 Contract was presented to Commission and discussed. It was moved by Commissioner Tolbert and seconded by Commissioner Niewiarowski to approve our law enforcement and code enforcement contract. Counsel Report Counsel Kardash spoke on Interlocal with PC Building Services. Counsel looked at old agreement and our interlocal needs to be revised. Counsel will be checking with Pinellas County on what our Town website needs to do, if anything, to coincide with the County and new statutes. Counsel discussed Special Magistrate conflict with a dual office holding violation. She has not been able to get a new applicant yet, but will be looking outside the County for a new applicant. The qualifications of new Magistrate are written in our new ordinance. History regarding seawalls was spoken of regarding the Cares Act money that can be used for infrastructure improvement. Also spoke about future Penny money may be able to be used for our seawall infrastructure. Existing seawall report was written in 1996. Advice was to start with an inspection. Noted there is a statewide grant for seawalls related to sea level rise. Research also BRIC and FMA grants to find the county and state people that are working on something similar and piggy back off of a higher tier. Mayor noted that Penny money at this time is slated for the Gulf Blvd undergrounding work. Lynn Rives explained where the municipalities stand int the undergrounding work.
