Sweich, Deputy Paul Dean 6:00 pm Call to order by Mayor Schmidt Consideration to Approve Agenda: agenda. The voice vote was unanimous. Comments from the public on any agenda item: There were no comments from the public on the agenda. Approval of Minutes September 7 and September 20, 2021 Itwas moved by Commissioner Tolbert and seconded by Commissioner Blume to approve the Itwas moved by Commissioner Blume and seconded by Vice Mayor Roseman to approve the Minutes from the September 7 and September 20, 2021. The voice vote was unanimous. Sheriff's Report Sgt. Sweich reported statistics for September 2021. 1 battery reported, simple battery. 196 events reported for directed patrols and parking enforcement. FLC/Eryn Russell Years of Svc Award Ms. Russell was not present at the meeting. Treasurers Report Clerk/Treasurer, Barb Colucci went over balance sheet and P&L. September 2021 expenditures: Regions Bank Svc Chg $31.00, Clerk/Treasurer Salary $896.50, Staples $149.79 correct black toner, Bentley Law Firm $263.25, Duke Energy $248.71, Verizon $50.50, Persson & Cohen $2580.00, PCSO Law Enforcement $2924.00, Waste Connections $1077.75, PCSO Code Enforcement $47.88. Question by Commissioner Blume on the Bentley Law Firm invoice. Counsel noted the invoice being from the ethics violation allegation. Commissioner Blume questioned ift they had been cleared. Counsel noted that they have all been cleared. Itv was moved 1 by Commissioner Blume and seconded by Commissioner Tolbert to approve both the treasurers report and expenditures. The voice vote was unanimous. Code Enforcement Spreadsheet from Deputy Doherty presented to Commission by clerk. Commissioner Blume questioned how Deputy Doherty is paid monthly. Counsel explained that Deputy Doherty works int the capacity of Code Enforcement for several communities on the barrier island. Vice Mayor Roseman questioned on whether or not Code Enforcement was still monitoring VRBO. Yes CJNW Engagement Letter Approval for FY 2020-2021 Mayor Schmidt noted that this engagement letter mirrors last years. Mayor noted that, in speaking with Counsel, there needs to be an added portion to meet new statutory provision in service contracts for the municipalities that talks about public records provisions. Counsel requests that we allow approval with the additional needed requirements. It was moved by Commissioner Tolbert to add the additional language proposed by Counsel and seconded by Vice Mayor Roseman. The voice vote was unanimous. Counsel Report Pinellas County Interlocal Agreement discussed by Counsel. County will not extend flood plain management services. Noted cancellation clause is adequate and spoke on private service providers. Discussion was had, including linking the County on our website. Discussion on researching private companies tot take care of this for the Town and noting it had been previously done inhouse. It was moved by Commissioner Blume and seconded by Commissioner Tolbert to approve this interlocal. The voice vote was unanimous. Ordinance 2021-03 Code Enforcement Special Magistrate read by Counsel 6:23 pm Public Hearing opened Itwas moved by Vice Mayor Roseman, seconded by Commissioner Blume to adopt Ordinance 2021-03 Code nforcement'Special Magistrate. Voice vote was unanimous. Commissioner Blume had questions regarding existing ordinance and code enforcement. Counsel explained processes. There were no comments from the public. 6:29pm Public Hearing closed 6:29pm Public Hearing opened Resolution 2021-07 Code Enforcement Fines read by Counsel and explained. Commissioner Tolbert had questions regarding Special Magistrate. Commissioner Blume had questions on fines. All questions were answered by Counsel. It was moved by Commissioner Tolbert to approve this Resolution adding VRBO to fine schedule, seconded by Vice Mayor Roseman. The voice vote was unanimous There were no comments from the public. 6:35pm Public Hearing closed 2 Resolution 2021-08 Special Magistrate appointment read by Counsel. 6:36pm Public Hearing opened Attorney Barneby was discussed by Commission and procedural questions were answered by Counsel. Counsel explained why Trask cannot be our Special Magistrate any longer. It was moved Commissioner Blume, seconded by Commissioner Tolbert to adopt Resolution 2021-08 Special Magistrate. Counsel is to verify there is no travel time to be paid. There were no comments from the public. 6:41pm Public Hearing closed 6:41pm Public Hearing opened 6:42pm Public Hearing closed Resolution 2021-09 Budget Amendment read by Counsel. Itv was moved by Commissioner Tolbert, seconded by Vice Mayor Roseman to adopt Resolution 2021-09 Budget Amendment. There were no comments from the public. Miscellaneous Letter from Belleair Beach City Manager Lynn Rives re: Buoys at accesses 6th and 12th. Discussion was had. Mayor explained that Buoys had been there in the past at a cost of 8to 10 thousand dollars and they were gone in a year or two. Counsel noted that approximately 3 years ago she had to go through this type of situation with another municipality on how to establish swimming and idle speed zones, and all the criteria that has to be proven to obtain a permit with FWC. The Town does have an ordinance that was enacted in 2000 establishing a water safety zone 100 yards off of our shore. Counsel spoke on information that she knows regarding FWC. Counsel noted that it looks as though Belleair Beach would want a swim area zone. The permit to the north of Belleair Shore is a swim area permit and the permit to the south of Belleair Shore is an idle speed/no wake permit. Counsel recommended that Belleair Beach provide the Town with an interlocal of exactly what would be covered by Belleair Beach in this situation. Counsel noted that buoy permits are not issued as they used to be and cannot now be done by another municipality. Discussion was had by Commission and Counsel on several different aspects oft this scenario. No vessel designated swim zone is what Belleair Beach is asking for. Counsel suggested sending correspondence. requesting Belleair Beach send a draft interlocal, that would include attorney fees also, for the Commission and Counsel to review. Tolbert Blume Yes Yes Yes Yes wayor/Commissioner Comments on Non-Agenda Items Commissioner Tolbert questioned the new radar signs installed in Belleair Shore that were not requested by Belleair Shore. When speaking with the people that were installing the sign, Commissioner Tolbert was informed that the sign was not supposed to go where it was installed, 3 but the workers felt it made more sense where they installed it. Commission gave permission to Counsel to research who and how permission was given toi install these signs and how they were initiated.
