ted Meeting Minutes Tuesday November 16, 2021 Belleair Bluffs City Hall 6:00pm Town of Belleair Shore Regular Meeting of the Board of Commissioners PRESENT: Mayor Schmidt, Vice Mayor Roseman, Commissioner Niewiarowski, Commissioner Blume, Commissioner Tolbert, Attorney Regina Kardash, Sgt. Sweich, Cpl. Kellman 6:00 pm Call to order by Mayor Schmidt Consideration to Approve Agenda: agenda. The voice vote was unanimous. Comments from the public on any agenda item: There were no comments from the public on the agenda. Approval of Minutes October 19, 2021 Itwas moved by Commissioner Blume and seconded by Commissioner Tolbert to approve the Ity was moved by Vice Mayor Roseman and seconded by Commissioner Niewiarowski to approve the Minutes from the October 19, 2021 meeting. The voice vote was unanimous. Sheriff's Report Cpl. Kellman reported statistics for October 2021. 175 events, 35 illegal parking, 11 house checks, 1 trespass, 119 directed patrols, 25 warnings and 25 citations reported. Commissioner Blume questioned if any tickets were given out, none. Also, questioned if warnings were for other ordinance violations, yes. FLC/Eryn Russell Years of Svc Award Ms. Russell presented award, congratulations and Resolution plaque for Mayor Schmidt 25 years of Service serving Belleair Shore. Mayor Schmidt noted that what has made his job easy has been the Commissioners he has had the privilege of working with, along with other Mayors and a great town clerk. Mayor noted that it has been a labor of love and a lot of fun. Treasurers Report Clerk/Treasurer, Barb Colucci went over balance sheet and P&L. October 2021 expenditures: Regions Bank Svc Chg $31.12, Clerk/Treasurer Salary $896.50, United Mini Clearwater $810.00, Bentley Law Firm $222.00, Verizon $52.58, FMIT $16,633.00, Waste Svcs $1077.75, Municode $550, US Treasure 941 $540.00, Tampa Bay Times $361.60, Duke Energy $248.71, Persson & 1 Cohen $3903.00, Florida League of Cities $546.00, PCSO law enforcement $2892.00, PCSO code enforcement $83.79. Clerk requested approval for IT assistance and it was offered by Commissioner Tolbert and his son. It was moved by Commissioner Tolbert and seconded by Commissioner Blume to approve both the treasurers report and expenditures. The voice vote was unanimous. Code Enforcement Ithas not yet. Spreadsheet from Deputy Doherty presented to Commission by clerk. Counsel questioned clerk as to whether the 3rd Thursday of the month at 2:30pm has been confirmed with Belleair Bluffs. CJNW Engagement Letter Approval for FY 2020-2021 Addendum was added by Counsel. Public records language was added. Engagement letter was approved last month. Counsel Report Resolution Special Magistrate - Counsel noted that she has done the addendum to reference Radar Sign Follow up Counsel followed up with Pinellas County. Discussed the situation. Belleair Shore jurisdiction (only for the traffic and road signs) does not start until the privacy wall of Belleair Shore owners. Iti is a county road. Pinellas County did request at traffic liaison in Belleair Shore sO the County can contact the Town with any issues that come up. Mayor questioned this mapping and it was explained that this county mapping in this situation is just for traffic. It was moved by Vice Mayor Roseman and seconded by Commissioner Niewiarowski to appoint Buoy follow up letter to Lynn Rives/Belleair Beach - Counsel noted that that this follow up letter Mayor introduced Dave Gattis/Vice Mayor Belleair Beach to the Commission and asked if Mr. that there is no travel included in the hourly rate for the Magistrate. Commissioner Tolbert as Belleair Shore traffic liaison for the county records. was sent to Lynn Rives and has not heard anything back yet. Gattis would like to speak. Dave Gattis declined. Announcement of Elections Clerk announced election qualification dates of November 13, 2021 through December 13, 2021. 11am to 4pm. Mayor noted that positions open are for Commissioners Tolbert, Blume and Niewiarowski. Miscellaneous None Availability of Commissioners for December 21, 2021 meeting Mayor Roseman Niewiarowski Yes Tolbert Yes Yes Yes 2 Blume TBD Wayor/Commissioner Comments on Non-Agenda Items Commissioner Tolbert brought SB280 and questioned what the local governments and our state representatives are doing to oppose this bill. Counsel commented on this and noted that the Town can do a Resolution opposing this, to represent the entire governing body. Mayor noted that the Big C is diligently working to oppose this bill. He feels that something from the group of municipalities is more impactful. Public Comments on Non-Agenda Items Frank Bankard Belleair Beach Councimember spoke regarding buoy installation at the Belleair Shore 6th and 12th street accesses. Noted that there is an old interlocal regarding buoys in Belleair Beach. Mayor noted that the state does not allow another municipality to put buoys in the water. Counsel noted that there are very stringent requirements that are needed by the state and noted water safety guidelines being stringent. Counsel noted that she has never seen a buoy interlocal between the municipalities, even in the previous Town Counsel records. She noted that it was much easier in the past to obtain permitting and it is much more involved now. Counsel noted that FWC was contacted and they have never had anything on file for Belleair Shore. Counsel noted that this would be considered a long range, capital improvement type project for the Town. Bankard stated that all costs would be covered by Belleair Beach, installation etc. and would not have to be in our budget. Mayor thought that the letter from Belleair Beach stated that Belleair Beach would cover all costs and expenses. Mayor also noted that the Town has spent money in the past and the buoys were gone within 3 years. Mayor thinks it would help the commission if they knew exactly where Belleair Beach wants the buoys. Counsel noted that the FWC would have to issue the permit under Belleair Shore, sO ultimately the Town would be responsible for it and that can be tricky, obviously. Counsel concern is that the Town is not budgeting for this and ift the relationship between the municipalities does not remain, the Town is responsible. It was noted that Belleair Beach Council cannot agree on what their buoys should say in the City Ordinance. Mayor thinks that the Commission needs to look at all the issues and liabilities to make any decision. Town Meeting adjourned 6:49 pm. meeting. The voice vote was unanimous.
