Meeting Minutes Tuesday May 17, 2022 Belleair Bluffs City Hall 6:00pm Town of Belleair Shore Regular Meeting of the Board of Commissioners PRESENT: Mayor Schmidt, Commissioner Seith, Commissioner Niewiarowski, Vice Mayor Blume, Commissioner Tolbert, Attorney Regina Kardash, Captain Leiner, Deputy Doherty 6:00 pm Call to order by Mayor Schmidt Consideration to Approve Agenda: agenda. The voice vote was unanimous. Comments from the public on any agenda item: There were no comments from the public on the agenda. Itv was moved by Commissioner Tolbert and seconded by Vice Mayor Blume to approve the Approval of Minutes April 17, 2022 Itwas moved by Commissioner Niewiarowski and seconded by Commissioner Tolbert to approve the Minutes from the April 17, 2022 meeting. The voice vote was unanimous. Sheriff's Report Captain Leiner reported statistics for April 2022. Most of Belleair Shore activity related to directed patrols and parking. Question from Vice Mayor Blume on whether the new mayor from Belleair Beach contacted Captain regarding increasing patrols. Captain noted that he speaks with the City Manager of Belleair Beach. Discussion was had regarding this. Captain noted that increased patrols will be happening on the beach of both communities, particularly in the summer months. Ordinances being ignored and parking was discussed by Vice Mayor Blume. Commissioner Niewiarowski noted that the South end of Belleair Shore has a problem with over-run from Indian Rocks Beach with partying. Code Enforcement Deputy Doherty presented spreadsheet to Commission. Noted an abandoned shower stall in front of 860 Gulf. Deputy Doherty went and got his personal pickup truck to remove the outdoor shower stall. Noted 40 Gulfi is overgrown and he is working on this. This home will be changing hands in June. Spoke regarding 960 Gulf Blvd disrepair and overgrowth. Has contacted the owner and will continue to monitor. Expenditures: Regions Bank Svc Chg $30.81, Clerk/Treasurer Salary $896.50, Waste Services $1077.75, Persson & Cohen $2780.000, Verizon $50.40, US Treasury (quarterly 941)$540.00, Duke Energy $200.17, PCSO Law Enforcement $2892.00, PCSO Code Enforcement $87.15, Postmaster Itwas moved by Commissioner Seith and seconded by Vice Mayor Blume to approve both the Budget worksheet was presented to Commission in preparation for the June 2022 Budget Workshop. Mayor questioned what our general liability insurance covers. Counsel responded that it covers the Town in any real property, court actions and ethics complaints. Clerk noted that ita also covers fraud' for employees. Mayor noted that Florida insurance is averaging an increase of 30 to 35%. Vice Mayor Blume asked if there was a breakdown of what insurance amount is related to the lawsuits. It was explained that Counsel bills are broken down but the insurance amount is not. Vice Mayor Blume asked if the Town shopped this price. Counsel explained that FMIT is used by most municipalities in FL because iti is a Trust and the Town does have sovereign immunity sO that essentially puts a cap on our claim that the most the Town would pay out is limited for serious court claims. The City of St. Petersburg is self-insured. The Town would have to plan for a number of years to be self-insured. Counsel noted that she only knows of one other company in the State of FL that offers municipality insurance. Commissioner Seith questioned if $25.76 (stamps and Audit report). treasurers report and expenditures. The voice vote was unanimous. there is a way to know the percentage increase before the budget. Ordinance Violation follow up was discussed. Counsel Report Resolution 2022-02 was read by Counsel. Belleair Shore Policy First and final reading. Itv was moved by Vice Mayor Blume and seconded by Commissioner Tolbert to approve 6:29pm Open Public Hearing Resolution 2022-02 Belleair Shore Policy Resolution 2022-02. The voice vote was unanimous. Noted that he knows that conversations were had between Joseph Manzo and Mayor Schmidt to resolve the issue of the lawsuit before it goes to trial. Just here in hope that the Commission consider settling this lawsuit. Noted he has lived here for 11 years and he uses 12th Street access. Noted that Vice Mayor Blume has the patience of a saint and that he understands how the Town residents feels. Was on the beach Friday and saw people leaning on his property. Wants the Town and City to work together to keep these other people off the beach. Mayor Schmidt interjected that he needed to leave the meeting and Vice Mayor Blume would take over. Mayor Schmidt noted that he had permission to meet with former mayor Manzo to discuss a settlement. Town would like to get it settled and he knows that Dave Gattis Mayor Belleair Beach spoke that he appreciates what the Commission is doing and noted that he knows that Belleair Beach wants to keep the 'bad guys' out. Discussion meeting was had with Vice Mayor Blume and City Manager Rives about gating the accesses. Dave Gattis did some research into this. Noted that key fobs were not a cost- effective solution. Very costly. Towing was also discussed. Dave Gattis requested the Commission blessing on bringing in a tow company. Increased patrol on the beach was discussed. Noted that he hopes that the Town can come to a compromised to allow single pole umbrellas. Vice Mayor Blume thanked Dave Gattis for his comments and noted that the Town goal is to have the most pristine beach for the residents. And the two municipalities are in agreement with this. Counsel questioned Captain Leiner on whether or not there is a rotating list that the County uses for towing. Itis up to each municipality and is property specific. Counsel noted that there is a statute that says that there must be signage and sometimes the tow companies will pay for the signs. Counsel can provide the statutory requirements if the Commission requests. Counsel noted that it is not required to be ini the interlocal, but this may require an ordinance change for this to be allowed. Commissioner Tolbert thinks that towing may be a start to solving the issues, but there are other things that need the citizens of Belleair Beach would like to get it settled. to be looked at deeper.
