Meeting Minutes Tuesday September 19, 2022 Belleair Bluffs City Hall 5:01pm Town of Belleair Shore Hearing Regular Meeting of the Board of Commissioners and Final Budget and Millage Public PRESENT: Vice Mayor Blume, Commissioner Seith, Commissioner Tolbert, Commissioner Niewiarowski, Attorney Regina Kardash, Cpl. Daniel Storie 40 Gulf wasi invited to introduce himself as a new resident. Itv was moved by Commissioner Tolbert and seconded by Commissioner Seith to approve the Suncoast Pinellas Fire Protection Chief Jeff Davidson spoke briefly about ballot referendum and Approval of Minutes August 16, 2022lt was moved by Commissioner Seith and seconded by Commissioner Niewiarowski to approve the minutes from the August 16, 2022 meeting. The The Sheriffs report was presented to Commission by Cpl. Killman. No crime, no arrests, 223 events. 47 parking citations, no crashes, no traffic stops. Vice Mayor Blume attempted to find out the instructions that the deputies have been given on patrolling the beach. Commissioner Niewiarowski questioned what the instructions are for the south end of the Town where there are tents and canopies consistently set up. Would like regular patrol of the south end of the Town sO the residents are not targeted. Mr. Storie 40 Gulf, noted that approx. 401 times, he had to approach people on his property over the weekend with shade structures from Indian Rocks Beach. There voice vote was unanimous. Sheriff's Report were times that the situation got elevated. Code Enforcement The Code Enforcement report was presented to Commission by Deputy Doherty. Deputy Doherty commended Mr. Storie for the quick response to overgrown landscape at his home during the transition of purchase. 660 Gulf and 860 Gulf are being worked on by code enforcement. If the properties are not in compliance in a timely matter, the process will move: forward. Commissioner Seith questioned compliance timeframe. It was explained by Counsel. Treasurers Report Clerk/Treasurer spoke on. Auditor approval of moving funds from Regions Bank checking to LGIP Clerk/Treasurer, Barb Colucci went over balance sheet and P&L for July 2022. Expenditures: Regions Bank Svc Chg $30.62, Clerk/Treasurer Salary $896.50, Staples $40.64 (USB), Persson & Cohen $3300.000, Waste Services $1077.75, Duke Energy $204.0 04, Verizon $50.50, Clerk of Circuit Court Printing $219.50 (citation books) PCSO Law Enforcement $2892.00, PCSO Code Enforcement $99.60. It was moved by Commissioner Tolbert and seconded by Commissioner Seith to approve both the treasurers report and expenditures. The voice vote was unanimous. Open Public Hearing Final Budget and Millage FY 2022-2023 5:20pm open General Fund. Tabled to October 2022 meeting. Resolution 2022-05 Final Millage 2022-2023 Commissioner Seith. The voice vote was unanimous. Resolution 2022-06 Final BudgetFY 2022-2023 No public comments. Public Hearing Ordinance 2022-01 Section 30-53 Public Hearing Closed 5:25pm Vice Mayor Blume noted that he spoke to Mayor Gattis, Belleair Beach regarding the diameter of the umbrellas allowed in the accesses and that these might be added to ordinance. Some discussion was had by Commission and Counsel regarding Belleair Shore owner rights and shared expenses between Belleair Beach and Belleair Shore for enforcement, as discussed with Mayor Gattis. It was mentioned that the resident at 1720 Gulf that spoke at the last meeting pays no taxes on any beach area based on the county ECL tax base. 7 % foot diameter, single pole, Vice Mayor would like the language to be correct sO the ordinance was tabled to the October 18, in accesses only was discussed. 2022 meeting. Counsel Report Counsel presented Tenant Bill of Rights Ordinance of Pinellas County, effective October 4, 2022. Counsel explained the County Ordinance. Counsel also noted that the County will be 100% responsible for enforcing this. The Town has 3 options. 1) do nothing and just allow the County enforce it within this jurisdiction. 2) opt out of it by telling the County the Town does not want enforcement within this jurisdiction. 3) enact a Town ordinance to enforce this. Tabled to the October 18, 2022 meeting. Availability of commissioners for October 18, 2022 Regular Town meeting All Mayor Yes No Wayor/Commissioner Comments on Non-Agenda Items Commissioner Tolbert noted the situation presented to the Commission by the Stockel! family about public parking in our accesses. Noted that, after much work, Google Maps now does not show our accesses as public parking. Vice Mayor Blume noted that he did get three quotes for electronic gate control. The cheapest was $35,000 and went up to $60,000 for each gate. This was for the entry system only. Then there is a charge for each resident that would need the app 2 to gain access. It was also be an additional cost fori internet access and electric to be supplied to each gate. Towing was also discussed and the loss of revenue if that was pursued. Vice Mayor Blume noted that cost of enforcement was discussed with Mayor Gattis. Commissioner Tolbert noted that he had a confrontation with someone that felt that his seawall was their own personal lounging space. It was noted that the public does park at the Belleair Beach City Hall and walk to the 6th and 12th St. accesses. After being questioned about locking the ability to lock the gates. Counsel noted that there is an Attorney General's opinion that the gates cannot be locked to the general public. Public Comments on Non-Agenda Items Debi Keith Harbor Dr Belleair Beach. Commented that she would like to thank the Commission for all the work that they do. Lori Shelley 1320 Gulf noted that she would like to see the Ordinance on the shade structures moved forward quickly. Vice Mayor Blume noted that the Town would like to get all of the wording correct for the benefit of all in the Ordinance and noted that the Town would not liket to have to revisit this again after initially jumping the gun'. Counsel noted that due to Sunshine laws, the Commission can only discuss this at Town meetings and that makes it difficult to get the Ordinance language as it should be. Daniel Storie 40 Gulf mentioned that their family is very happy to be a part of the Town. He has been looking for 3 years and it benefits his entire family to bei in a limited access area and less traffic to the beach. Town Meeting adjourned 6:10pm.
