Meeting Minutes Tuesday December 6, 2022 Belleair Bluffs City Hall 6:00pm Town of Belleair Shore Regular Meeting of the Board of Commissioners PRESENT: Mayor Schmidt, Vice Mayor Blume, Commissioner Seith, Commissioner Tolbert, Attorney Regina Kardash, Sgt. McKnight Call to order by Mayor Schmidt 6:00pm Consideration to Approve Agenda: agenda. The voice vote was unanimous. Comments from the public on any agenda item: There were no comments from the public on the agenda. Approval of Minutes November 1, 2022 Itv was moved by Vice Mayor Blume and seconded by Commissioner Tolbert to approve the Itv was moved by Commissioner Tolbert and seconded by Commissioner Seith to approve the minutes from the November 1, 2022 meeting. The voice vote was unanimous. Sheriff's Report The October 2022 Sheriff's report was presented to Commission by Sgt. McKnight. No crime, no arrests, 226 events, 246 units responding, 27 citations. Mayor questioned 1 burglary in October? Itwas noted by Sgt. McKnight that this is a YTD number. It was moved by Commissioner Seith and seconded by Commissioner Tolbert to approve the Sheriff's report. The voice vote was unanimous. Code Enforcement The Code Enforcement report was presented to Commission by Clerk. Clerk noted that a compliance letter was sent to 660 Gulf and the lot has been mowed. Also, 920 Gulf needing stucco repair has been taken care of. Homeowner is waiting for County final inspection. 860Gulf has been mowed. Commissioner Tolbert questioned that 660 has listed as closed and does that mean we will not move forward. It was explained that for the mowing violation, it is closed. Commissioner Tolbert noted that on both sides of the property there are fire hazards, rodents and hel has sent pictures to Deputy Doherty of large piles of debris. Counsel noted that another letter must be sent to note exactly what the homeowner is being charged with. Noted by clerk to send as second letter and open a new case. Vice Mayor Blume questioned how many hours Deputy Doherty is working in a month. Clerk noted that it is about 2 hours a month. Vice Mayor says that he has talked to Deputy Doherty about doing additional hours for code enforcement, such as 1 sunset times. It was moved by Vice Mayor Blume and seconded by Commissioner Tolbert to approve the Code Enforcement report. The voice vote was unanimous. Treasurers Report Clerk/Treasurer, Barb Colucci went over balance sheet and P&L for October 2022, noting balances in both the General Fund and Regions Bank. Expenditures: Persson & Cohen $7948.50 (2 months per Counsel), Regions Bank Svc Chg $35.57, PCSO Code Enforcement $174.30, Verizon $50.38, Waste Svcs $1107.93, Clerk/Treasurer Salary $896.50, CivicPlus (municode) $775 ($550 Code setup $275 Admin), IRS, US Treasury $540 (3d Qtr 941), Duke Energy $204.06, Barbara Colucci $64.11 ($23.10 stamps, $41.01 closing 12th street access safety), FL League of Cities $573.00 (annual membership), Tampa Bay Times $422.20 (Ordinance 2022-01), United Mini Clearwater $810.00 (annual storage includes 10% discount), PCSO Law Enforcement $2692.00, PCSO Code Enforcement $99.60. Mayor requested clerk/treasurer to check on code enforcement amount of $174.30. Was this for 2 months or 1 month? Vice Mayor Blume questioned how much of the Attorney bill is for Manzo, sO it can be charged back? Counsel noted that it is broken out on each monthly invoice. It was moved by Commissioner Tolbert and seconded by Commissioner Seith to approve both the treasurers report and expenditures. The Transfer to General fund from Regions bank checking. Requested by Clerk to approve an amount to transfer. Discussion was had. Mayor noted that the checking account has no need for these additional funds, sO requested Barb to check with Regions. Counsel noted that she would have to check on what municipal investment standards and restrictions for next meeting. Ordinance 2022-01 - Section 30-53 Second and Final Reading Second and Final Reading Ordinance 2022-01 amendmentappea. Section 30-53 Dave Gattis noted that he is very happy to see this coming to an end. Itwas moved by Vice Mayor Blume and seconded by Commissioner Tolbert to approve Ordinance 2022-01. Open Public Hearing 6:17pm open Public Meeting Closed 6:19pm Counsel Report Vice Mayor Blume started the Counsel Report with Captain Leiner requesting clarification on the Town expectations on enforcement of amended Ordinance 2022-01. Vice Mayor noted how he answered Captain Leiner with his interpretation. Deputies can use their discretion on maximum size, but must be single pole within the access lots. As far as height, also discretion but if deputy feels the height exceeds al basketball net (10ft) then maybe it needs to be addressed. Thel biggest question was homeowner usage on their private property, no more than 3 days. Noted that his interpretation is that he does not expect the deputy to go up to the individuals, but that the homeowner would have the responsibility of calling the Sheriff's Office if there are individuals trespassing ont their property. *note* this is' Vice Mayor Blume interpretation and that the Deputies should just use common sense. Vice Mayor Blume noted that Capt. Leiner requested that answers to the questions in writing. Commissioner Seith noted that homeowners might have to help neighbors in the trespassing. Vice Mayor Blume noted that he would like to utilize Code Enforcement Officer Dan Doherty to help with electric/motorized vehicles on the beach and violations that happen at sunset time on the beach, approximately 5 hours a week. Mayor questioned who would write the answers to Captain Leiner's questions. Mayor also noted that he believes that' Vice Mayor should put the answers in writing. Mayor noted that he has lived here a very long time and now has more problems with people coming off the beach, turning on his hot tub and using his pool, among other things that he found happening on his property on Saturday 2 and Sunday morning. Counsel noted that the Commission cannot send their thoughts to Vice Mayor, that they must be sent to her. Commissioner Tolbert feels that the problems are more prevalent ont the south end oft the beach, than the north end. Vice Mayor thought that, ift the Town utilizes Deputy Doherty, maybe his efforts can be used more at the south end more than up at Counsel noted that she had spoken to the City of Belleair Beach attorney Randy Mora. He provided a copy of the recently enacted vessel exclusion zone. Attorney Mora asked if the Town of Belleair Shore would be interested in moving forward with something similar. Counsel noted that the Commission spoke on this recently and decided no on this. Counsel noted that if the Town were to move forward it would be under the Town purview only and as far as payment, it would be subject to an interlocal. Mayor opinion is he likes the buoys, but the problem is that the Town spends a lot of money trying to replace the buoys that are gone or destroyed. The cost is prohibitive. Mayor noted that as a resident of Belleair Shore, IF Belleair Beach will incur all costs, he does not have a problem with it. Commissioner Seith clarified that the Town would get the buoys and Belleair Beach would be paying all costs. Counsel noted for clarification, that since it ist the Town jurisdiction, the Town would be the permit holder and the Town would be ultimately responsible for them. The Town would enter into a contract with the neighboring community, but the permit would be in the Town name. Based on Counsel conversation, it seems that Belleair Beach may be willing to incur the cost. Counsel explained that she knows that the Town already has a vessel exclusion ini the ordinances, but there would have to be some research on her part Public: Dave Gattis said that Councimember Bankard brought it up that he would be interested in maintaining buoys in Belleair Shore. The thought train was that the Town would obtain the permit and costs would be covered by Belleair Beach. Gattis noted that he is not sure that the entire council is on board, but this is the beginning of the conversation, that if the Town is Question: There is a yacht that pulls up and sends a smaller vessel to shore to pick up. Would that be restricted. Counsel: Itis any vessel, she would have to look to see if kayaks are included or how that would work. Is there a risk of allowing Belleair Beach do this that precludes the rights of Belleair Shore? Counsel: No. that cannot occur as long as the Town is an incorporated municipality. That is part of why the FWC will not issue a permit for Belleair Shore to Belleair Beach. Belleair Shore would have ultimate control over the ordinance and the permit. The Town would just be bringing them into the fold to maintain and pay for it (from what she is hearing). Treasurer: Noted that the Town allows kayaks. Are they included in 'vessels'? As treasurer, Public: asked if the Town could accept contributions to support this? Counsel: The Town can accept contributions. The Town would have to draft a resolution, especially if it is for a specific purpose, then the resolution must pass, and the contribution would have to be treated as its own Mayor requested that Gattis go back to the Belleair Beach Council, do some research and come 12th or 18th street accesses. and it would be about a 6 month process. interested, it can move forward. noted that there could be high costs involved that would affect the budget. fund.
