Meeting Minutes Tuesday February 21, 2023 Belleair Bluffs City Hall 6:00pm Town of Belleair Shore Regular Meeting of the Board of Commissioners PRESENT: Vice Mayor Blume, Commissioner Tolbert, Commissioner Niewiarowski, Commissioner Seith, Attorney Regina Kardash, Captain Leiner, Deputy Doherty Call to order by' Vicel Mayor Blume 6:12pm Consideration to Approve Agenda Itv wasi moved by Commissioner Tolbert and: seconded by Commissioner Niewiarowski to approve the agenda. The voice vote was unanimous. Comments from the public on any agenda item: There were no comments from the public on the agenda. Approval of Minutes January 17, 2023 Ity was moved by Commissioner Seith and seconded by Commissioner Tolbert to approve the minutes from the January 17, 2023 meeting. The voice vote was unanimous. The. January 2023 Sheriffs report was presented to Commission by Captain Leiner. No crime, no arrests, 159 events, 122 directed patrols, 11 illegally parked vehicles, 3 calls for assistance, 10 citations. Vice Mayor Blume questioned about the south end of Belleair Shore next to Indian Rocks Beach, if the Sheriffs office has noticed any differences with spring break coming up. Captain noted that they are continuing to educate the deputies, will step up patrols and noted that The Code Enforcement report was presented to Commission by Deputy Daniel Doherty. Follow upon660 Gulf Blvd open violation has been in communication with Ms. Tsen and owner has hired anewl landscaper andi issues will be remediated as he comes continually to maintain this property. Commissioner Tolbert noted that this landscaper seems reliable and will be handling the situation as needed. Deputy Doherty noted that he put the ordinance violation books back into the Deputy office in Belleair Beach and Attorney Kardash explained that the Town would have to provide a locked box for the violations written and it was agreed that Barbara Colucci would take care of picking upt the violations. Vice Mayor Blume spoke about PCSO Secondary Employment options and wanted to re-emphasize the previous motion made at the January 2023 meeting. This was discussed and it was noted that there is a 3 hour minimum for PCSO secondary employment. It was noted that Commission wants 2-3 days a week preferably using Deputy Doherty for the third dayi if possible. Deputy Doherty questioned ift the owner of 40 Gulf Blvd was happy with the current Sheriff's Report issues will increase during spring break. Code Enforcement enforcement situation. He noted that he is and praised Deputy Robertshaw. 1 Itwas moved by Vice Mayor Blume and seconded by Commissioner Seith to sign the secondary employment contract with PCSO and Vice Mayor Blume will be the initial point of contact. Treasurers Report The Clerk/Treasurer noted that other municipalities were not changing the election dates to The Clerk/Treasurer presented the Town AFR 20221 for approval by the Commission. The Clerk/Treasurer discussed the Transfer Fund amount that had been tabled from previous meetings. Ity was requested that the Clerk/Treasurer to look into the options that could be provided by Regions Bank. It was also noted that Treasurer spoke with the owner of the BMC Auditors and after reading the information on transferring funds, he noted that there was no need for the Town to adopt a written investment policy. Attorney Kardash further researched this and provided further information for the Commission and noted that a resolution can be adopted by the Commission without at formal Investment policy. Attorney Kardash provided information from Dana Investment Advisors, in case the Town would like to move to a more formal investment strategy. Itwas moved by Commissioner Tolbert and seconded by Commissioner Seith to approve the AFR The Clerk/Treasurer presented the proposed Budget and Trim Calendar dates for Commission. Itwas noticed that the dates would not work and new calendar will be presented at the March Clerk/Treasurer went over P&L, Balance Sheet and P&L, budget VS actuals for January 2023. Expenditures: Regions Bank Svc Charge $32.80, Quickbooks Annual $457.50, FMIT Insurance $33,191.00, Barbara Colucci $896.50, Adobe Annual $239.88, U.S Treasury Quarterly 941 $540.00, Waste Connections $1135.63, PCSO Code Enforcement $103.60, PCSO Law Enforcement $2692. .00, Safebuilt $343.75, Duke Energy $211.90, Verizon $50.37. Itwas moved by Commissioner Seith and seconded by Commissioner Tolbert to approve. January Daniel Storie 40 Gulf stepped upt for open position for March. Attorney Kardash requested a voter registration in Florida. Candidates must still qualify under the Town Charter. November, so the Town can keep their existing election cycle. 2022. Open Commission Position Counsel Report Counsel noted that she was contacted by the Belleair Beach City Manager regarding the buoys. She was surprised that someone from Belleair Beach did not come to the Belleair Shore meeting to speak to the Commission, but it is up to the Commission on what they would liket to do about this. Vice Mayor Blume noted that hei is not really comfortable in entering into another agreement with Belleair Beach at this time with the ongoing litigation and feels that there are existing issues with the current interlocal agreement. Commissioner Tolbert noted that buoys are okay, but noted that the buoys just blow off. Noted that he knows that Belleair Beach is offering to pay for everything to do with the buoys, but he does not see the point in going through all the trouble if they are) just going to end up on our beach. Commissioner Niewiarowski agrees. Commissioner Seith agrees, that he sees no reason for them ift they. just wash up. 2 Ordinance 2023-01 EAR Comprehensive Plan AN ORDINANCEOFTHE TOWN OF BELLEAIR SHORE, FLORIDA, AMENDING THETOWN OF BELLEAIR SHORE'S COMPREHENSIVE PLAN PURSUANTTOTHEEVALVATION AND APPRAISAL PROCESS OF SECTION 163.3191, FLORIDA STATUTES, AND THE AMENDMENT PROCESS OF SECTION 163.3184, FLORIDA STATUTES, BY ADOPTING A PROPERTY RIGHTS ELEMENT, TO INCORPORATE THE REGIONAL WATER SUPPLY PLAN OF THE SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT, AMENDING THE FUTURE LAND USE ELEMENT UPDATING TERMINOLOGY AND REFERENCES TO REFLECT CHANGES IN FLORIDA STATUTES, CHAPTER 163, SINCE 2018DELETING OBSOLETE DATA AND ANALYSIS, REMOVING OUTDATED REFERENCES, UPDATING DEFINITIONS AND TERMINOLOGY THROUGHOUT THE COMPREHENSIVE PLAN AS HEREINAFTER PROVIDED; ESTABLISHING THE LEGAL STATUS OF THE COMPREHENSIVE PLAN; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES JN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. They strongly disagree with Belleair Beach installing buoys in Belleair Shore, that Belleair Beach has more pressing issues of safety to spend Belleair Beach money on. Appreciates knowing where the commission stands on the buoy issue and will voice their disagreement with Belleair Beach also. Daniel Storie 40 Gulf also noted that buoys are washed up from IRB also. 3 Town Meeting adjourned 7:10pm. meeting. The voice vote was unanimous.
