Meeting Minutes Wednesday March 29, 2023 Belleair Bluffs City Hall 6:00pm Town of Belleair Shore Regular Meeting of the Board of Commissioners PRESENT: Mayor Schmidt, Vice Mayor Blume, Commissioner Tolbert, Attorney Regina Kardash, Sgt. Sweich, Deputy Doherty, Shelly Rich Regions Bank Call to order by Mayor Schmidt 6:00pm Consideration to Approve Agenda agenda. The voice vote was unanimous. Comments from the public on any agenda item: There were no comments from the public on the agenda. Approval of Minutes February 21, 2023 Itwas moved by Commissioner Tolbert and seconded by Vice Mayor Blume to approve the Itv was moved by' Vice Mayor Blume and seconded by Commissioner Tolbert to approve the minutes from the February 21, 2023 meeting. The voice vote was unanimous. Regions Bank - Shelly Rich Branch Manager Spoke regarding getting a higher interest rate on the Town liquid assets. Money market was recommended. Options given: Money Market CD $50K-1 1.25% $100K-2.5% $50K - 9 month 4% $50K - 13 month 4.25% Shelly Rich also discussed annuities as a possibility Mayor Schmidt questioned percentage rates and noted that he has been quoted 4.25% from Raymond James (Valley is at 4.5%, etc) and believes that the Town: should do something to obtain al higher interest rate. Shelly Rich is to check into obtaining a higher rate for the Town. Discussion was had with Commission that the funds are now in a checking account with no interest. Attorney Kardash questioned if Regions/Shelly Rich is aware of State statutes regarding municipalities, yes. $100,000 is what the commission had previously noted as the amount to be moved. Question from public Daniel Storie if there is any downside to moving the dollars now at 2.5%. Attorney Kardash noted that a resolution needs to be done to designate authority for the Town and the amount. Resolution will be brought to the April meeting. Vice Mayor Blume made ar motion to stay with Regions Bank and move some funds to a more liquid higher rate instrument with Mayor Schmidt and' Vice Mayor Blume will have the authority to move the funds according to state statute seconded by Commissioner Tolbert. The voice vote was unanimous. 1 Sheriff's Report The February 2023 Sheriff's report was presented to Commission by Sgt. Sweich. One larceny/theft, no crashes, 169 events, leading with directed patrols then parking citations, no arrests, 30 parking citations. Commissioner Tolbert questioned 7 trespasses, Sgt. Sweich will research and bring this to the next meeting. Mayor questioned if PCSO has had more complaints about homeless and noted that he had someone come and go to sleep at his front door. The Code Enforcement report was presented to the Commission by Deputy Daniel Doherty. Secondary Employment detail started last weekend and reported on this. Noted 960 Gulf contacted on a Sunday due to construction work being done against code. When approached, the workers stopped work for the day. Also noted a couple of bicycle riders that were cooperative. Deputy Doherty also worked the next Saturday and came across most activity at the 6th Street access, including large tents being set up, but people complied easily to the education and took them down. Deputy noted that he spoke to many Belleair Shore residents that were very happy about the extra detail and police presence. Spoke/questioned how to handle high tide situations and reported on other situations that he came across working the secondary employment. Mayor noted that people come and sit or lay in front of vacant lots (sometimes every day, the same The Clerk/Treasurer presented the Town attorney fees breakdown as requested by the The Clerk/Treasurer presented the PCSO Secondary Employment Contract. Attorney Karkash explained that the Resolution for this employment is to make sure that the Town has the money int the budget ift this is the schedule that is needed. Ift the funds are not used, it can bet fixed when the Town does the end of the year budget reconciliation, it can be returned. This resolution is to show that the Town is being fiscally responsible with how we budget Town money, that we are The Clerk/Treasurer presented Budget/Trim calendar as a 'save the date' for the commission. The Clerk/Treasurer went over P&L, Balance Sheet and P&L, budget VS actuals for February 2023. Open Commission Position Vice Mayor Blume made a motion to appoint Daniel Storie to the commission for the open position for a 2 year term and it was seconded by Commissioner Tolbert. The voice vote was unanimous. Counsel Report Attorney Kardash read: Resolution 2023-02 Secondary Employment Contract Budget Amendment AF RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF BELLEAIR SHORE, FLORIDA AMENDING THE FY2022-2023 BUDGET THAT WAS APPROVED ON SEPTEMBER 20, 2021, RESOLUTION 2022-06, TO COVER UNANTICIPATED EXPENSES. Public Hearing opened 6:38pm 2 No Comments from the public. Public Hearing closed 6:39pm Itwas moved by Vice Mayor Blume and seconded by Commissioner Tolbert to approve Resolution 2023-02. The voice vote was unanimous. Buoys tabled from previous meetings. Mayor stated his opinion that he has nothing against the buoys under one condition... that any costs now and forever would be covered by Belleair Beach. Commissioner Tolbert questioned if another interlocal would have to be entered into with Belleair Beach for this. Attorney Kardash answered that yes, the Town would have to enter into another interlocal and the Town would have to do whatever is required int the way of executing documents to apply for the permits because the permits, even with the interlocal, are still going to be issued int the name of the Town. The Town will have to execute and keep with any any paperwork that is required for the permit. Commissioner Tolbert noted that he is of the same opinion that the buoys are fine, but has al big concern with the durability of buoys, they require al lot ofr maintenance and work. For this reason, he does not see why the Town would put al lot of effort into the buoys. Vice Mayor Blume noted that buoys are great if they work, but he has seen more downside to it. He is also not really comfortable signing an interlocal agreement with Belleair Beach at this time until all pending items are resolved. He believes that there are a lot of issues in the existing interlocal that need to be addressed and he is not interested in signing any new interlocal Itwas moved by Vice Mayor Blume that at this moment the Town will not proceed with any relationship with Belleair Beach regarding the buoys and seconded by Commissioner Tolbert. agreement. The voice vote was unanimous. Miscellaneous The Clerk/Treasurer presented the Auditor representation letter for FY 2022-2023. $7000.00 for this FY, next fiscal year will be $10,000. It was moved by Vice Mayor Blume and seconded by Commissioner Tolbert to have BMC represent the Town as Auditor for FY 2022-2023. The voice Mayor spoke regarding beach renourishment that was presented today at the BigC meeting. Noted that all oft the BigC mayors signed a letter to be taken to legislation in Washington to move vote was unanimous. forward with renourishment without 100% easement relinquishment. Form 6 Full and Public Disclosure of Financial Interests - Mayor Form 1, but the Mayor is not supporting this legislation. Availability of Commissioners for April 18, 2023 Town Meeting Mayor spoke on a new possible' legislation requiring municipal government elected officials must provide Form 61 that is much more extensive than Form 1. Tolbert Blume Storie None No Yes Yes Yes Mayor/commissioner Comments on Non-Agenda Items 3 Public Comments on Non-Agenda Items PSFRD Fire Chief Jeff Davidson acknowledged that one of his paramedic teams was given the John Moroni Legacy Foundation award for the County for successfully reviving a former Commissioner in Pinellas County. He also spoke oft the upcoming plans for PSFRD in the way of new stations and locations, requesting additional paramedic funds from the County and Vice Mayor Blume questioned the Attorney regarding the Fees Breakdown. Federal, State, County, Ethics, Town ? Attorney Kardash explained that Town is for the basic Counsel services for the Town, Federal is for the Federal lawsuit, State is for the State litigation, ethics is for the Ethics complaint was for the Mayor and Barb, County court is when Regina needs to go to the County Court for ordinance violations. Vice Mayor noted a $5000 charge in August. Attorney Kardash explained that this was for a motion that she drafted that was a response on a motion to dismiss the citation related to the State litigation. Vice Mayor questioned if he was correct that over $40,000 of the expense is related to the litigations that the Town has to back charge for. Frank Bankard Belleair Beach spoke regarding the buoys after not realizing that the Town agenda begins with public comments on agenda items, not during the agenda items. Gave his personal opinions on the subject matter. He states that he understands there is litigation pending. Discussed costs and says that the City of Belleair Beach is willing to pay for everything. Hel hopes that the Town reconsiders. Said that residents have come to him supporting the buoys. Mayor thanked him for coming to the meeting and explaining his position. Resident Daniel Storie spoke that several residents from Belleair Beach spoke at the last Town meeting and were absolutely against the buoys being put in Belleair Shore by Belleair Beach, not specifically about cost, but because the Belleair Beach residents felt that there were several safety issues that should be addressed in Belleair Beach before spending money on another municipality. Frank Bankard Itwas moved by Commissioner Tolbert and seconded by Vice Mayor Blume to adjourn the requesting the Commissioner to write al letter in support oft this request. Correct. disputed this.
