Meeting Minutes Wednesday April 18, 2023 Belleair Bluffs City Hall 6:00pm Town of Belleair Shore Regular Meeting of the Board of Commissioners PRESENT: Vice Mayor Blume, Commissioner Tolbert, Commissioner Storie, Attorney Regina Kardash, Sgt. Sweich, Deputy Doherty Call to order by Vice Mayor Blume 6:00pm Consideration to Approve Agenda agenda. The voice vote was unanimous. Comments from the public on any agenda item: There were no comments from the public on the agenda. Itwas moved by Commissioner Tolbert and seconded by Commissioner Storie to approve the Approval of Minutes March 29, 2023 Itv was moved by Commissioner Storie and seconded by Commissioner Tolbert to approve the minutes from the March 29, 2023 meeting. The voice vote was unanimous. Sheriff's Report The March 2023 Sheriff's report was presented to Commission by Sgt. Sweich. No Crime. Deputy activity 157 events. Total of 27 parking citations issued. Trespassing violations from previous month was explained. Just a couple violations were from the beach sand and the vacationers moved along. Vice Mayor noted 4 ordinance violations, and they were warnings. 16 were citations and the balance were warnings of parking citations. Deputy Doherty noted that there were beachgoers setting up chairs and an arch to have a wedding at 40-60 Gulf Blvd on the beach. Code Enforcement The Code Enforcement report was presented to the Commission by Deputy Daniel Doherty. 8 secondary employment details. Deputy Doherty is doing some secondary employment duties and code enforcement combined. 4 bicycles on beach contacts, 3 temporary shade structures, 2 animal contacts, 1 glass on the beach contact. It was noted that it is the homeowner responsibility to report to police when beachgoers are a problem on their property. Counsel noted that Belleair Shore has additional jurisdiction due to a grant from the state and the Town Charter, going out into the water. Treasurers Report Commission. The Clerk/Treasurer presented the Town attorney fees breakdown as requested by the The Clerk/Treasurer went over P&L, Balance Sheet and P&L, budget VS actuals for February 2023. It was moved by Commissioner Tolbert and seconded by Commissioner Storie to approve March Vice Mayor Blume noted that Funds were transferred to a money market at Regions bank as the 2023 expenditures. The voice vote was unanimous. bank was able to meet the 4% quoted by Raymond James. Counsel Report Counsel request for Shade Meeting 5:00 pm May 16, 2023 with litigation attorneys present by phone. Vice Mayor Blume asked if there is a reason to spend the money if the Town is not going to do anything. Commissioner Tolbert questioned if there has been any movement with the court and noted that maybe the Town should have a meeting. just to be updated. It was moved by Commissioner Tolbert and seconded by Commissioner Storie to hold this shade meeting at 5:00PM May 16, 2023. The voice vote was unanimous. Attorney Kardash read: Resolution 2023-03 Resolution 2023-03 Funds Transfer and appointment A RESOLUTION OF THE TOWN OF BELLEAIR SHORE FLORIDA; AUTHORIZING THE INVESTMENT OF CERTAIN MUNICIPAL FUNDS; AUTHORIZING CERTAIN PUBLIC OFFICIALS TO CONDUCT SUCH INVESTMENT TRANSACTIONS; AND PROVIDING FOR CONFLICTS SERVERABILITY AND AN EFFECTIVE DATE. Open Public Hearing 6:23PM Comments None Itwas moved by Commissioner Storie and seconded by Commissioner Tolbert to approve Resolution 2023-03. The voice vote was unanimous. Close Public Hearing 6:24pm Miscellaneous: Commissioner Storie questioned the positioning of current signage on the beaches. It was discussed as the move questioned would only be by a couple of inches. Also, homeowner personal signage was discussed. Counsel noted that there are state statutes that would define allowable signs for homeowners. Discussion was had. Commissioner Tolbert asked if he could post a no trespassing sign noting ownership to 26 feet beyond the seawall. Counsel noted that a homeowner can do that but the homeowner would have to double check with the statutory requirements and the signage is the homeowner responsibility. Vice Mayor Blume does have signs that he has made. Commissioner Tolbert noted that on each homeowner deed has the Availability of Commissioners for May 16, 2023 Special Shade Meeting and Town Meeting ownership depth past the seawall.
