Commission Meeting 11/15/2023 Meeting Minutes Wednesday November 15, 2023 Belleair Bluffs City Hall 6:00pm Town of Belleair Shore Regular Meeting of the Board of Commissioners PRESENT UPON ROLL CALL: Commissioner Tolbert, Commissioner Storie, Commissioner Niewiarowski, Mayor Schmidt, and Attorney Kardash. Absent, Vice Mayor Blume. Consideration to Approve Agenda: agenda. The voice vote was unanimous. Comments from the public on any agenda item: There were no comments from the public on the agenda. Approval of Minutes September 15, 2023 Itv was moved by Commissioner Tolbert and seconded by Commissioner Storie to approve the Itwas moved by Commissioner Tolbert and seconded by Commissioner Niewiarowski to approve the minutes from the September 15, 2023, meeting. The voice vote was unanimous. No report was received. Deputy Dougherty will get in touch with Captain Lanier for the Sheriff's Report information. Code Enforcement Deputy Dougherty stated the vacant lot at 660 has started cleanup and is pretty much cleared. After the hurricane he found a tire on the beach in front of a home, which the owner removed. A recent demonstration was held protesting the Smoking Ban Ordinance. The leader was issued a citation. A copy of the citation was presented to the Town Attorney. Treasurers Report Interim Clerk/Treasurer, Sandra Rowalnd went over the report with the Commission. After discussion it was moved by Commissioner Tolbert and seconded by Commissioner Storie to approve the treasurers report. The voice vote was unanimous. Counsel Report Attorney Kardash reviewed with the Commission the need to change the qualifying dates for the election. The qualifying dates per the town code would be two days after the date the Supervisor of Elections has for ballot language deadline. The temporary ordinance for this change will be discussed later in the meeting for the Commission to adopt on First Reading. The new qualifying dates for the Town's election will be opening December 10th and closing December 19, 2023. Attorney Kardash spoke with the Commission about the new Form 6 that elected officials are required to fill out as of. January 1, 2024. The form when filled out will need to! be uploaded directly 1 Commission Meeting 11/15/2023 tot the Commission on Ethics. New email addresses will need to be created for the Commission. Any elected official must decide by December 31st, 2023, if they will be resigning. Those who resign by December 31st will not fill out Form 6, they will fill out Form 1F. Discussion ensued on what needs to be disclosed on Form 6. Mayor Schmidt will bring this before the BIG-C for At this time Chief Davidson addressed the Commission reporting that they have received a grant from FEMA for 1.1 million, this money is being used to hire new Fire Fighters and Paramedics. An advertisement has gone out for a new Fire Station with EOC facilities. The purchase of the property for the station should bet final in March 2024. He also will be going to Legislation tol lobby discussion. for 7 million dollars to upgrade Station 27. First Reading Ordinance 2023-02 = Smoking Ban Public Hearing Attorney Kardash read Ordinance 2023-02 by title. Mayor Schmidt opened the Public Hearing. Mayor Schmidt asked ift there were any comments from the audience, none were brought forward. Itwas asked if this ordinance included marijuana. Attorney Kardash stated she would need to investigate the Constitutional Provision regarding medical marijuana. Commission Tolbert would like this provision added and amend the ordinance. There being no further discussion, Commission Tolbert moved to approve the Ordinance on first reading as amended, seconded by Commissioner Niewiarowski. The voice vote was unanimous. First Reading Ordinance 2023-05 Amending Election Ballot Ordinance Attorney Kardash read Ordinance 2023-05 by title in both English and Spanish. Mayor Schmidt asked if there were any comments from the audience. None were brought forward. Commissioner Storie moved to adopt Ordinance 2023-05 on first reading, seconded by Commissioner Niewiarowski. The voice vote was unanimous. Budget Amendment Resolution 2023-12 Attorney Kardash stated she would like to table this item, as she was not clear on what the amendment was. Update on Signage Mayor Schmidt stated he thought they were waiting for the Smoking Ban ordinance to be completed. Commissioner Tolbert stated, he does not want to hold up the signage; he explained to the Commission he had seen where another municipality added a QR code onto their signs that takes them right to the town's webpage where information can be obtained. In the future he would like to possibly add the code to the signs. Miscellaneous Mayor Schmidt spoke toi the Commission regarding the beach restoration that Pinellas County is doing. Residents who wish to participate are required to sign a Temporary Easement Agreement, which is good for one year. This is not the normal beach renourishment that has been done in the past. Pinellas County are creating dunes and planting sea oats on top of the dunes. In speaking with citizens from Indian Rocks Beach, they are very unhappy and feel like they have been misled. The dunes are six to ten feet high in front of their properties and they do not have easy access to the beach. Sandra Rowland was hired to filli in until one was secured. At this time Mayor Schmidti introduced Mary Palmer, who has shown interest in the job. Mayor Schmidt stated the start date would be December 1, 2023. Commissioner Tolbert moved to hire Mary Palmer as Town Clerk with a start date of December 1, 2023, seconded by Commissioner Storie.
