AND TOWN COUNCIL MINUTES ASTA EMERGENCY SESSION AUGUST 29, 2023 TOWN HALL Having been duly advertised as required by law, Mayor Mack called the Emergency Session meeting to order at 5:36pm and led the Pledge of Allegiance. Members Present: Mitchell Mack, Mayor Stephen Cross, Vice-Mayor Gayle Sikkema Zane Teeters Absent: Orita Issartel Staff Present: Graham Wells, Town Clerk Wally Hoagland, Police Chief Roll Call was performed, and it was determined that a quorum was present. CITIZENS QUESTIONS AND COMMENT There were no questions or comments. NEWI BUSINESS ASTATULA. RESOLUTION 2023-19 DECLARING A STATE OF EMERGENCY FOR THE TOWN OF ARESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF ASTATULA IN LAKE COUNTY, FLORIDA, DECLARING A STATE OF EMERGENCY BECAUSE OF HURRICANE IAN; AUTHORIZING AND DIRECTING THE MAYOR TO TAKE WHATEVER PRUDENT ACTIONS NECESSARY TO PROTECT THE HEALTH, SAFETY AND WELFARE OF THE CITIZENS OF THE TOWN PURSUANTTOTHIS DECLARATION; PROVIDING FOR AN EFFECTIVE DATE. Pursuant to Section 252.38(3)(a) of the Florida Statutes, the Legislature has empowered the Town to declare a state of local emergency and to waive the procedures and formalities otherwise required by law pertaining to: A. Performance of public work and taking whatever prudent action is necessary to ensure thel health, safety, and welfare oft the community; Employment of permanent and temporary workers; Enteringi into contracts; Incurring obligations; Utilization of volunteer workers; F. Appropriation and expenditure of public funds. The Mayor is authorized and directed to take whatever prudent actions that may be necessary toj protect thel health, safety, and welfare oft the citizens and residents oft the Town while the state ofe emergency exists, including but not limited to the following: A. To order evacuations; B. To declare curfews; C. To declare certain areas oft the Town accessible only under specified conditions; D. To prohibit the sale of merchandise, goods or services at more than the normal average F. To: suspend or regulate the sale of alcoholic beverages, explosive or combustibles; retail price; E. Toi implement emergency procurement procedures; G. To restrict water usage; H. Tos suspend local building regulations; To ration fuel, ice and other essentials; Tot temporarily modify personnel policies; and, service policies set by ordinance or resolution. I. J. K. Tot temporarily suspend or modify utility rates, fees, charges, bulling termination, and/or Vice-Mayor Cross made a motion to read the resolution by title only; seconded by Councilman MOTION by Vice-Mayor Cross to approve Resolution 2023-19; SECONDED by Teeters and unanimously approved. The Mayor read the title. Councilwoman Sikkema. A Roll Call vote was taken.
