MINUTES OF A COUNCILI MEETING APRIL18.2017 Thel Hollywood Park City Council met in a regular session on April 18, 2017 at 7:00p.m. in Town Hall. Notice was posted in accordance with the Texas Open Meeting Laws. Mayor Chris Fails called the meeting to order with the following Council Members present: Steve Phillips, Debbie Trueman, David Neugebauer, Steve Phillips and Cullen Schwarz. Also present: Fire Chief- John Butrico, Police Chief- Shad Prichard, City Treasurer-Kristina Marsico, City Attorney- Michael Brenan and City Secretary-Janice Alamia. ANNOUNCEMENIS MAYOR AND CITY EMPLOYEES: 1. Fire Report: Chief Butrico gave his monthly report to the Council. He spoke ofa call they received concerning a choking resident. The resident was transported to the hospital because oft the swift thinking ofl Police Officer Diana Salinas, Fire Lieutenant Tim Zelenak, Fire Engineer Travis Granzin, Firefighters Vince Gonzales and Spencer Thorpe. 2. Police Report: Chief Prichard gave his annual report to the Council. He is still tackling the cut through traffic and speeding through Hollywood Park. The annual drug take back 3. Financial report: City Treasurer, Kristina Marsico stated that 50% ofthe budget had been completed and our revenues are at 73.36% of the budget while expenditures are at 4. City Secretary report: City Secretary, Janice Alamia stated the April Business oft the Month is the Bagel Factory. May 7th will be the dedication of Voigt Park. 5. City Attorney report: Attorney Mike Brennan stated that the Mayor appointed a new Public Works Director recently. He went on to state that in his opinion the Mayor is the Chief Administrative Officer oft the City and he has that authority. Because ofthe increased responsibilities it is appropriate to have this as ai full time position rather than piggy back position for another city official. He advised the Mayor that he had the authority to fill that position. He went on to: mention that later in the meeting there will be a closed session which will involve personnel discussion. Councilman Phillips made a motion to approve the Consent Agenda in its entirety. Councilman Neugebauer seconded the motion. The motion passed unanimously. CITIZEN PARTICIPATION: Stan Hartzler/106 Casa del Vista: Ball moss inhibits the circulation of tree sapi robing the tree ofi its own nutrients. Iask the City Council to encourage discussion on this issue. 1m CLOSE THE REGULAR MEETING Mayor Fails closed the regular meeting to go into Executive Session at 7:18pm so the City Council could convene in a closed session to discuss the position ofthe Public Works Director, including employment, duties and discipline, as authorized by Section 551.074 oft the Texas Government Code. OPENTHE REGULAR MEETING Mayor Fails opened the regular meeting again at 7:57pm OLD BUSINESS: None NEW BUSINESS: 1. Discuss /Take Possible Action to approve an Ordinance Amending the Budget ofthe Town ofHollywood Park for the 2017 Fiscal Year by adjusting various Public Works accounts. a. Citizen Comments: Sudie Sartor/505 El Portal: Ms. Sartor stated wel havel heard from thel Mayor and City Attorney that stated this was all legal but this is not what this isa all about. We had an employee that was here for 25 years that left 7 months short of his planned retirement because he was not comfortable here anymore. She stated she has nothing against Mr. Cowan but this should have been an open discussion with the Council. She had not heard any complaints from anyone before we hired a new Public Works Director. 2 years ago during a budget session the Council decided to give all Department Heads the same pay which was over $70,000. Is this new employee going to be given the same amount of pay without having the Tonya Cummings/129 Grand Oak: She feels all oft the Council should have been aware in advance and there should be more transparency. Weedge Henderson/303 Rua Del Matta: Iam concerned about our taxes and will this affect our taxes, because I don't know where we are going to get Michael Howe/124 Cueva Lane: Why didn't we post the job SO residents could apply? Ithink that is why people get a little nervous. b. Discussion: Councilwoman Trueman stated she didn't like the way this was handled, It think we should have been approached before it happened. Councilman Murphy stated there were staffing and budget questions discussed and raised in budget meetings with the committee for the Voigt Center and operations. The was an issue on whether it would be a pool focused person or venue focused person or aj public works focused person and the money we knew would be needed. We have invited the public to come to budget meetings to work on budgets going forward, last month. Iam pleased Kelly is here and we found someone that appears very qualified to fill the position. Councilman Neugebauer stated we needed to hand over Voigt Park to someone who was going to take it over and there was ai time crunch. He went on to say that Chief Butrico did not same thing to do. the money. 2m have the time to do this jobi in addition to the jobl he already has. Councilman Phillips stated that it has been said that we needed toj post this job to ensure we hired the best qualified person. He stated who is to say we did not. Councilman Trueman stated that was not the point. Councilman Murphy made the motion and Councilman Phillips seconded. The motion passed 41 to 1 with Councilman Trueman voting nay. 2. Discuss Take Possible Action to approve an Ordinance Amending Chapter 70. Traffic and Motor Vehicles, oft the Code of Ordinances by adopting a new Article IV Regulating the Use ofHand Held Mobile Communication Devices While Driving. a. Citizen Comments: Sudie Sartor/505 El Portal: Texas already has a law concerning distracted driving. If that is not sufficient we need to add dogs in drivers laps, dogs loose in their cars, putting on makeup, eating, reading and babies sitting in drivers laps in golf carts. b. Discussion: Mayor Fails stated we should have the same ban on texting and driving in Hollywood Park that you do when you go outside ofHollywood Park. He went on to say we currently do not have a texting ban in Hollywood Park. The Mayor said he heard residents asking about this at the "Meet the Candidates" gathering. Councilman Schwarz stated he did not agree with Ms. Sartors comments and we do not need to add to this but he is in favor oft the texting ban. Councilman Murphy agreed. Chief Prichard agreed with this Ordinance. Councilman Phillips made the motion and Councilman Neugebauer seconded. The motion passed unanimously. 3. Discuss /Take Possible Action to approve an Ordinance Amending Chapter 70. Traffic and Motor Vehicles. oft the Code of Ordinances for the Town of Hollywood Park. Texas by Expanding Authority of the ChiefofPolice for the Issuance of Motorized Cart Permits and Correcting a Section Reference in Section 70-81. b. Discussion: Mayor Fails stated some of the side by side Mules can go pretty fast. He asked the City Attorney how can we keep that kind of vehicle off the streets of Hollywood Park. Chief Prichard will have subjective authority to give a permit or not based on the speed or noise level oft the golf fcart. A permit is for 2 years. Councilman Murphy made the motion and Councilman Schwarz seconded. The a. Citizen Comments: None motion passed unanimously. 4. Discuss/Take Possible Action to approve reimbursement of expenditures for Hotel Fund in the amount of$23.200 a. Citizen Comments: None b. Discussion: Mayor Fails stated this are the restricted funds that can be used to put "heads in beds" in our local hotel. Thisi is reimbursing the hotel for their marketing expenditures. Councilman Phillips made the motion and Councilman Neugebauer seconded the motion. The motion passed unanimously. 3m ADJOURNMENT: There being no other business, Mayor Fails adjourned the meeting at 8:23pm.
