MINUTESOF Al REGULARCOUNCIL MEETING JUNE 19,2018 Thel Hollywood Park City Council met in a regular session on June 19,2018 at 7:00p.m. in Town Mayor Chris Murphy called the meeting to order with the following Council Members present: Mike Howe, Debbie Trueman, Scott Bailey, Oscar Villarreal and Delaine Hall. Also present: Fire Chief-John Butrico, Police Lieutenant-Sam Williams, Public Works Director-Kelly Cowan, City Treasurer-Anita Moreno Navarro, City Attorney-Mike Brenan and City Secretary-Janice Hall. Notice was posted in accordance with the Texas Open Meeting Laws. Alamia. Absent: Chief Shad Prichard. PRESENTATIONS: None ANNOUNCEMENTS, MAYOR AND CITY EMPLOYEES: 1. Fire Report: Chief Butrico presented his report for the month to the Council. Average response time for all calls was 02:56 MM:SS. There were 26 Hollywood Park calls, 21 for Bexar Bulverde, 5 for Shavano Park and 1 to "other" for a total of53 calls for last month. 2. Police Report: ChiefPrichard presented his report for the month. There were 367 total calls 3. Public Works Report: Public Works Director, Kelly Cowan stated there were 31 cases for Code Compliance in the past month. There were 14 events at the Voigt Center in the past 4. Financial Report: City Treasurer, Anita Navarro stated the City has completed 66.67% oft the 5. City Secretary Report: City Secretary, Janice Alamia announced the June Business oft the Month is the Texas Weight Loss Center. Court activity had 229 new cases filed for May which are almost double the amount from the previous year; and there were 110 permits filed, also up significantly from last year. Two new court and permit clerks were announced 7. Mayors report: Mayor Murphy stated the City Secretary found some information in which the Town ofHollywood Park will be receiving funds from the Texas Department of Transportation because ofaj project the city was involved in when Ruby Weinholtz was Mayor. Apparently Hollywood Park contributed $9,000 at that time and we will be receiving arefund for the unused amount in the next 601 to 90 days. The Mayor stated he had a productive meeting with Clear Channel for the possibility to convert an existing static billboard into a digital billboard on Mecca and 281. Councilman Bailey seconded the motion. The motion passed unanimously. CITIZEPARTICIPATION: Linda Phillips/4 Ashford Glen: Ms. Phillips stated she was upset by the Executive Session currently on the Agenda and wanted tol know why Ms. Alamia was being harassed in this manner. She stated the city has already lost one employee in Finance because of Council harassment and now the Council is targeting another employee. Sudie Sartor/505 El Portal: Concerned about safety issues at pool. No one seems to be at desk for sign in. 2 guards were in their chairs but there seemed to be over 200 people inside the pool gates. This is an accident waiting tol happen. Needs to be limit ofage Weedge Henderson/303 Rua De Matta: Issue with Code Compliance based on notice she received. She stated the City Secretary, Janice Alamia is very professional and has been placed on who can bei in baby pool. with Hollywood Park for 14 years; she urged the Council to keep her. OLDBUSINESS: 1. Discuss/Take Possible Action to approve 2018 Budget Calendar.[A. Navarro] b. Discussion: Councilwoman Trueman made the motion to approve and Councilman Villarreal seconded. The motion passed unanimously. a. Citizen Comments: None EXECUTIVE SESSION Mayor Murphy closed the regular meeting at 7:37pm to go into Executive Session. The Town ofHollywood Park City Council will convene into an executive/closed session as authorized by Section 551.071(1) oft the Texas Government Code to consult with the City Attorney concerning contemplated litigation regarding a ban on solicitors. Mayor Murphy opened the regular meeting at 8:19pm. NEW BUSINESS: 1. Discuss/Take Possible Action concerning revision oft the Town'sh ban on solicitors. [Mayor] a. Citizen Comments: None Discussion: City Attorney, Michael Brenan stated the Town ofHollywood Park currently has an Ordinance which basically prohibits peddlers and solicitors from 2m going door to door selling goods and products. The city has received a demand from a law firm asserting we abandon that kind ofblanket ban because it is unconstitutional. Mr. Brenan agreed so he developed an ordinance based ona prototype that TML has worked on for several years. Councilman Bailey made the motion and Councilwoman Trueman seconded. Discuss/Take Possible Action to approve a Deer Committee vote to move $3,000 from line item# 590.479[deer mgmt supplies] to line item# 590.101[deer manager seconded. Citizen Comments: LuAnn Montgomery/304 El Portal: Ms Montgomery clarified that this reallocation is to assist the Deer Manager to help control our predator population. She also stated as the President oft the Deer Committee she did not think the committee would be where it is right not ifit were not for the City Secretary, Janice Alamia. seconded. The motion passed unanimously. b. Discussion: Councilman Villarreal made the motion and Councilwoman Trueman 4. Discuss/Take Possible Action concerning Donella Street Project phase II. [Mayor] b. Discussion: Mayor Murphy tabled this item until further notice. a. Citizen Comments: None 5. Discuss/Take Possible Action to set a guest limit for pool pass purchasers to prevent b. Discussion: Mayor Murphy stated there was an issue at the pool recently where a pool pass member had a middle school pool party for about 150 people as guests with no prior warning to our pool staff. This created a lot of problems. Kelly Cowan, Public Works Director suggested we put a limit on the number of guests a season pass holder can bring to the pool. The Council discussed the desire to have each season pool pass member have the ability to bring 2 guests only to the pool per visit. This would be 2 guests for each wrist band holder or 2 guests for each season pass pool member that has a card membership. Councilwoman Trueman made the motion for the 2 guest limit and Councilman Bailey seconded pool staffing challenges. [Mayor] a. Citizen Comments: the motion. The motion passed unanimously. 3m EXECUTIVE SESSION Mayor Murphy read the Executive Session and then City Secretary, Janice Alamia requested per her right, that she would like tol have any Executive Session discussion in Open Session as per the Open Meetings Act. Mayor Murphy agreed. The Town ofHollywood Park City Council will convene into an executive/closed session as authorized by Section 551.071(1) ofthe Texas Government Code to consult with the City. Attorney concerning the duties oft the City Secretary. Mayor Murphy stated the purpose of the Executive Session was to discuss issues that Councilwoman Trueman stated she was the one who asked for the Executive Session since the only time the Council can talk about a topic is when they are all together legally. She stated in early May she received a call from an employee stating they did not have insurance coverage and this was during the time when the former Mayor Chris Fails was checked out because we were getting ready to go to a new. Mayor. Councilwoman Trueman stated 2 days later she received a call from another employee stating she did not have dental insurance. She stated there were payments not made for March and April and when an email finally came out concerning the situation from the Mayor at the time, Chris Fails, it was very white washed and not Mayor Murphy stated that since he has been Mayor he has dug in and stated there were mistakes made and now they are corrected and he has spoken to all insurance vendors and we are in good standing. He went on to say that Administration is finally fully staffed for the first time this year and he isi impressed with the work that gets Ms. Alamia spoke to the Council stating that she did make ai mistake and now that the Admin department is now fully staffed there is a system of checks and balances sO Councilman Bailey stated he does not see a real problem here and there was ai mistake Councilman Villarreal stated he was made aware that 2 payrolls were missed last year. Ms. Alamia stated she was not aware of any payrolls where employees did not get paid last year. Councilman Villarreal stated they were late. Ms. Alamia asked if he would provide the dates sO she could check because there was aj period when we had an employee for a short time in Finance who is no longer with us and it could have been during that time. Councilman Villarreal asked "for the record" what Ms. Alamia'sir involvement was in former Mayor Chris Fails campaign. He asked her if she assisted him with his campaign during city hours or any paid hours. Ms. Alamia stated she did not. Councilman Villarreal asked if any ofN Ms. Alamia's staff campaigned for former Mayor Chris Fails. Ms. Alamia stated she was not aware of anyone on her staff that did. Councilman Villarreal stated it was brought to his attention that this had occurred. He also asked ift there was someone in the office that knows how to do workers compensation. Ms. Alamia stated that yes, Jessica Johnson Councilman Howe asked Ms. Alamia why she thought she was being terminated. Ms. Alamia stated people had informed her that a Councilmember had stated that they took place ini the first and second quarter prior to May 15th. very detailed. done in that department. these type of errors will not be reoccurring. but now we need to move on. in Human Resources handles all Workers Comp cases. were trying to get consensus on the Council for her termination. 4m Councilman Howe stated he seconded the request for an Executive Session because this was the forum in which he could ask questions. Ms. Alamia stated she understood but wondered why no one: simply asked the current Mayor, since he has become very involved in the Admin day to day processes. Mayor Murphy stated he is very impressed with the work that has been done. He stated we went through a rough patch and now we will be moving on. 6. Discuss/Take Possible Action on a proposed Ordinance concerning communication between Administration Department and Mayor/Council on issues of financial integrity. [Mayor] a. Citizen Comments: b.
