TOWN OF GEORGETOWN BOARD OF SELECTMEN July 9, 2024 Regular scheduled meeting minutes CALLTOORDERPIEDGE OF ALLEGIANCE The Georgetown Board of Selectmen held a work session on the Multi-Jurisdictional Housing Authority at 5:00 p.m. before the regular scheduled meeting on Tuesday, July 9, 2024. The meeting was held at the Georgetown Town Hall, 404 6th St. with the option to join virtually. Police Judge Kelsey called the regular meeting to order at 6:01 p.m. Police Judge Kelsey took the roll call, Selectmen answering in-person were. Selectman Connell made a motion to approve the July 9,2024, agenda as amended, second by Selectman Goscinski, and the motion passed with unanimous vote. NEW ANDUNFINISHED BUSINESS Amendment.Police Judge Kelsey's statement for the 4thofJuly Mark Reynolds, Event Organizer for the 4thofJuly BBQ, requested Police Judge Kelsey make the following statement at the event, but the microphone was not working well, SO Police Judge Kelsey made the following statement again during the meeting: Mr. Reynolds thanked all ofthe volunteers oft the BBQ and mentioned that 25-year Pit Boss volunteer, Hugh Anderson, has passed away. Also, past pit bosses Scott Innis, Don Weber, Doc Bailey and John Krueger have passed away and all will be missed. 1. Police Report - Acting Police Chief Gaskins Gaskins' report was included in the Board'sa agenda packets. It included a graph oft traffic incidents, citizen assist/service calls, assist fire/medical, motor vehicle accidents and verified alarms. Gaskins stated that every call isi included ini the report. He also reported that he has been in contact with Jeffcom and they told him they have 361 lines for 911 calls and ai maximum of20 employees to answer the calls, they are short-staffed. The emergency 911 calls rollover to Denver and those calls still must go through Jeffcom to be dispatched. Jeffcom will be splitting fire and EMS: from the law side which will help to alleviate the workload for the dispatcher. Gaskins explained that this is good news and will alleviate a lot ofissues such as that the need to Gaskins also reported that Kim Hill, Administrative Assistant Town of Georgetown Police Department /1 Municipal Court Clerk Town of Georgetown has been continuing her training to keep up her knowledge for the position and is now Georgetown's CCIC coordinator along with other certifications. The Georgetown Police Department has its own ORI and isi independent of Gaskins stated that 4th ofJuly went well, he had enough Rangers to assist him, and didn'thave any people on the parade route before the parade began which was a first for him. 2. Ordinance #5 (Series 2024) Public Hearing and Second Reading AN ORDINANCE ADOPTING AN NEW SECTION 5.16 OF THE GEORGETOWN MUNICIPAL CODE TO. ALLOW COMMUNAL OUTDOOR DINING AREAS Police Judge Kelsey opened the public hearing at 6:25 p.m. There were no public comments Kazia Hart explained that she talked to Sadie Schultz, Director oft the Idaho Springs Chamber of Commerce, and Ms. Schultz attended the July 3, 2024, Business Promotion Commission meeting and talked about the Common Outdoor Dining Area (CODA) in Idaho Springs. Ms. Hart pointed out that the way the Idaho Springs CODA is operating is like what the Business switch to multiple channels during an incident. the Sheriff'sl Department. made. Page 2 7-9-24 Promotion Commission has been talking about having in Georgetown. Ms. Hart stated they have created Encroachment Agreements for the non-liquor licensed businesses that want to expand their business into the CODA area, created pedestrian byways that allows people to use the crosswalks during special events with an open container, allow people to go into businesses with an open container ift the business allows it, and during special events, customers can leave the designated expanded area and go into the CODA area. In the CODA area the business must be identified where the open container came from. This could be with a sticker, special cups, or Selectman Smith mentioned that Ms. Schultz told the Business Promotion Commission that the biggest problem is informing the liquor licensed establishments and its customers that they are allowed to take their open containers into the CODA area on Miner St. beyond the restaurant's Ms. Hart explained that Ms. Schultz showed her that for Idaho Springs, the CODA is active ona a permanent basis, and the participating non-liquor-licensed businesses have Encroachment Agreements with the city to bei in the right-of-way. Ms. Schultz explained that there can be multiple mini-CODA areas and that the boundary map is submitted to the State. Ms. Hart said that Ms. Schultz will be sending documents including Idaho Spring'sCODA ordinance, operational policies, and the application process that the town can use as ag guide for Police. Judge Kelsey suggested incorporating some oft the definitions that apply from Ordinance Town Attorney, Gerald Dahl, suggested tabling the ordinance until after the Ordinance #9 (Series 2024); public hearing sO when the definitions are included in this ordinance the statement Dahl stated in the state statutes regarding CODA, it lists regulations for supervision and control, security and control plans, removal of alcohol from the CODA area, insurance requirements, etc. Selectman Smith asked Mr. Dahl for his recommendation ofhow to allow alcohol in a town park, the Encroachment Agreements parts for CODA, and the amount oft time needed to incorporate those into the process. A Police Judge Kelsey opened the public hearing at 6:51 p.m. There were no public comments Mr. Dahl explained that on page 10, Section 2, Section 17.16.042 was amended to allow the Historic Commercial District to allow eating and drinking service in a CODA or a Common Consumption Area within an Entertainment District as authorized by the Board of Selectmen. Police Judge Kelsey closed the public hearing at 7:05 p.m. 4.Ordinance #8 (Series 2024) Public Hearing and Second Reading AN ORDINANCE AMENDING CHAPER 17.28 OF THE GEORGETOWN MUNICIPAL CODE CONCERNING SUBDIVISION PLAT AMENDMENTS AND REVISINGANDRELOCATINGTHE PROCEDURE TORADMINISTRATVEPAT CORRECTIONS Police Judge Kelsey opened the public hearing at 7:08 p.m. Mr. Dahl explained that the addition to the types of subdivisions, is #4 Subdivision amendments and will be section 17.28.070 in the Georgetown Municipal Code. Ben Cheang, owner of the deed-restricted townhome at 2162 Bighorn Trail, appeared in-person and stated that he was told that his townhome would be managed by the Microtel Hotel, but instead is being managed by a 3d party management company. This management company charges each property owner in the HOA a $395 monthly fee. Mr. Cheang mentioned that he would like to rent out his townhome long-term, but since Mr. Dahl stated that the deed-restricted townhomes were created to satisfy the 50% commercial/5096 residential requirement for the Gateway Mixed-Use zoning district, but now that requirement is not needed due to the open space meeting the requirement. itis deed-restricted, it prohibits him from doing that. Amending Jalisco's Construction Agreement from 10%1 to 5%, which is the state requirement. The withholding percentage in the. STAFF ITEMS Assistant Town Administrator's update Ms. Hart announced that at the August 22, 2024, Design Review Commission meeting, they will have a guest that will present information on tax credits for historical structures. Town Administrator's Report and Task List Sheriff's driveway on 6th St, will be fixed soon. removed it, but it reappears soon after. 7thSt. bridge- materials should arrive next week. Skyline Rd. will be cleaned next week. There is a graffiti problem in town especially at the basketball court. Staff! has ESI will start paving tomorrow on Main St. from 14th St. to Clear Creek Dr. The project at 11th St. and Main St. in ongoing. Three service lines are involved, and the main line needs to extended and two manholes installed. The Gateway Argentine North St. project will be from July 8, 2024- October 20, Stage 1 Fire Ban in effect for Clear Creek County and Georgetown follow the count SO also in effect in town. The only difference is that Georgetown permits portable fireplaçes where the County does not at this level ofa fire ban. Mr. Keuroglian mentioned that the committee had its first meeting. Ms. Yobski announced that the Business Promotion Commission is holding a Business Mixer Wednesday, July 10, 2024, at the Old School, 809 Taos St. 4:00 p.m.-7:00 p.m. EXECUTIVESESSION Selectman Goscinski made a motion to go into Executive session, under CRS 24-6-402(4)() with the Town Attorney, Town Administrator and appropriate stafft to receive legal advice and instruct negotiators for a personnel matter: review applications for filing the Town Police Chief vacancy second by Selectman Smith and the motion passed unanimously. The Executive Session commenced at 7:49 p.m. and concluded at 8:51 p.m. The Board returned to the regular scheduled open meeting at 8:52 p.m. Page 6 7-9-24 Selectman Connell made a motion to direct the Town Administrator to request the KRW consultant to conduct screening of police chiefapplicants and to provide a list of finalists for the Board to consider in the finalist interview process.
