BACKGROUND: Ohio Revised Code 1520.02 allows the Director of ODNR to grant the state's interest in any canal lands to be transferred to local governments based upon the local governments needs and economic development potential with respect to recreational, ecological and historical value of the canal lands. The City of Troy owns land near the southeast corner of the Mulberry/Race Street intersection that is contiguous to land owned by the State of Ohio that was a part of the Miami and Erie Canal. Staff has worked with ODNR to obtain ownership of approximately 0512 acres of land once used as part oft the Miami and Erie Canal. Thes subject land is located at the southeast corner oft thel Mulberry/Race Street ODNR has prepared an Agreement To Transfer Canal Lands, which has been reviewed by the City Law Director, to transfer ownership of approximately 0512 acres of abandoned Miamiand Erie Canal intersection. Troy Codified Ordinance Chapter 375 Bikeways was adoptedi in 1974 when thei firstr mile oft traili in the Great Miami Recreational Trail was constructed. Since the passage oft this ordinance, manyy updates and changes have occurred to promote and provide additional use oft the Great Miami Recreational Trail, along with other facilities such as bike lanes, and shared-use paths in the city, in the region, and nationally. In2 2018, Troy's Codified Ordinances were amended to reflect changes in the Ohio Revised Code (ORC) related to electric bicycles. With the continued improvement and implementation of the City's Complete Streets Policy, and newt types ofr micromobility devices (e.g., e-bikes, electric scooters, electric skateboards, etc.) it is appropriate to amend Chapter 375 to comply with the ORC and traffic laws regarding the use of The proposed amendments to Chapter 375 provide a more cohesive and updated set of standards that these types of devices on public ways. align with other Troy Codified Ordinance chapters and the Ohio Revised Code. Proposed amendments are regarding: Amend the title of Chapter 3751 from Bikeways to Bike Lanes and Shared-Use Paths; Amend Section 375.01 Definitions, to add the definitions of Class 1,2, and 3 Electric Bicycles, Low- speed micromobility devices, and Shared-use path, to reflect the ORC; Amend Section 375.02 Designated Paths, Lanes and Areas, to authorize the Director of Public Service and Safety to designate and keep record of new bike lanes and shared-use paths as an administrative process, and to create standards for the use of bike lanes and shared-use paths that arei inl line with current policies and practices of Ohio DOT and the Federal Highway Administration; Amend Section 375.03 Permitted Vehicles, to define specifically the vehicles that are allowed on Amend Section 375.04 Posting, regarding the required posting of designated bike lanes or shared- Amend Section 375.99 Penalty, changing it from a minor misdemeanor to a fourth-degree bike lanes and shared-use paths to coincide with the Ohio Revised Code; use path; and misdemeanor. Titterington DATE: February 22, 2024 7 SUBJECT: EXTENDING MORATORIUM ON APPLICATIONS FOR SPECIFIC USES IN THE DOWNTOWN RIVERFRONT OVERLAY (DR-O) DISTRICT BACKGROUND: City Council approved Ordinance No. 0-44-2023, a moratorium on specific uses in the Downtown Riverfront Overlay (DR-O) District. This moratorium will expire on May 3, 2024. Planning Staff requested an additional ninety-day moratorium on specific uses in the DR-O. This will assure that there is sufficient time to present proposed changes The DR-O District was established in 2018 from a recommendation made by the Troy Downtown Riverfront Study. The DR-O District is designed to promote revitalization of Downtown Troy and nearby riverfront areas by providing an optional alternative to the regulations of the various underlying conventional Zoning Districts. It is intended to permit alteration and adaptive reuse of existing buildings and redevelopment of vacant lands in accordance with a coordinated plan which can be designed with greater flexibility and, consequently, more creative and imaginative The DR-O Downtown Riverfront Overlay encompasses 12 zoning districts; the PD Planned Development District, Wellhead Operation District, A-R Agricultural Residential District, R-5 Single Family Residential District, R-6 Two Family Residential District, R-7 Multiple Family Residential District, OR-1 Office Residence District, OC-1 Office Commercial District, B-1 Local Retail District, B-2 General Business District, B-3 Central Business District, and M-2 Staff is requesting a moratorium on specific uses in the DR-O District that may be non-desirable uses in the district.
