PRESENTATION: AFair Housing Presentation was provided by. John Zimmerman, Vice-President of Miami Valley Fair Housing Center, and Jacqueline Tyler, City of Troy Management Analyst in the Development Department. Mr. Zimmerman explained that the mission of Fair Housing is to eliminate housing discrimination, promote economic opportunity, and achieve diverse, inclusive communities by leading the nation in the enforcement, administration, development, and public understanding of federal fair housing policies and laws. He further commented that the work to eliminate housing discrimination for protected categories includes those currently in the uniform service but does not currently include working on behalf of veterans; 60% of complaints are by those with disabilities; much of the worki is in providing education; and he enjoys an excellent working relationship with Troy City Staff. COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY: Mr. Titterington commented that: -A Streetscape Concept discussion meeting will be held on April 17, 6:00 pm, on the 3rd floor of the Redmen's Building, and the public is encouraged to attend, hear thei information, and provide feedback. -Regarding street sweeping, the City uses a contractor that sweeps the entire City approximately every month, and this is more cost effective than providing the service in-house. COMMENTS OF MEMBERS OF COUNCIL: Mr. Severt noted that The Troy Foundation kicked off their 100th Anniversary celebration on. April 15 and has planned -Ben Sutherly, President of the Troy Historic Preservation Alliance (THPA), 1101 % W. Main Street, provided a status update on the stabilization of the IOOF Building (112-118 W. Main Street). He commented that THPA is 15 days from the deadline for stabilization and expects the work to be completed ahead of schedule; some oft the scaffolding has been removed; $816,184 has been ledged plus al loani is available; THPA does not believe the Cityl has answered all the questions asked; THPA believes it has honored the Settlement. The existing twenty-year agreement between the City, the County and West Milton has expired. The new proposed agreement is basically the same as the expired agreement, other than some minor updating requested by all parties. The new agreementi increases the average flow rate from one million gallons per day (MGD) to 1.1 MGD (for which the City has the capacity), and will bet for 30 years based on an initial five-year agreement that can auto renew for three additional five-year periods. The review at five-year increments will provide for more routine review of any oft the terms. This meeting was also attended by Mayor Oda, Council Member Whidden, thel Director of Public Service and Safety, citizens, and members oft the City On December 4, 2023, Council approved legislation establishing a 180-day moratorium on the granting of any permits allowing Adult Use Cannabis Operators to establish within the City of Troy. This was in response to the State of Ohio enacting laws concerning cannabis use and operators that were effective December 7, 2023. ORC Section 3780.25 allows municipalities to prohibit and/or limit the location of Adult Use Cannabis Operators. So that staff could review and make recommendations on this issue to conform tot the City's goals of providing adequate regulations, the moratorium was enacted. At this time, sufficient information has not been received by the City to evaluate needed zoning changes or regulations in this regard. City Council adopted a moratorium on specific uses int the Downtown Riverfront Overlay (DR-0) as per 0-44- 2023 to allow staff to perform analysis on the uses ini the DR-O.Thel DR-O encompasses twelve (12)zoning districts; the PD Planned Development District, Wellhead Operation District, A-R Agricultural Residentlal District, R-5 Single Family Residential District, the R-6 Two Family Residential District, the R-7 Multiple Family Residential District, OR-1Office Residence District, OC-1 Office Commercial District, B-1 Local Retail District, B-2 General Business District, B-3 Central Business District, and the M-2 Light Industrial District. Staff Analysis: When analyzing thet twelve (12) zoning districts as a whole, it was determined that there are undesirable uses that are currently permitted by right ini thel DR-O. The B-1 Local Retail District and the B-2 General Business District represent only 3.8% or about! 52.58 acres of the entire acreage oft the DR-O and reflect one of the main business support areas to the downtown. The intent of the DR-O is intended to permit alteration and adaptive reuse of existing buildings, and redevelopment of vacant lands, in accordance with a coordinated plan which can be designed with greater flexibility, and consequently, more creative and imaginative redevelopment ofi this closely built and oldest area of Troy. Many of the permitted uses int the underlying districts do not support the stated intent of the DR-0. Additionally, these uses do not meet today's design standards of the Historic Preservation Overlay as well as safe maneuverability of PROPOSAL: vehicles per the Construction Standards. Alteration #1: Changes to. 1143.13, 1143.14, and 1143.18 Planning Staff are proposing to add an additional permitted uses list for properties that are located in the DR-O with the underlying zoning of B-1 Local Retail District, B-2, General Business District, and the M-2 Light Industrial District.
